MOTION FOR EXECUTION

Plaintiffs XXXXXXXXXXX and XXXXXXXXXXXX, by themselves, to this
Honorable Court, respectfully avers that:

1. In a Decision dated ___________, copy of which was received on

even date, both herein plaintiffs and defendant were informed of this Honorable
Court’s decision of rendering judgment via compromise agreement, the relevant
portion of which are hereunder quoted, thus:

“6. Failure on the part of the defendant to pay the

conditions stated under paragraphs 2 or 3 and three (3)
monthly contributions under paragraph 4 shall give rise to
the acceleration of the whole balance, and shall entitle the
plaintiffs to ask for the writ of execution of the decision of
the Court;

It appearing that the agreement is not contrary to

law, morals, good customs and public policy, and pursuant
to Article 2028 and 2037of the Civil Code of the Philippines,
 the same is APPROVED and ADOPTED as the Decision of
the Court.
Parties are hereby directed to faithfully comply with
the terms and conditions of the agreement.

SO ORDERED.

GIVEN this 8th day of November, 2021 at Irosin,

2. As of the present moment however, the defendant failed and

continuously failed to comply what was decided by this Honorable Court via
Compromise Agreement;

3. Thus, and in accord with the aforesaid decision which had long
become final and executory, herein plaintiffs submit the hereunder prayer;

WHEREFORE, premises considered, it is respectfully prayed of this

Honorable Court that a Writ of Execution with respect to approved compromise
agreement be issued.
