THE PRESIDING OFFICER

 The Presiding Officer and Limitations on the His/Her Power


• He/she can vote only to break a tie.
• He/she can be elected as chairperson of any special committee.
• He/she cannot be elected as chairperson of any standing committee.
He/she cannot relinquish the chair to participate in the deliberation of the body.
 Powers and Duties of the Presiding Officer
• Preside over the session of the sanggunian
• Preserve order and decorum during sessions and in case of disturbance or
disorderly conduct in the session hall or within the premises, take measures as she
may deem advisable or as the sanggunian may direct
• Decide all questions of order, subject to appeal of any sanggunian member in
accordance with the internal rules of procedure
• Sign all acts, ordinances, resolutions, memorials, writs issued by, or upon order of
the sanggunian
• Exercise such other powers and perform such other functions as may be provided
by law, ordinance or regulation

THE SECRETARY

 Appointment and Compensation


composed of the secretary and staff responsible for providing technical and
administrative services necessary in legislative work; and headed by the secretary to
the sanggunian who is appointed by the vice governor/vice mayor.
 Powers and Duties of the Secretary
• Attend meetings of the sanggunian and keep a journal of its proceedings
• Keep the seal of the local government unit and affix the same with his/her
signature to all ordinances, resolutions, and other official acts of the sanggunian and
present the same to the presiding officer for his/her signature
• Forward to the governor or mayor, as the case may be, for approval, copies of
ordinances enacted by the sanggunian and duly certified by the presiding officer
• Forward to the sanggunian panlungsod or bayan concerned, in the case of the
Sangguniang Barangay, and to the Sangguniang Panlalawigan concerned, in the case
of the Sangguniang Panlungsod of component cities or Sangguniang Bayan, copies
of duly approved ordinances
• Furnish, upon request of any interested party, certified copies of records of public
character in his custody, upon payment to the treasurer of such fees as may be
prescribed by ordinance
• Record in a book kept for the purpose, all ordinances and resolutions enacted or
adopted by the sanggunian, with the dates of passage and publication thereof
• Keep his/her office and all non-confidential records therein open to the public
during the usual business hours

THE LEGISLATIVE PROCESS


 Ordinances and Resolutions Distinguished - Solid Waste Management
 Content and Form of Ordinances and Resolutions -
 First Reading – Filling of proposed ordinance on December 1, 2021
 Second Reading and Debate – Committee report on December 2, 2021
 Five-Minute Rule – Late during session will be sanctioned
 Approval of Measure on Second Reading – The proposed Resolution
ordinance will be transmitted to the members
 Third Reading – Amendments of the said proposal
 Approval of Resolutions – undergoes legislative process in the Sanggunian
Panlalawigan with Majority votes
 Voting – Majority decision
 Special Provision on the Budget Ordinance – it is included in the compilation
of acts and resolutions.
 Veto Override – if the Sanggunian Panlalawigan decides to overrides the veto,
the Presiding Officer shall proceed separately to reconsider the ordinance or
the vetoed items of ordinance.
 Enforcement of Disapproved Measures – if it is not good for everyone
 Effectivity of Enactment – December 3, 2021
DECORUM AND DEBATE
 Decorum Defined – as appropriate polite behavior in society
 Rules of Decorum - expect the presiding officer to protect your right to speak
even if it turns out that you're a minority of one, focus on issues, not
personalities, avoid questioning motives.
 Rules in Asking Questions - address remarks through the chair, use titles, not
names and be polite.
 Call to Order – Presiding Officer
