COM540 – MEDIA LAW, REGULATION &
ETHICS

CLO1: Discuss the relevant concepts of the media and law in the country. (C2)

Assessment: Individual assignment on media case study (ILAC) report to


emphasise the attribute of ‘knowledge’ in MQF 6 LOD.

Individual case study (20%)

1. The students have to find a media case study / court report and summarise it in
ILAC format. The guideline and example of format will be given in the
Padlet/Google classroom.
2. The students will need to get their case study approved first before proceeding
with report writing. Hence, consultation is a must.
3. The dateline of submission is on Week 5 of the semester.

1.0 INTRODUCTION TO PARTIES INVOLVED

Plaintiff/Appellant:
Introduce the parties involved here. Who are they? What is their position? For
example, Eliza Ezzauddin is a lecturer at the Faculty of Communication and Media
Studies in UiTM, Shah Alam. She is also an interdisciplinary PhD candidate in the
Department of Communication, International Islamic University Malaysia.

Defendant/Respondent:
Similar as above. However, if the parties involved are Public Prosecutor/Ministry of
Home Affairs/The Government, you will have to write down their basic role on the
case. For example, what is the role of the Public Prosecutor or the Ministry of Home
Affairs. You may also include their actual name if it is included in the court case, if it
is not included, you don’t have to be worried.

2.0 BACKGROUND OF THE CASE:


What happened in the real event, include in the chronology of the actual event. You
may include in timeline structure (table/graph). Do not forget to rephrase using your
own words. This doesn’t have to be too long. Just enough to explain what has
happened for the case to be brought in court.
3.0 ILAC REPORT SUMMARY

3.1 ISSUE
This is normally provided on top of the court report in italicized font and usually
starts with the word whether in Bahasa Melayu, it starts with ‘sama ada/samada’.
There will be more than one issues provided and also depending on the charges to be
discussed. Let’s say your case has several issues on Defamation Act and Penal Code.
You may focus your issues on Defamation only and list it out for your report
summary. For example:

1. Whether Eliza has made a defamatory remark towards Jimin.


2. Whether Eliza has communicated her defamatory remark on Jimin to the public.
3. Whether Jimin has suffered damages from Eliza’s defamatory remark.
4. Whether…… so on and so forth.

3.2 LAW

3.2.1 Referred legislations:


 In this part you will have to list out the all the legislations used on the case.
 If you are focusing on defamation, then you have to write down the section
used under Defamation Act only.
 For example…

Defamation Act, Section 7(1) mentioned that ……. Put in the whole section,
paraphrase this to your own sentence but make sure you do not misinterpret the
section. Do make sure you DO NOT write down any opinionated sentence here.

Defamation Act, Section 7(2) mentioned that ….

3.2.2 Referred case:


Choose only two (2) referred cases from the list given on the court report related to
your selected act, in this example, past cases on demation. Give a short one (1)
paragraph summary of each case. For example, ...
1. Kim Namjoon v BigHit Entertainment (2019)
And write down the short summary here on what happened in the case.

2. Public Prosecutor v ZICO (1996)


And write down the short one paragraph summary here too.

4. APPLICATION
In this section, you will have to answer your issues referring to the law and referred
cases used. Copy paste all your issues and justify the application of the law on your
each of the issues.

4.1 Whether Eliza has made a defamatory remark towards Jimin.


Provide proof with details that she has done this. For example, On February 30 th, 2020,
Eliza has made a statement to the press that Jimin is married to her and will retire
from his career. Eliza then attached a realistic edited photo of the matrimonial
ceremony to proof her statement. The exact statement is as follow:

“You may quote any actual defamatory statements here… if it is in Bahasa Malaysia,
write this down in italic font”

4.2 Whether Eliza has communicated her defamatory remark on Jimin to the
public.
Provide proof with details that she has done this.

4.3 Whether Jimin has suffered damages from Eliza’s defamatory remark.
Provide proof with details that she has done this.

4.4 Whether…… so on and so forth.


Provide proof with details that she has done this.
5.0 CONCLUSION
Here is where the court judgement if given. How long will Eliza be imprisoned and
how much should she pay for the damages done etc. Make sure you paraphrase the
contents without losing the actual meaning too.

6.0 REFERENCES
Provide your references list here in APA style (if any).
