Rule 1: Short title, scope and relation to special rules


 These rules are known as the AP State & Subordinate Services
Rules, 1996 (AP S&SS Rules, 1996).

 Also known as General Rules.

 Applies to the Gazetted & Non Gazetted posts under AP Govt.


Which have been constituted into various state & subordinate
services, whether temporary or permanent.

 Do not apply to the holders of the posts appointed by contract or


on agreement.

 Further, these rules cannot prevail over the other rules like
Special rules, Adhoc rules etc.,

 Consists of 31 important definitions.

Rule 3-A: Conditions of service


 The Rules / conditions existed at the time of entry into Govt.
service.
Ex: 1. The AP FR’s.
2. The scales of pay.
3. The AP CS (Conduct) Rules, 1964.
4. The AP CS (CC & A) Rules, 1991.
5. The AP Leave Rules, 1933 & so on .......... etc.,

Rule 3-b: application of rules


 The AP S&SS Rules, 1996 cannot prevail over the other rules of
a service, class or category for which special / Adhoc rules have
been made.

Rule 4: method of appointment


4 (a) 1. Direct recruitment.
2. Recruitment/Appointment by transfer.
3. Promotion, or.
4. Contract/Agreement/Re-employment.

4 (b): Direct recruitment shall be made only against the


substantive vacancies.
 Posts earmarked for DR shall be filled by Direct Recruits only.
 Percentage earmarked for Direct Recruitment:
33 1/3 percent in respect of posts in State Service.
30 percent in respect of posts in Subordinate Service.

Rule 5: selection posts

Rule : method of preparation of panels


In respect of Selection Posts:

 The appointing authority prepares panels in consultation


with DPC / SC.

 DPC (Departmental Promotion Committee) in r/o posts


outside the purview of the APPSC.

 SC (Screening Committee) in r/o posts within the purview


of the APPSC to recommend the names to the
Commission.

 Panel year: 1st September to 31st August of succeeding


year.

 1st September of the year shall be reckoned as the


qualifying date to determine the eligibility of a candidate
for inclusion in a panel.

 Currency of panel: 1st September to 31st December of


succeeding year or date of approval of panel for next year.
(Or)
Date of approval of panel for next year, whichever is
earlier.

 Vacancies arising from 1st September to 31st August


shall be considered.

 The zone of consideration: 1:3.

 The Panel can be reviewed after a period of 6 months


after its approval to consider unqualified candidates who
become qualified subsequently.

Rule 6 (i): Non-Selection Posts:

Rule 7: appointing authority

1st level Gazetted officer - Regional officer, if exists


otherwise HoD.

2nd level Gazetted officer - HoD.

3rd level & above Gazetted officers – Government.

Rule 9: appointment by agreement or contract


9 (a) (i):
 Provisions of agreement only apply.
 If no provision has been made in the agreement or contract,
promotions of these rules or special rules relatable to the post
shall apply.

Rule 10: temporary appointment including appointments


by direct recruitment, recruitment /
Appointment by transfer or by promotion
10 (a):
 Where it is necessary in the public interest to fill
(emergently) a vacancy.

 Adhoc promotions in exigencies of administration.

10 (e): The appointing authority shall have the right to


terminate the service of a person who was been
appointed under sub rule (a) at any time, without
assigning any reason and without any notice.

10 (g): No increment till fulfilling the qualifications or


completion of the training.

10 (i): Temporary posts requiring special qualifications.

Rule 11: the time limit for joining either on first


Selection or on promotion or on appointment
By transfer

a) Direct Recruitment – 30 days (from the date of despatch
of appointment order by RPAD).

b) Otherwise than by Direct Recruitment – 15 days (from


the date of receipt of appointment order by RPAD or any
other means).

Rule 12: qualifications for direct recruitment

 Sound Health, Active habits & free from any bodily defect
or infirmity etc.,

 Good character and antecedents.

 Academic qualifications prescribed.

 Must be a citizen of India.

 Must undergo training.

 Age limit (Open Category):


Minimum: 18 years
Maximum: 34 years as on 1st July.

(The Govt. have relaxed the maximum age limit from 34 years
to 42 years up to 30-09-2019 vide G.O. Ms. No. 132, GA (Ser-A)
Dept, Dated. 15-10-2018).

 Relaxation: 5 years for SCs, STs and BCs.

 Disqualifications:
1. Canvass or extraneous support from officials, non-
officials relatives etc.,
2. Bigamy.
3. Dismissal from service.
4. Conviction for an offence involving moral turpitude.

Rule 13: language test in telugu


 Pass in Language Test in Telugu within the period of probation
is compulsory.

 Probation shall be extended and increments in the time scale of


pay shall postponed to without cumulative effect till passing of
language test.

Rule 14: language test – exemption


Exemption from Passing of Language Test in Telugu.

 Pass in SSC / Equivalent / Higher examination with Telugu as


medium of instructions / Telugu as one of the Subject.

 On attaining the age of 45 years.

Rule 15: time to pass newly prescribed tests


 Newly prescribed tests should be passed within the period of
probation or within one year or in one of the 1 st two
examinations, whichever is later.

 Exemption shall be given to those employees on completion of


45 years of age either for the 1st stage promotion or for
appointment by transfer.

Rule1 : commencement of probation


16(a): Commences from date of his/her joining the duty or from
such other date as maybe specified by the appointing
authority.

16 (b): Minimum Service for commencement of probation is 60


days continuously on duty from the date of joining in
cases of promotion / appointment by transfer.

16 (c): Period of Probation:


1. For direct recruits: 2 years on duty within a continuous
period of 3 years.
2. For promotes / appointment by transfer: 1 year on duty
within a continuous period of 2 years.

16 (e): Tests to be passed during probation.


1. If does not pass tests, probation has to be extended for 1
year by the appointing authority and subsequently by
Government till passing the tests.
2. If does not pass within the period of extended period, the
date of commencement of probation be changed to a date
two years anterior to the date of passing the tests and the
seniority be reckoned from such date.
3. In case the probationer fails to pass the prescribed tests,
the appointing authority discharges him/her from service.

16(h): Change of date of commencement of probation – with


effect from the date fixed by the Govt.

Rule 17: suspension, termination or extension of


Probation
17 (a)(i): Probation can be suspended for want of vacancy.

17 (a)(ii): Probation can be terminated for


 Unsatisfactory performance or progress during training
or
 Unsatisfactory performance of duties or.
 Unsatisfactory conduct or.
 Any other sufficient reason to be recorded in writing.

17 (b): Probation can be extended for 1 year (not exceeding 1


year) in case of failure of passing tests.

Rule 18: declaration of probation


18 (a): After completion of prescribed / extended period of
probation the appointing authority shall take a decision
& issue order declaring satisfactory completed probation.

18 (b)(i): A decision to extend/suspend or discharge from service


should be taken within 8 weeks on expiry of probation
period.

18 (b) (ii): If no such order is passed within 1 year of expiry of


probation period, such employee be deemed to have
satisfactorily completed the period of probation and a
formal order should be issued.

 In case of charges pending, the above position does not


apply.

Rule 19: rights of a probationer and approved


Probationer for re-appointment
19 (a): First preference in filling up of a vacancy shall be given to
approved probationer or probationer, if available.

19(b)(i): Discharge of a Probationer or Approved Probationer:


 A probationer or an approved probationer shall be
discharged for want of vacancy in the order of juniority.

Rule 20: exercise of certain powers of appointing


Authority in respect of probationers
Appointing authority can:
 Discharge a probationer under rule 16(f) (i.e., failure to pass
tests) or under rule 17 (a)(ii) (i.e., unsatisfactory
performance).

 Extend probation of a probationer under rule 17(a)(ii) (i.e.,


extension of probation not more than 1 year) or under rule
17(b) (i.e., to enable the probationer to pass tests).

Rule 21: confirmation


 Employee declared to have satisfactorily completed his
probation, shall be confirmed as a number of that service.

In a unit of 100 vacancies:

 15 for SCs,

 6 for STs,

 29 for BCs (A-7%; B-10; C-1%; D-7% and E-4%)

 3 for PH persons (6-VH, 31-HH, 56-OH).

 2 (13 and 37) for Ex-Serviceman.

 In respect of SAs, JAs, Junior Stenos, Typists etc., in HoDs


and ASOs etc., in Secretariat, 2 roster points at 48 and 98
have been allotted for meritorious sports men.

22 (j): When there is only a single solitary post, no rule of


reservation applicable.

 Rule of reservation is applicable for appointment if the


number of posts is more than one even though selection is
made for only one vacancy.

 In respect of appointments by promotion or recruitment by


transfer from subordinate service to state service, the claims
of SCs & STs shall be considered on the basis of seniority
subject to fitness.

 Provided that a member of the SC or the ST possessing


superior merit & ability shall be allowed to supersede not
only others but also the members of SCs or STs as the case
may be.

 The vacancies in respect of SC, ST, BCs (Group-A to Group-


D) Women, handicapped shall be carried forwarded.

 POINTS TO BE REMEMBERED:
1. SC and ST vacancies are not inter-transferable.
2. The vacancies for backward classes are inter-
transferable only among the different groups.
3. The members belonging to SC, ST, and BC can also be
considered against OC vacancies.

Rule 22-a: women reservation in appointments


 33 1/3 % reservations for Woman w.e.f., 28-5-1996.

 In DR to posts for which women are better suited than men,


preference shall be given to women and it shall not result in
total exclusion of men.

 In the matter of DR to posts which are reserved exclusively


for women, they shall be filled by women only.

 In the matter of promotions to post for which women and


men are equally suited and where the cadre strength more
than 5 there shall be reservation to women to an extent of
33.1/3 % in favor of SCs and STs.

 In such cases, if no eligible women candidate is available to


fill up the roster point earmarked to them, the vacancy shall
be filled up with male SC/ST candidates as the case may be.

Rule 23: appeal, revision and review of orders of


Appointment (including promotion) to higher
Posts
 Order can be revised within 6 months by the appellate
authority on its own motion or on appeal filed by the aggrieved
employee.

 Revision can be made within 3 months on the appellate


authority order.

Rule 24: revision of lists of approved candidates


(Panels) or list of eligible candidates for
Appointment by promotion or by transfer
 The state Govt. shall have the power to revise.

 Such revision of lists of approved candidates (panels) can be


made by placing them before the DPC/Review DPC/SC&
obtaining recommendations.

 Revision can be made within 6 months from the date of original


order.

Rule 25: review


 The State Government may review its order or any order of
revision passed by them under Rule 24 if it was passed under
any mistake, whether of fact or of law, or in ignorance of any
material fact or for any other sufficient reason.

Rule 2 : appeal against seniority or other conditions


Of service
 Appeal against seniority or assignment of notional seniority on
par with junior be entertained by the appellate authority within
a period of 90 days from the date on which junior was promoted.

 Revision petition against the order of the appellate authority


shall be done within 3 months.

Rule 27: appointment of all india service officers and


apas officers to posts in the state services

Rule 28: relinquishment of rights by members


 Relinquishment of any privilege by the employee may be
accepted if it is in public interest.

 Such relinquishment once made will be final and irrevocable.

Rule 29: re-employment of members of service


Discharged on account of their suffering
From t.b., etc.

Rule 30: resignation


 Resignation forfeits past service.

 It takes effect from the date of relief, if the individual is on duty.

 It takes effect from the date of expiry of leave, if the individual is


on leave.

 The employee may withdraw his resignation before it takes


effect.
(No withdrawal of resignation of shall be permitted if the
withdrawal is made after the resignation takes effect in terms of
G.O.Ms. No. 33, GA (Ser-D) Dept, Dated. 04-02-2014).

 The Resignation of a Government Servant against whom


departmental proceedings are pending shall not be accepted.
(G.O.Ms.No. 250, GA(Ser-D) Dept, Dated. 14-07-2000).

 If the resignation is accepted, but has not taken effect and he


withdraws his resignation before it has taken effect, he should be
deemed to be continuing in service.

 A member of service, shall, if he resigns his appointment, forfeit


not only the service rendered by him in the particular post held by
him at the time of resignation but all his previous service under
the Government.

 Where a member of a service is selected for appointment by direct


recruitment to another post and is appointed to it, his lien on the
service or his probationary right, if any, in the former post shall
be retained for a period of three years or until he becomes an
approved probationer in the latter post, whichever is earlier; and
if before the expiry of three years he is not an approved
probationer in the latter post, unless he reverts to the parent
department, he shall be deemed to have resigned to the former
post with effect from the date on which the three years period
expires.

 Provided that nothing in this sub-rule shall affect the benefits


accrued to such member of a service in the previous post or
posts, except the lien or probationary right on such post or
posts.

Rule 31: relaxation of rules by the governor


 The Governor has the power to relax rules in public interest or
where the application of such rule or rules is likely to cause
undue hardship to the person or class of persons concerned in
respect of posts carrying a scale of pay of Junior Assistant and
above.

Rule 32: relaxation of rules by the heads of the


Department
 The Head of the Department is competent to relax rules
relating to transfer, promotion or other service conditions
governed by these rules or special rules in respect of posts
carrying a scale of pay less than that of Junior Assistant in his
Department.

Rule 33: seniority


33 (a): The seniority of a person is to determined with
reference to the date of first appointment to a service/class
category/grade.

33 (b):
 Regarding fixation of seniority among two persons who
join service simultaneously, the order of preference
fixed by the competent authority is the criterion.

 For candidates allotted by the APPSC, seniority with


reference to the order of merit or order of preference
assigned to them in the said list is final.

33 (c): If notional date for promotion is assigned such date shall


be taken into consideration for computing the qualifying
length of service in the feeder category for promotion to
next higher category. Such notional date should be
counted for the purpose of declaration of probation also in
the feeder category.

33(f): The seniority of retrenched employee on reappointment is


with reference to the date of reappointment.

Rule 34: preparation of integrated or common seniority


List of persons belonging to different units of
Appointment
 The list should be prepared with reference to the provisions of
sub rule (a) of Rule 33, provided that the seniority list of the
persons inter-se belonging to the same units shall not be
disturbed.

Rule 35: fixation of seniority in the case of transfers on


Request or on administrative grounds
35(a): Transfer on administrative grounds: Seniority shall be
determined w.ref. to the date of seniority of such member in
the former unit of appointment.

35(b): Transfer on Request: Seniority shall be determined w.ref. to


the date of his/her joining in the later unit of appointment.

Rule 3 : inter-se seniority where the dates of


Commencement of probation are same
i. In respect of DR candidates selected by APPSC or other
recruiting agency, the ranking assigned irrespective of the date
of commencement of probation.

ii. In respect of persons promoted or appointed by transfer, the


dates from which they were placed on their probation.

iii. In respect persons covered under item (ii) above, in case the
date of commencement of probation is same, whoever is aged
shall be the senior.

iv. In respect of persons appointed on transfer on administrative


grounds, the seniority shall be from the date on which the
individual was placed on probation in the original dept.

v. In respect of persons appointed on request transfer, the date of


joining of such person in the new department / unit.

Certain clarifications on seniority issued by Govt. vide


Circular Memo No. 16/Ser-A/98-99 of G.A (Ser-A) dept. Dt.
21-04-1999:
 For determining the seniority of the employee the provisions
contained in general rule 33 shall be followed.

 The seniority of a Direct Recruit is to be determined only from


the date of his/her joining duty but not from the date on which
the vacancy earmarked for direct recruitment arose.

 If an employee is promoted to a post earmarked for Direct


Recruit, his probation shall be reckoned from the date on which
he would have occupied the vacancy meant for promote.

 The inter-se Seniority of Direct Recruits shall be as per the


ranking assigned to them by the recruiting agency irrespective
of their dates of joining provided they all joined within the time
allowed for them to join as per Rule. 11 of general rules.

 The Seniority lists already finalized as per court orders need


not be disturbed, if they are finalized. If not yet done, they
should be finalized as per these instruction.

Rule 37: seniority of directly recruited candidates, re-


Allotted in consultation with a.p.p.s.c

 Seniority shall be assigned below the last regular candidate in


the concerned class or category in the unit to which such
candidate is re-allotted.

Rule 38: postings and transfers


 Transfer to a post shall be limited within the unit of
appointment or within in the jurisdiction of local cadres.

 Transfers shall be made by Appointing authority or any


authority superior to appointing authority or any subordinate
authority delegated such power.

 The HoD may transfer on tenure, from a local cadre to a post to


which the presidential order does not apply, where such posts
are required to be filled on tenure basis from such local cadres
and retransfer him/her to his/her local cadre.

 All inter local cadres transfers in public interest and on


reciprocal basis be made by Government only .
