INFORMATION

The undersigned prosecutor, hereby accuses DENNIS CORDOVA y

ALYANSA of the crime of violation of Section 5 Article 2 of RA 9165, otherwise
known as the “Comprehensive Dangerous Drugs Act of 2002” committed as
follows:

That on or about 2:30 PM At about September 1, 2021, in front of Security

Bank Andres Bonifacio corner Washington street, Tuguegarao City, Cagayan and
within the jurisdiction of this Honorable Court, the above-named accused, not
being authorized by law, did then and there willfully, unlawfully, and feloniously
sell one piece heat sealed transparent plastic sachet containing white crystalline
substance, methamphetamine hydrochloride locally known as “shabu”
weighting approximately 0.00804 grams, a dangerous drugs. The above-named
accused is apprehended by the police officers in violation of Section 5 of RA 9165.

opportunity to do so, there is reasonable ground to the believe that the accused
has committed the crime of Sale of Dangerous Drugs under Section 5 of R.A. 9165

Greetings:

I have the honor to refer to your Office, the records of investigation relative
to the case of Section 5 of R.A. 9165 committed at about September 1, 2021 in
Andres Bonifacio street corner Washington Street, Centro, Tuguegarao City,
Cagayan.

COMPLAINANT: PNP Tuguegarao

SUSPECT (Arrested/Detained): DENNIS CORDOVA y ALYANSA, 24 years old,

single, laborer, and a resident of Caritan Centro, of Tuguegarao City, Cagayan.

FACTS OF THE CASE:

At about 9 AM of September 1, 2021, Deputy Chief of Police PLt

Alyano A. Dalisay composed a team in coordination with PDEA Regional Office II
with Control Number 10000-032021-0084 with date September 1, 2021 900H. They
conducted a short briefing together with Confidential Informant (CI) for the
conduct of an anti-illegal drug buy-bust operation against the person of Kevin B.
Abad, and that the agreed place of transaction will be in front of Security Bank
in Andres Bonifacio corner Washington street, Tuguegarao City, Cagayan. PCMS
Manuel Chua coordinated to Brgy. Captain Leon Gannaban and Media
Representative Paul Lopez (DZCV Tuguegarao) to witness the conduct of the buy-
bust operation.

At around 2:30 PM of the same date, the buy-bust operation resulted in the arrest
of the suspect identified as one Dennis A. Cordova 24 years old, single, laborer,
and a resident of Brgy. Caritan Centro, Tuguegarao City, the confiscation of the
buy-bust stuff one (1) piece heat sealed transparent plastic sachet containing
white crystalline substance suspected to be methamphetamine hydrochloride
locally known as “shabu” and the buy-bust money of two (2) piece genuine one-
thousand-peso bill with serial numbers LY357764 and TH013585 and with an “X”
mark on the forehead of Josefa Llanes Escoda on each bill made by the poseur
buyer, and the death of one (1) Kevin B. Abad, 27 years old, single, laborer, and
a resident of Brgy. Linao Norte, Tuguegarao City, also an identified suspect. The
suspect was arrested after selling buy-bust stuff to Pat. Carlos C. Bacud, the police
officer who acted as a poseur buyer. The suspect was likewise informed of the
cause of his arrest and his rights under the Miranda Doctrine. The conduct of
inventory, photograph and markings on the pieces of evidence was done in the
parking space of the old Divine Mercy Wellness Center in order to preserve the
crime scene, in the presence of the suspect himself and the above-mentioned
witnesses. The suspect, so with the confiscated pieces of evidence i.e. one (1)
piece heat sealed transparent plastic sachet containing white crystalline
substance suspected to be methamphetamine hydrochloride locally known as
“shabu” and the buy-bust money of two (2) piece genuine one-thousand-peso
bill with serial numbers LY357764 and TH013585 and with an “X” mark on the
forehead of Josefa Llanes Escoda on each bill made by the poseur buyer was
brought to Tuguegarao City Police Station for proper documentation by the
Investigating Officer PSSG. Benjamin Praybeyt. Then subsequently, the suspect
and the confiscated pieces of evidence were brought to the PDEA Crime
Laboratory for drug analysis, weighing and drug examination.

The case will be presented by (Pat. Carlos Bacud as Poseur Buyer, PSSg
Benito Dayag and Danilo Escobar as Arresting Officers) of this office during the
course of inquest proceedings.

DETAILS OF COMPLAINT: Anti-Illegal Drug Buy-Bust Operation

At around 2:00 PM of September 1, 2021, duty investigator PSSg Benjamin

Praybeyt was dispatched to assist in the conduct of inventory to the confiscated
piece of evidence in the Anti-Illegal Drug buy bust operation that resulted to the
arrest of one Dennis A. Cordova 24 years old, single, laborer, and a resident of
Brgy. Caritan Centro, Tuguegarao City

The operating team returned at 5:00 PM of same date and brought to this
office the suspect who was arrested Andres Bonifacio corner Washington Street,
Centro, Tuguegarao City, Cagayan after selling One (1) pc heat sealed
transparent plastic sachet containing white crystalline substance suspected to be
methamphetamine hydrochloride locally known as “Shabu” to the member of
the operating team who acted as poseur buyer Pat Carlos Bacud during the buy
bust operation. Furthermore, aside from the buy bust stuff, the operating team
who acted as seizing/arresting officer, Pat Carlos Bacud confiscated from the
direct possession, control and custody of the suspect the buy bust money of two
(2) pieces of genuine One Thousand peso bill with serial no. LY357764 and
TH013585 and marked “X” on the forehead of Josefa LLanes Escoda on each bill.
That confiscated items were properly marked, inventoried by the poseur buyer,
seizing officer and photographed by PCpl Jaepee Bertday at the place of
transaction in the presence of the suspect witnessed by Brgy Captain Leon
Gannaban, Brgy. Centro, Tuguegarao City, Cagayan, Mr. Paul Lopez Media
representative of DZCV Tuguegarao City. The buy-bust stuff One (1) pc heat
sealed transparent plastic sachet containing white crystalline substance
suspected to be methamphetamine hydrochloride locally known as “Shabu” with
initial markings on the attached masking tape PCB - SH 9/1/21 2:30PM CENTRO,
TUGUEGARAO CITY, CAGAYAN with signature of Poseur Buyer were brought to
the Tuguegarao City Police Station and surrendered to the Duty Investigating
Officer at that time PSSg. Benjamin Praybeyt for Proper Documentation.
Subsequently, the buy-bust stuff buy-bust stuff One (1) pc heat sealed transparent
plastic sachet containing white crystalline substance suspected to be
methamphetamine hydrochloride locally known as “Shabu” with initial markings
on the attached masking tape PCB - SH 9/1/21 2:30PM CENTRO, TUGUEGARAO
CITY, CAGAYAN with signature of Poseur Buyer was brought to the PDEA RO2 for
Laboratory examination and drug test delivered by the Investigating Officer
together with the Poseur Buyer/Seizing Officer and Arresting Officer and the duty
driver.

That prior to the Drug Buy-Bust operation proper, Deputy Chief of

Police PLT Alyano Dalisay under the direct supervision of PMaj Hepe Hurey COP
conducted briefing in his office together with the CI who conducted monitoring
and surveillance to the subject. During the briefing PSSg Benito Dayag
coordinated with the PDEA R02 thru email while PCMS Manuel Chua contacted
Media Representative and a barangay official to witness the briefing and
conduct of operation but accordingly they will catch-up during inventory. The
operating team is equipped with the buy bust money two (2) pcs genuine One
thousand peso bill with serial no. LY357764 and TH013585 as the agreed value of
Shabu and on the said bills, Pat. Carlos Bacud put mark “X” on the forehead of
Josefa Llanes Escoda and Certificate of coordination number 10000-032021-0084
with date September 1, 2021 900H and upon receiving of coordination the CI
contacted Kevin B. Abad that there is an interested buyer of Shabu and both
agreed to meet in front of Security Bank, Andres Bonifacio corner Washington
Street, Centro, Tuguegarao City, Cagayan.

AFFIDAVIT OF POSEUR BUYER

I, Pat Carlos Bacud, 29 years old, single, PNP member assigned at

Tuguegarao City Police Station as Intelligence Operative and a resident of Brgy.
Awallan, Baggao, Cagayan after having sworn to an oath in accordance with
the law do hereby depose and state;

1. That I am designated as Intelligence Operative of Provincial Intelligence

Unit, Cagayan Provincial Office/ Provincial Drugs Enforcement Unit
(PIU/PDEU-CPPO)

2. That on or about 9:00 in the morning of September 1, 2021, while

rendering my official duties and responsibilities as Intel Operatives of
Tuguegarao City Police Station, our Deputy Chief of Police PLT Alyano
Dalisay instructed us to proceed in his office for a briefing regarding an
Anti-Illegal Drug buy-bust operation against KEVIN B. ABAD who
according to the Confidential Informant is indeed engaged in selling
illegal drugs particularly Shabu within the Area Of Responsibility of
Tuguegarao City, Cagayan;

3. DCOP PLT Alyano Dalisay instructed the CI to contact the subject KEVIN
B. ABAD on loud speaker mode informing him that there is an interested
buyer of shabu worth Two thousand pesos (P2000.00) and the subject
agreed to the CI and instructed him to bring along with him his friend
and just meet in front of Security Bank, Andres Bonifacio corner
Washington Street, Centro, Tuguegarao City, Cagayan at 2: 00 PM
wherein they will a white Ford Ranger to consummate the transaction.
That during the briefing at around 10:30 AM of the same date the
approved coordination from the PDEA R02 was received thru email with
coordination number 10000-032021-0084 with date September 1, 2021
900H.

4. That during the briefing, DCOP PLt Alyano A. Dalisay tasked me (Pat
Carlos Bacud) to be the poseur buyer so with the CI utilizing buy-bust
money of two (2) pieces genuine One-Thousand-peso bills with the serial
numbers LY357764 and TH013585 in which I marked “X” on the forehead
of Josefa Llanes Escoda on each respective bills. PSSg Benito Dayag and
PSSG Danilo Escobar were tasked to be the arresting/seizing officers so
with the rest of the team as a backup and security. It was also tackled
in the briefing that the agreed pre-arranged to show that the
transaction was consummated would be when the CI and the poseur
buyer will open the doors to alight from the vehicle;
5. Before the briefing started, PCMS Manuel Chua exerted his effort to
contact media representatives and barangay officials to attend the
briefing. PSSg Benito Dayag coordinated with the PDEA RO2 by sending
to them their pre-operation plan thru E-mail;

6. At around 1:30 PM, DCOP PLT Alyano Dalisay, under the direct
supervision of PMaj Hepe Hurey, COP, lead our team at the agreed
place of transaction wherein I (Pat Carlos Bacud) together with the CI
waited while the rest of the team strategically positioned themselves
near the area. That after few minutes of waiting, a white Ford Ranger
appeared and parked in front of the agreed place of transaction at
exactly 2PM. CI again contacted the subject Kevin B. Abad to inform
that we are waiting at the area and not long after, we were instructed
to board the white Ford Ranger. We boarded the white ford ranger, and
inside were Dennis A. Cordova who was at the driver’s seat and Kevin
Abad who was seated beside the driver. I was seated behind Kevin B.
Abad, and the CI was seated beside me to my left. A conversation
ensued between the CI and Kevin Abad. The CI introduced me (Pat
Carlo Bacud) to the subject and that I am the person who is an
interested buyer of “Shabu” worth two thousand pesos (P2000.00). After
a short talk between us, the CI asked for the “Shabu”. Dennis Cordova
reached in his right pocket and brought out 1 plastic sachet containing
white crystalline substance which I suspected as shabu. He handed said
plastic sachet to Kevin Abad who in turn, handed it to me, while I
subsequently handed the buy-bust money of two (2) pieces genuine
One Thousand peso bills with the serial numbers LY357764 and TH013585
to the Kevin B. Abad who immediately placed the buy-bust money
inside of his sling bag where I also saw a 45 Caliber gun however, Dennis
Crodova insisted that he should be the one to keep the money, so Kevin
Abad handed it to him and Dennis Cordova placed the marked money
in his right pocket. I immediately verified and when indeed the
transparent plastic sachet contains white crystalline substance
suspected to be “shabu”, I immediately opened the door and alighted
from the vehicle thus giving the pre-arranged signal, prompting the
Arresting Officers PSSg Benito Dayag and Danilo Escobar, and the
members of the backup team to immediately run towards the suspects
introducing themselves as PNP members of Tuguegarao City, Cagayan,
however, I heard PSSG Benito Dayag utter
“May baril!” and then Pat Carlo Bacud heard gunshots that caused him
to duck for his safety. When I got up, I saw blood oozing from the nape
of Kevin B. Abad which caused his death.

7. In the meantime, PSSg Danilo Escobar arrested Dennis Cordova suspect

Dennis Cordova was informed of the cause of his arrest and his
constitutional rights under Miranda Doctrine in a dialect that he can fully
understand. PSSg Danilo Escobar brought Dennis Cordova to the
parking space at the side of the Old Divine Mercy Wellness Center 10
meters away from Security Bank where he was frisked Right then and
there he conducted body search and found In his right pocket the buy
bust money of two (2) pieces genuine One-Thousand-peso bills with the
serial numbers LY357764 and TH013585 in which I (Pat Carlos Bacud)
 marked “X” on the forehead of Josefa Llanes Escoda on each
respective bills. In the same place, I, Pat Carlos Bacud(Poseur Buyer) put
my initial markings PCB - SH 9/1/21 2:30 PM CENTRO, TUGUEGARAO CITY,
CAGAYAN on the attached masking tape on the evidence One (1) pc
heat sealed transparent plastic sachet containing white crystalline
substance suspected to be methamphetamine hydrochloride locally
known as “Shabu” with my signature and PSSg Danilo Escobar put his
initials PDE – MM 9/1/21 2:30 PM CENTRO, TUGUEGARAO CITY, CAGAYAN
WITH HIS SIGNATURE on the buy bust money two (2) pieces genuine One
Thousand peso bills with the serial numbers LY357764 and TH013585 with
RESPECTIVE “x” marks on the forehead of Josefa Llanes Escoda.

8. SOCO, headed by Antonio Cortina arrived at 3pm to process the crime

scene as requested by the Investigating officer in light of the death of
one Kevin B. Abad during the conduct of the buy-bust operation. The
sling bag was found on the seat where Kevin was seated and inside of
it were 3 sachets containing white crystalline substance suspected as
“shabu” and 2 Government-issued ID’s i.e. Driver’s License and TIN ID. A
45 caliber gun was also found at the floor where Kevin was seated;

9. The Barangay Captain and Media Representative arrived at 4PM at the

place of arrest and the confiscated pieces of evidence was
immediately marked and inventoried.

10. The team complied with the requirements of Section 21 of R.A. 9165 as
amended by R.A. 10640 and its IRR and conducted inventory and taking
of photographs at the place of apprehension and in the presence of
the arrested suspect being witnessed by Barangay Captain Leon
Gannaban – Elected Public Official and Mr. Paul Lopez, DZCV
Representative. The witnesses signed the inventory of property seized
and were given copies. The Photograph of inventory was taken by PSSg
Jaepee Bertday;

11. Later the suspect was identified as DENNIS CORDOVA y ALYANSA, 24

years old, single, and a resident of Caritan Centro, Tuguegarao City,
Cagayan.

12. After the inventory, I (Pat Carlos Bacud), together with PSSg Benito
Dayag and PSSg Danilo Escobar brought the arrested suspect and
confiscated pieces of evidence to Tuguegarao City Police Station (Main
Office) utilizing the Toyota Innova Patrol Car for documentation and
proper disposition

13. We immediately brought the arrested suspect and confiscated pieces

of drug evidence seized from the suspect to PDEA R02 Laboratory
Office, Camp Adduru, Brgy. Caggay, Tuguegarao City for laboratory
examination and screening.

That I am executing this affidavit to attest to the truthfulness of the foregoing

and to file a case of Violation RA 9165 (Comprehensive Dangerous Drugs Act of
2002) Section 5 selling against the arrested suspect DENNIS A. CORDOVA;
 IN WITNESS WHEREOF, I have here unto affix my signature below this 1st day
of September 2021 at Tuguegarao City, Cagayan.

This Judicial Affidavit of Pat Carlos Bacud is executed to serve as his direct
testimony in the instant case.

I, Pat Carlos Bacud, Filipino, of legal age, single, and resident of Brgy. Awallan,
Baggao, Cagayan, witness in this case, state under oath as follows:

PRELIMINARY STATEMENT

That in accordance with A.M. No. 12-8-8-SC, which prescribes the use of judicial
affidavits to serve as the Direct testimony of the witnesses, on the basis of which
the adverse party may conduct their cross- examination on such a witness, I
hereby execute this judicial affidavit in a question and answer format;
That conformably with section 3 (b) of the said A.M. No. 12-8-8-SC, I also state that
the person examining me is Pros. Lance Adrian Tumanguil of the Office of the
Provincial Q:utor with office address at Carig Sur, Tuguegarao City. The
examination is being held at the same address.

That conformably under also with section 3 (c) thereof, I am answering his
questions fully conscious that I do so under oath and may face criminal liability for
false testimony and perjury.

PURPOSE

This affidavit/testimony of witness Pat Carlos Bacud is being offered to prove that:

1. He is designated as Intelligence Operative of Provincial Intelligence Unit,

Cagayan Provincial Office/ Provincial Drugs Enforcement Unit (PIU/PDEU-
CPPO);

2. That he was designated as Poseur Buyer by DCOP PLT Alyano Dalisay in the
briefing for the buy-bust operation against accused Dennis Cordova;

3. That during the briefing he was given two (2) pieces genuine One-Thousand-
peso bills with the serial numbers LY357764 and TH013585 in which he marked
“X” on the forehead of Josefa Llanes Escoda on each respective bills to be
utilized as buy7-bust money.

4. That during the buy-bust operation, a sale was consummated between him
and the Accused Dennis Cordova.

5. That the chain of custody has been established

6. That he made an affidavit stating the conduct of the buy-bust operation.

7. That he will also identify certain documents and pieces of evidence and other
facts in relation to the examination he conducted.

A: I am Pat Carlos Bacud, 29 years old, single, PNP member assigned at
Tuguegarao City Police Station as Intelligence Operative and a resident of Brgy.
Awallan, Baggao, Cagayan

5. Q: how long have you been in the service as a police officer?

A: I have been in service for almost 5 years now, started since 2016.

6. Q: What is your designation?

A: I am designated as Intelligence Operative of the Provincial Intelligence
Unit, Cagayan Provincial Office/ Provincial Drugs Enforcement Unit.

7. Q: Since when were you designated at Provincial Intelligence Unit?

A: Since 2018.

8. Q: Usually what do you do as an Intelligence Operative?

A: We conduct buy bust operations, surveillance and office work.

9. Q: On the the 1st of September, where were you?

A : I was at the office at the Tuguegarao City Police Station rendering my
official duties and responsibilities as intel operative.

10.Q: Were you given any particular task during that day?
A: Yes

11.Q: and what was it?

A: We were briefed by our Deputy Chief of Police PLT Alyano Dalisay for a
bust buy operation.

12.Q: Why?
A: A confidential informant came to our office and informed us that certain

A: After the briefing, we arrived at security bank - the agreed place of

A: I was with our Deputy Chief PLT Alyano Dalisay, the Arresting Officers PSSG
Dayag and Escobar and the rest of the back-up team.

27.Q: What did you do when you arrived at the place of transaction?
 A: we waited for the arrival of the Kevin Abad, while the rest of the team
positioned themselves near the area of transaction.

28.Q: When you say “we” who are you referring to?
A: I (Pat Carlos Bacud) and the CI.

29.Q: What time did Kevin arrive?

A: exactly 2pm, sir, as agreed.

30.Q: What vehicle did he arrive in?

A: the white ford ranger, Sir

31.Q: After their arrival what did you do?

A: the CI contacted Kevin to inform him that we are waiting in front of
security Bank.

32.Q: what was the response of the Subject Kevin Abad?

A: he instructed us to board his vehicle, which we subsequently did.

A: I saw Dennis Cordova in the driver’s seat and beside him was Kevin
Cordova.

A: the CI introduced me as the person interested to buy 2000 pesos worth of
shabu to the subject Kevin Abad.

35.Q: Were you immediately handed the shabu?

A: No, Sir. we had a short talk and after which, the CI asked for the Shabu.

36.Q: Did they give you the Shabu after the CI asked for it?
A: Yes, Sir.

37.Q: Who gave you the shabu?

A: it was dennis who passed it to kevin who in turn passed it to me.

38.Q: So you mean to say the shabu came from Dennis?

A: yes sir, he took it out of his right pocket.

39.Q: After receiving the shabu, what did you do?

A: I handed the buy bust money to kevin, Sir.

40.Q: Did Kevin keep the buy-bust money?

 A: no, sir. dennis insisted to keep the money instead.

41.Q: After handing the buy-bust money, what did you do with the shabu?
A: I immediately verified the plastic sachet and it contained white crystalline
substance which I suspected to be shabu.

42.Q: After you verified, what did you do next?

A: I gave the pre-arranged signal.

43.Q: And what is the pre-arranged signal?

A: I immediately opened the door and alighted form the vehicle.

44.Q: And what is the importance of this pre-arranged signal?

A: to notify the arresting officers and the team that the sale has been
consummated.

A: I put initial marking on the attached masking tape of the plastic sachet,

I, PSSg Benito Dayag, 30 years old, married PNP Member assigned at

Tuguegarao City Police Station and PSSg Danilo Escobar 33 years old, married
PNP Member assigned at Tuguegarao City Police Station as Intelligence
operatives after having sworn to an oath in accordance with the law do hereby
depose and state;

1. That I (PSSg Benito Dayag) was designated as Intelligence Operative of

Provincial Drug Enforcement Unit, Cagayan Police Provincial Office,
Camp Tirso H. Gador, Tuguegarao City Cagayan and I (PSSg Danilo
Escobar) was designated as Intelligence Operative of Regional Drug
Enforcement Unit, Police Regional Office, Camp MARCELO Adduru,
Tuguegarao City, Cagayan

2. That on or about 9:00 in the morning of September 1, 2021, while

rendering my official duties and responsibilities as Intel Operatives of
Tuguegarao City Police Station, our Deputy Chief of Police PLT Alyano
Dalisay instructed us to proceed in his office for a briefing regarding an
Anti-Illegal Drug buy-bust operation against KEVIN B. ABAD who
according to the Confidential Informant is indeed engaged in selling
illegal drugs particularly Shabu within the Area Of Responsibility of
Tuguegarao City, Cagayan;

3. PLT Alyano Dalisay instructed the CI to contact the subject KEVIN B.

ABAD on loud speaker mode informing him that there is an interested
buyer of shabu worth Two thousand pesos (P2000.00) and the subject
agreed to the CI and instructed him to bring along with him his friend
and just meet in front of Security Bank, Andres Bonifacio corner
Washington Street, Centro, Tuguegarao City, Cagayan at 2: 00 PM
wherein they will a white Ford Ranger to consummate the transaction.
That during the briefing at around 10:30 AM of the same date the
approved coordination from the PDEA R02 was received thru email with
coordination number 10000-032021-0084 with date September 1, 2021
900H;

4. That during the briefing, DCOP PLt Alyano A. Dalisay tasked Pat Carlos
Bacud to be the poseur buyer so with the CI utilizing buy-bust money of
two (2) pieces genuine One-Thousand-peso bills with the serial numbers
LY357764 and TH013585 in which I marked “X” on the forehead of Josefa
Llanes Escoda on each respective bills. I (PSSg Benito Dayag) and I
(PSSG Danilo Escobar) were tasked to be the arresting/seizing officers so
with the rest of the team as a backup and security. It was also tackled
in the briefing that the agreed pre-arranged to show that the
 transaction was consummated would be when the CI and the poseur
buyer will open the doors to alight from the vehicle;

5. Before the briefing started, PCMS Manuel Chua exerted his effort to
contact media representatives and barangay officials to attend the
briefing. PSSg Benito Dayag coordinated with the PDEA RO2 by sending
to them their pre-operation plan thru E-mail;

6. At around 1:30 PM, DCOP PLT Alyano Dalisay, under the direct
supervision of PMaj Hepe Hurey, COP, lead our team at the agreed
place of transaction wherein Pat Carlos Bacud together with the CI
waited , while we and the rest of the team strategically positioned
ourselves near the area; That after few minutes of waiting, a white Ford
Ranger appeared and parked in front of the agreed place of
transaction at exactly 2PM. CI alias “Gom-gom” again contacted the
subject Kevin B. Abad to inform that he and Pat Bacud are waiting at
the area and not long after, they boarded the white Ford Ranger.

7. After a while, the pre-arranged signal commenced, the car door

opened and the Poseur buyer and CI alighted from the vehicle, which
prompted us to approach the vehicle to arrest the driver and the
passenger in the front seat. I was about to open the car door to arrest
Kevin B. Abad when I (PSSG Benito Dayag) saw him holding a gun and
aiming it against Danilo Escobar who was about to Arrest Dennis A.
Cordova, so I shouted “May baril!” to warn my fellow arresting officer
and I shot Kevin B. Abad from behind at his nape which ultimately
caused his death.

8. In the meantime, I (PSSg Danilo Escobar) arrested Dennis Cordova was

informed of the cause of his arrest and his constitutional rights under
Miranda Doctrine in a dialect that he can fully understand. I brought
Dennis Cordova to the parking space at the side of the Old Divine Mercy
Wellness Center 10 meters away from Security Bank where he was frisked
by the same. Right then and there I conducted body search and there
I found In his right pocket the buy bust money of two (2) pieces genuine
One-Thousand-peso bills with the serial numbers LY357764 and TH013585
in which the poseur buyer Pat Carlos Bacud marked “X” on the forehead
of Josefa Llanes Escoda on each respective bills. In the same place, Pat
Carlos Bacud(Poseur Buyer) put his initial markings PCB - SH 9/1/21 2:30
PM CENTRO, TUGUEGARAO CITY, CAGAYAN on the attached masking
tape on the evidence One (1) pc heat sealed transparent plastic sachet
containing white crystalline substance suspected to be
methamphetamine hydrochloride locally known as “Shabu” with his
signature and I (PSSg Danilo Escobar) put initials PDE – MM 9/1/21 2:30
PM CENTRO, TUGUEGARAO CITY, CAGAYAN WITH MY SIGNATURE on the
buy bust money two (2) pieces genuine One Thousand peso bills with
the serial numbers LY357764 and TH013585 with RESPECTIVE “x” marks on
the forehead of Josefa Llanes Escoda.

9. SOCO, headed by Antonio Cortina arrived at 3pm to process the crime

scene as requested by the Investigating officer in light of the death of
 one Kevin B. Abad during the conduct of the buy-bust operation. The
sling bag was found on the seat where Kevin was seated and inside of
it were 3 sachets containing white crystalline substance suspected as
“shabu” and 2 Government-issued ID’s i.e. Driver’s License and TIN ID. A
45 caliber gun was also found at the floor where Kevin was seated

10. The Barangay Captain and Media Representative at 4PM at the place
of arrest and the confiscated pieces of evidence was immediately
marked and inventoried.

14. The team complied with the requirements of Section 21 of R.A. 9165 as
amended by R.A. 10640 and its IRR and conducted inventory and taking
of photographs at the place of apprehension and in the presence of
the arrested suspect being witnessed by Barangay Captain Leon
Gannaban – Elected Public Official and Mr. Paul Lopez, DZCV
Representative. The witnesses signed the inventory of property seized
and were given copies. The Photograph of inventory was taken by PSSg
Jaepee Bertday;

11. Later the suspect was identified as DENNIS CORDOVA y ALYANSA, 24

years old, single, and a resident of Caritan Centro, Tuguegarao City,
Cagayan.

12. After the inventory, we, together with Pat Carlos Bacud brought the
arrested suspect and confiscated pieces of evidence to Tuguegarao
City Police Station (Main Office) utilizing the Toyota Innova Patrol Car for
documentation and proper disposition

13. We immediately brought the arrested suspect and confiscated pieces

of drug evidence seized from the suspect to PDEA R02 Laboratory
Office, Camp Adduru, Brgy. Caggay, Tuguegarao City for laboratory
examination and screening.

That we are executing this affidavit to attest to the truthfulness of the

foregoing and to file a case of Violation RA 9165 (Comprehensive Dangerous
Drugs Act of 2002) Section 5 selling against the arrested suspect DENNIS A.
CORDOVA.

PREPARATORY STATEMENT
That the taking of my Judicial Affidavit was administered and supervised by
Prosecutor Marlon P. Saquing, and was done at the City Prosecutors Office,
Tuguegarao City, and I am fully aware and cognizant of the questions asked of me
by Prosecutor Marlon P. Saquing and my answers thereto are under oath being aware
that I may face criminal liability for false testimony or perjury, to wit:
Q1: Can you state your real name, age and personal circumstance?
A1: I am Danilo Escobar 33 years old, married form Centro 10, Tuguegarao City.
I am a Member of the Philippine National Police and was assigned at
Tuguegarao City Police Station as Intelligence Operatives.

Q2: Mr. Escobar, how many years are you in the service as a member of the
Intelligence Operatives?
A2: I’ve been in the service for almost 8 years, Sir.
Q3: As a member of the Intelligence Operative what are your usual task?
A3: We do Surveillance, Buy Bust Operation and office works.

Q4: Mr. Escobar, so do you remember any event that transpired on September 1,
2021?
A4: Yes Sir, we received a call coming from our Chief of Police that we are going
to conduct a Buy Bust Operation.

Q5: So upon arriving at the Police Station, what did you do Mr. Escobar?
A5: We conducted a briefing and meeting for the conduct of the Buy Bust
Operation.

Q6: And what is the tasked given to you during the briefing?
A6: I was tasked to be the Arresting Officer together with PSSg. Benito Dayag.

Q7: Where will the buy bust operation be conducted Mr. Escobar?
A7: At the Security Bank, Andres Bonifacio Corner Washington Street.

Q8: Upon arriving at the place, where did you positioned your selves
A8: The Building in front of the Security Bank Sir.

Q9: How far was the building from the Bank?

A9: 10 meters away from the Bank Sir.

Q10: Can you describe the place where you positioned yourself Mr. Witness?
A10: It is a two story building beside the street and there is a pathway for the
people who will pass along the building.

Q11: While waiting for the signal of the poseur buyer what are you doing Mr.
Witness?
A11: I am talking with the sales lady outside the building while looking at the
vehicle.
Q12: Where does the poseur buyer and the CI positioned upon arriving at the
bank?
A12: They first talked with the Kevin Abad and after which they went inside a
white Ford Ranger.

Q13: How many minutes did you wait outside Mr. Escobar?
A13: We waited for 30 minutes.

Q14: After 30 minutes of waiting, what did you do?

A14: When the poseur buyer and the CI alighted from the white Ford Ranger we
immediately proceeded to the white Ford Ranger to arrest Kevin Abad and the
accused.

Q15: Did you successfully arrest Kevin Abad and Dennis Cordova?
A15: No, Sir.

Q16: Why?
A16: When I open the door of the car to arrest him, I saw Kevin Abad holding a
gun and aiming it against me.

Q17: And what did you do?

A17: Lumuhod po ako agad nung sumigaw si officer Dayag, and to save me,
Dayag shot Kevin in the nape.

Q18: After that incident what happened next Mr. Escobar?

A18: I arrested Dennis Cordova and brought him to a safer place.

Q19: Upon arresting Dennis Cordova, have you mentioned anything to him Mr.
Escobar?
A19: Yes, Sir.

Q20: And what is that Mr. Escobar?

A20: I informed him of his Miranda Rights.

Q21: Where did you bring Dennis Cordova?

A21: I brought him at the parking space of the Old Divine Mercy?

Q22: How many meters is that from the Bank?

A22: 10 meters away from the Bank, Sir.

Q23: After bringing him at the parking lot of the Old Divine Mercy what did you
do to him?
A23: I immediately conducted a body search.

Q24: Did you find anything from the accused?

A24: Yes Sir. I found in his right pocket the buy bust money of 2 pieces of
genuine One thousand Peso Bill with an X mark on the fore head of Josefa Llanes
Escoda.

Q25: How did you know that it was the buy bust money?
A25: Because of the markings made by the poseur buyer during the briefing.

Q26: Now, Mr. Witness, after you confiscated the marked money, what happened
next?
A26: We conducted the marking of the confiscated pieces of evidence.

Q27: Who was present during the markings?

A27: The Media Representative, The barangay Captain the poseur buyer the
accused and me, Sir.

Q28: Who marked the confiscated buy bust money?

A28: I marked the confiscated buy bust money.
Q29: After the markings and inventory of the confiscated item, what happened
next?
A29: The accused was brought to Tuguegarao City Police Station and together
with the marked evidences for proper documentation by the Investigating Officer.

Q30: When you brought the accused to the Police Station, what did you do next?
A30: The Chief of Police requested for the Laboratory Exam of the confiscated
sachet containing white crystalline substance.

Q31: Was you request being approved?

A31: Yes, Sir.

Q32: How did you know that your request was approved?
Q33: There was an acknowledgement and letter of approval from the crime
Laboratory.

Q34: When you received the approval letter what did you do next?
Q34: We transported the plastic sachets containing white crystalline substance to
the Crime Laboratory.

Q35: Who received the plastic sachets containing white crystalline substance?
A35: Godzilla Dinglasan, the chemist, Sir.

Q36: And what was the result Mr. Witness?

A36: The plastic sachets containing white crystalline substance is POSITIVE of
SHABU Sir.

Q37: How did you know that it is Positive Mr. Witness?

Q37: The Laboratory Result that was given to us by the Chemist.

This Judicial Affidavit of Godzilla Dinglasan is executed to serve as his direct

testimony in the instant case.

I, Godzilla Dinglasan, Filipino, of legal age, single, and living at 39 Phase 2

Perpetual Village, Buntun, Tuguegarao City, Cagayan, witness in this case, state
under oath as follows:
PRELIMINARY STATEMENT

That in accordance with A.M. No. 12-8-8-SC, which prescribes the use of judicial
affidavits to serve as the Direct testimony of the witnesses, on the basis of which
the adverse party may conduct their cross- examination on such a witness, I
hereby execute this judicial affidavit in a question and answer format;

That conformably with section 3 (b) of the said A.M. No. 12-8-8-SC, I also state that
the person examining me is Pros. Lance Adrian Tumanguil of the Office of the
Provincial Prosecutor with office address at Carig Sur, Tuguegarao City. The
examination is being held at the same address.

That conformably under also with section 3 (c) thereof, I am answering his
questions fully conscious that I do so under oath and may face criminal liability for
false testimony and perjury.

PURPOSE

This affidavit/testimony of witness Godzilla Dinglasan is being offered to prove

that:

1. He is a Chemist in profession and currently working in the Philippine Drug

Enforcement Agency, Regional Office II Laboratory, Camp Marcelo
Adduru, Tuguegarao City, Cagayan

2. That he was requested by PMaj HEPE HUREY to conduct qualitative and

quantitative examination on the seized illegal drugs.

3. That after conducting chemical examination, he confirmed that the heat-

sealed transparent sachet containing white crystalline substance
submitted to him is methamphetamine hydrochloride or shabu.

4. That he made a report stating the result of his examination.

5. That he will also identify certain documents and pieces of evidence and
other facts in relation to the examination he conducted.

for false testimony of perjury if you lie?

B. I want to give my testimony regarding the examination that I conducted
on an alleged heat-sealed transparent sachet containing
methamphetamine hydrochloride or shabu.

4. Q. Please state your name and your personal circumstances.

A. I am Godzilla Dinglasan, a resident of 39 Phase 2 Perpetual Village, Buntun,
Tuguegarao City, Cagayan, and I am a chemist currently working in the
Philippine Drug Enforcement Agency, Regional Office II Laboratory, Camp
Marcelo Adduru, Tuguegarao City, Cagayan.

5. Q. How long have you been a chemist?

A. I have been a chemist for almost twelve (12) years now.

6. Q. What is your designation at the Philippine Drug Enforcement Agency,

Regional Office II Laboratory?
A. I am designated as Chemist II.

7. Q. You mentioned earlier that you examined the alleged illegal; drugs, who
requested the examination of said illegal drugs?
A. PMaj HEPE HUREY requested the examination of the illegal drugs that they
seized during a buy-bust operation.

8. Q. Who turned over the said illegal drugs to you?

A. It was PMaj HEPE HUREY who turned over the seized illegal drugs to me.

9. Q. Do you have any evidence to prove that you received the said illegal drugs?

A. Yes, Sir. Before the seized illegal drugs were turned over to me, I signed a
chain of custody form.
10. Q. I am showing to you a document entitled Chain of Custody Form previously
marked as Exhibit “_H__”. Can you please examine whether this is the same
document that you signed to prove the receipt of the seized illegal drugs?
A. Yes, Sir. This is the document that I signed to prove that I received the illegal
drugs.

11. Q. You also mentioned earlier, that there was a request for you to examine
the alleged illegal drugs. Do you have any evidence to prove that a request for
the examination of the illegal drugs was actually made?
A. Yes, Sir. I received a document from PMaj. HEPE HUREY, requesting me to
examine the alleged illegal drugs.

12. Q. I am showing to you a Memorandum requesting for Laboratory

Examination of the seized illegal drugs. Can you please examine whether this is
the same document?

A. Yes, Sir. This is the document that I have received form PMaj. HEPE HUREY.
