I hereby certify that the accused was lawfully arrested without a warrant
and that upon being informed of his rights, refused to waive the provisions of
Article 125 of the Revised Penal Code and, for this reason , an inquest was
conducted; that based on the complaint and the evidence presented before
me without any countervailing evidence submitted by the accused, despite
opportunity to do so, there is reasonable ground to the believe that the accused
has committed the crime of Sale of Dangerous Drugs under Section 5 of R.A. 9165
and should, thus, be held liable for said crime.

Greetings:
I have the honor to refer to your Office, the records of investigation relative
to the case of Section 5 of R.A. 9165 committed at about September 1, 2021 in
Andres Bonifacio street corner Washington Street, Centro, Tuguegarao City,
Cagayan.
At around 2:30 PM of the same date, the buy-bust operation resulted in the arrest
of the suspect identified as one Dennis A. Cordova 24 years old, single, laborer,
and a resident of Brgy. Caritan Centro, Tuguegarao City, the confiscation of the
buy-bust stuff one (1) piece heat sealed transparent plastic sachet containing
white crystalline substance suspected to be methamphetamine hydrochloride
locally known as “shabu” and the buy-bust money of two (2) piece genuine one-
thousand-peso bill with serial numbers LY357764 and TH013585 and with an “X”
mark on the forehead of Josefa Llanes Escoda on each bill made by the poseur
buyer, and the death of one (1) Kevin B. Abad, 27 years old, single, laborer, and
a resident of Brgy. Linao Norte, Tuguegarao City, also an identified suspect. The
suspect was arrested after selling buy-bust stuff to Pat. Carlos C. Bacud, the police
officer who acted as a poseur buyer. The suspect was likewise informed of the
cause of his arrest and his rights under the Miranda Doctrine. The conduct of
inventory, photograph and markings on the pieces of evidence was done in the
parking space of the old Divine Mercy Wellness Center in order to preserve the
crime scene, in the presence of the suspect himself and the above-mentioned
witnesses. The suspect, so with the confiscated pieces of evidence i.e. one (1)
piece heat sealed transparent plastic sachet containing white crystalline
substance suspected to be methamphetamine hydrochloride locally known as
“shabu” and the buy-bust money of two (2) piece genuine one-thousand-peso
bill with serial numbers LY357764 and TH013585 and with an “X” mark on the
forehead of Josefa Llanes Escoda on each bill made by the poseur buyer was
brought to Tuguegarao City Police Station for proper documentation by the
Investigating Officer PSSG. Benjamin Praybeyt. Then subsequently, the suspect
and the confiscated pieces of evidence were brought to the PDEA Crime
Laboratory for drug analysis, weighing and drug examination.
The case will be presented by (Pat. Carlos Bacud as Poseur Buyer, PSSg
Benito Dayag and Danilo Escobar as Arresting Officers) of this office during the
course of inquest proceedings.

THIS IS TO CERFITY that as per record from the Official Record Book this station,
there appears an entry to wit:
The operating team returned at 5:00 PM of same date and brought to this
office the suspect who was arrested Andres Bonifacio corner Washington Street,
Centro, Tuguegarao City, Cagayan after selling One (1) pc heat sealed
transparent plastic sachet containing white crystalline substance suspected to be
methamphetamine hydrochloride locally known as “Shabu” to the member of
the operating team who acted as poseur buyer Pat Carlos Bacud during the buy
bust operation. Furthermore, aside from the buy bust stuff, the operating team
who acted as seizing/arresting officer, Pat Carlos Bacud confiscated from the
direct possession, control and custody of the suspect the buy bust money of two
(2) pieces of genuine One Thousand peso bill with serial no. LY357764 and
TH013585 and marked “X” on the forehead of Josefa LLanes Escoda on each bill.
That confiscated items were properly marked, inventoried by the poseur buyer,
seizing officer and photographed by PCpl Jaepee Bertday at the place of
transaction in the presence of the suspect witnessed by Brgy Captain Leon
Gannaban, Brgy. Centro, Tuguegarao City, Cagayan, Mr. Paul Lopez Media
representative of DZCV Tuguegarao City. The buy-bust stuff One (1) pc heat
sealed transparent plastic sachet containing white crystalline substance
suspected to be methamphetamine hydrochloride locally known as “Shabu” with
initial markings on the attached masking tape PCB - SH 9/1/21 2:30PM CENTRO,
TUGUEGARAO CITY, CAGAYAN with signature of Poseur Buyer were brought to
the Tuguegarao City Police Station and surrendered to the Duty Investigating
Officer at that time PSSg. Benjamin Praybeyt for Proper Documentation.
Subsequently, the buy-bust stuff buy-bust stuff One (1) pc heat sealed transparent
plastic sachet containing white crystalline substance suspected to be
methamphetamine hydrochloride locally known as “Shabu” with initial markings
on the attached masking tape PCB - SH 9/1/21 2:30PM CENTRO, TUGUEGARAO
CITY, CAGAYAN with signature of Poseur Buyer was brought to the PDEA RO2 for
Laboratory examination and drug test delivered by the Investigating Officer
together with the Poseur Buyer/Seizing Officer and Arresting Officer and the duty
driver.

3. DCOP PLT Alyano Dalisay instructed the CI to contact the subject KEVIN
B. ABAD on loud speaker mode informing him that there is an interested
buyer of shabu worth Two thousand pesos (P2000.00) and the subject
agreed to the CI and instructed him to bring along with him his friend
and just meet in front of Security Bank, Andres Bonifacio corner
Washington Street, Centro, Tuguegarao City, Cagayan at 2: 00 PM
wherein they will a white Ford Ranger to consummate the transaction.
That during the briefing at around 10:30 AM of the same date the
approved coordination from the PDEA R02 was received thru email with
coordination number 10000-032021-0084 with date September 1, 2021
900H.
4. That during the briefing, DCOP PLt Alyano A. Dalisay tasked me (Pat
Carlos Bacud) to be the poseur buyer so with the CI utilizing buy-bust
money of two (2) pieces genuine One-Thousand-peso bills with the serial
numbers LY357764 and TH013585 in which I marked “X” on the forehead
of Josefa Llanes Escoda on each respective bills. PSSg Benito Dayag and
PSSG Danilo Escobar were tasked to be the arresting/seizing officers so
with the rest of the team as a backup and security. It was also tackled
in the briefing that the agreed pre-arranged to show that the
transaction was consummated would be when the CI and the poseur
buyer will open the doors to alight from the vehicle;
5. Before the briefing started, PCMS Manuel Chua exerted his effort to
contact media representatives and barangay officials to attend the
briefing. PSSg Benito Dayag coordinated with the PDEA RO2 by sending
to them their pre-operation plan thru E-mail;
6. At around 1:30 PM, DCOP PLT Alyano Dalisay, under the direct
supervision of PMaj Hepe Hurey, COP, lead our team at the agreed
place of transaction wherein I (Pat Carlos Bacud) together with the CI
waited while the rest of the team strategically positioned themselves
near the area. That after few minutes of waiting, a white Ford Ranger
appeared and parked in front of the agreed place of transaction at
exactly 2PM. CI again contacted the subject Kevin B. Abad to inform
that we are waiting at the area and not long after, we were instructed
to board the white Ford Ranger. We boarded the white ford ranger, and
inside were Dennis A. Cordova who was at the driver’s seat and Kevin
Abad who was seated beside the driver. I was seated behind Kevin B.
Abad, and the CI was seated beside me to my left. A conversation
ensued between the CI and Kevin Abad. The CI introduced me (Pat
Carlo Bacud) to the subject and that I am the person who is an
interested buyer of “Shabu” worth two thousand pesos (P2000.00). After
a short talk between us, the CI asked for the “Shabu”. Dennis Cordova
reached in his right pocket and brought out 1 plastic sachet containing
white crystalline substance which I suspected as shabu. He handed said
plastic sachet to Kevin Abad who in turn, handed it to me, while I
subsequently handed the buy-bust money of two (2) pieces genuine
One Thousand peso bills with the serial numbers LY357764 and TH013585
to the Kevin B. Abad who immediately placed the buy-bust money
inside of his sling bag where I also saw a 45 Caliber gun however, Dennis
Crodova insisted that he should be the one to keep the money, so Kevin
Abad handed it to him and Dennis Cordova placed the marked money
in his right pocket. I immediately verified and when indeed the
transparent plastic sachet contains white crystalline substance
suspected to be “shabu”, I immediately opened the door and alighted
from the vehicle thus giving the pre-arranged signal, prompting the
Arresting Officers PSSg Benito Dayag and Danilo Escobar, and the
members of the backup team to immediately run towards the suspects
introducing themselves as PNP members of Tuguegarao City, Cagayan,
however, I heard PSSG Benito Dayag utter
“May baril!” and then Pat Carlo Bacud heard gunshots that caused him
to duck for his safety. When I got up, I saw blood oozing from the nape
of Kevin B. Abad which caused his death.
10. The team complied with the requirements of Section 21 of R.A. 9165 as
amended by R.A. 10640 and its IRR and conducted inventory and taking
of photographs at the place of apprehension and in the presence of
the arrested suspect being witnessed by Barangay Captain Leon
Gannaban – Elected Public Official and Mr. Paul Lopez, DZCV
Representative. The witnesses signed the inventory of property seized
and were given copies. The Photograph of inventory was taken by PSSg
Jaepee Bertday;
12. After the inventory, I (Pat Carlos Bacud), together with PSSg Benito
Dayag and PSSg Danilo Escobar brought the arrested suspect and
confiscated pieces of evidence to Tuguegarao City Police Station (Main
Office) utilizing the Toyota Innova Patrol Car for documentation and
proper disposition
JUDICIAL AFFIDAVIT
OF
WITNESS PAT CARLOS BACUD
This Judicial Affidavit of Pat Carlos Bacud is executed to serve as his direct
testimony in the instant case.
I, Pat Carlos Bacud, Filipino, of legal age, single, and resident of Brgy. Awallan,
Baggao, Cagayan, witness in this case, state under oath as follows:
PRELIMINARY STATEMENT
That in accordance with A.M. No. 12-8-8-SC, which prescribes the use of judicial
affidavits to serve as the Direct testimony of the witnesses, on the basis of which
the adverse party may conduct their cross- examination on such a witness, I
hereby execute this judicial affidavit in a question and answer format;
That conformably with section 3 (b) of the said A.M. No. 12-8-8-SC, I also state that
the person examining me is Pros. Lance Adrian Tumanguil of the Office of the
Provincial Q:utor with office address at Carig Sur, Tuguegarao City. The
examination is being held at the same address.
That conformably under also with section 3 (c) thereof, I am answering his
questions fully conscious that I do so under oath and may face criminal liability for
false testimony and perjury.
PURPOSE
This affidavit/testimony of witness Pat Carlos Bacud is being offered to prove that:
2. That he was designated as Poseur Buyer by DCOP PLT Alyano Dalisay in the
briefing for the buy-bust operation against accused Dennis Cordova;
3. That during the briefing he was given two (2) pieces genuine One-Thousand-
peso bills with the serial numbers LY357764 and TH013585 in which he marked
“X” on the forehead of Josefa Llanes Escoda on each respective bills to be
utilized as buy7-bust money.
4. That during the buy-bust operation, a sale was consummated between him
and the Accused Dennis Cordova.
7. That he will also identify certain documents and pieces of evidence and other
facts in relation to the examination he conducted.
2. Q. Are you aware that you are under oath and may be criminally charged
for false testimony of perjury if you lie?
A. Yes, Sir.
10.Q: Were you given any particular task during that day?
A: Yes

A: A confidential informant came to our office and informed us that certain
Kevin B. Abad is engaged in the proliferation of Illegal Drugs in Tuguegarao
City.
18.Q: How much money will you be using to buy from the suspect?
Witness : 2 genuine 1000 peso bill with serial numbers LY357764 and TH013585
26.Q: Who were you with when you went to the agreed place of transaction?
A: I was with our Deputy Chief PLT Alyano Dalisay, the Arresting Officers PSSG
Dayag and Escobar and the rest of the back-up team.
27.Q: What did you do when you arrived at the place of transaction?
A: we waited for the arrival of the Kevin Abad, while the rest of the team
positioned themselves near the area of transaction.
28.Q: When you say “we” who are you referring to?
A: I (Pat Carlos Bacud) and the CI.
33.Q: Upon boarding the vehicle, who did you see inside?
A: I saw Dennis Cordova in the driver’s seat and beside him was Kevin
Cordova.
36.Q: Did they give you the Shabu after the CI asked for it?
A: Yes, Sir.
41.Q: After handing the buy-bust money, what did you do with the shabu?
A: I immediately verified the plastic sachet and it contained white crystalline
substance which I suspected to be shabu.
45.Q: What did you do with the plastic sachet containing white crystalline
substance?
A: I put initial marking on the attached masking tape of the plastic sachet,
Sir.
47. Q. I have no more questions to ask, do you wish to add or change any of
your answers?
A. None, Sir and no more.

10. The Barangay Captain and Media Representative at 4PM at the place
of arrest and the confiscated pieces of evidence was immediately
marked and inventoried.
14. The team complied with the requirements of Section 21 of R.A. 9165 as
amended by R.A. 10640 and its IRR and conducted inventory and taking
of photographs at the place of apprehension and in the presence of
the arrested suspect being witnessed by Barangay Captain Leon
Gannaban – Elected Public Official and Mr. Paul Lopez, DZCV
Representative. The witnesses signed the inventory of property seized
and were given copies. The Photograph of inventory was taken by PSSg

12. After the inventory, we, together with Pat Carlos Bacud brought the

That the taking of my Judicial Affidavit was administered and supervised by

A1: I am Danilo Escobar 33 years old, married form Centro 10, Tuguegarao City.
I am a Member of the Philippine National Police and was assigned at
Tuguegarao City Police Station as Intelligence Operatives.
Q2: Mr. Escobar, how many years are you in the service as a member of the
Intelligence Operatives?
A2: I’ve been in the service for almost 8 years, Sir.
Q3: As a member of the Intelligence Operative what are your usual task?
A3: We do Surveillance, Buy Bust Operation and office works.
Q4: Mr. Escobar, so do you remember any event that transpired on September 1,
2021?
A4: Yes Sir, we received a call coming from our Chief of Police that we are going
to conduct a Buy Bust Operation.
Q5: So upon arriving at the Police Station, what did you do Mr. Escobar?
A5: We conducted a briefing and meeting for the conduct of the Buy Bust
Operation.
Q6: And what is the tasked given to you during the briefing?
A6: I was tasked to be the Arresting Officer together with PSSg. Benito Dayag.
Q7: Where will the buy bust operation be conducted Mr. Escobar?
A7: At the Security Bank, Andres Bonifacio Corner Washington Street.
Q8: Upon arriving at the place, where did you positioned your selves
A8: The Building in front of the Security Bank Sir.
Q10: Can you describe the place where you positioned yourself Mr. Witness?
A10: It is a two story building beside the street and there is a pathway for the
people who will pass along the building.
Q11: While waiting for the signal of the poseur buyer what are you doing Mr.
Witness?
A11: I am talking with the sales lady outside the building while looking at the
vehicle.
Q12: Where does the poseur buyer and the CI positioned upon arriving at the
bank?
A12: They first talked with the Kevin Abad and after which they went inside a
white Ford Ranger.
Q13: How many minutes did you wait outside Mr. Escobar?
A13: We waited for 30 minutes.
Q15: Did you successfully arrest Kevin Abad and Dennis Cordova?
A15: No, Sir.
Q16: Why?
A16: When I open the door of the car to arrest him, I saw Kevin Abad holding a
gun and aiming it against me.
Q19: Upon arresting Dennis Cordova, have you mentioned anything to him Mr.
Escobar?
A19: Yes, Sir.
Q23: After bringing him at the parking lot of the Old Divine Mercy what did you
do to him?
A23: I immediately conducted a body search.
Q25: How did you know that it was the buy bust money?
A25: Because of the markings made by the poseur buyer during the briefing.
Q26: Now, Mr. Witness, after you confiscated the marked money, what happened
next?
A26: We conducted the marking of the confiscated pieces of evidence.
Q30: When you brought the accused to the Police Station, what did you do next?
A30: The Chief of Police requested for the Laboratory Exam of the confiscated
sachet containing white crystalline substance.
Q32: How did you know that your request was approved?
Q33: There was an acknowledgement and letter of approval from the crime
Laboratory.
Q34: When you received the approval letter what did you do next?
Q34: We transported the plastic sachets containing white crystalline substance to
the Crime Laboratory.
Q35: Who received the plastic sachets containing white crystalline substance?
A35: Godzilla Dinglasan, the chemist, Sir.
Q39: Are you willing to sign this affidavit to certify that all the statements you made
is true?
A39: Yes.

That in accordance with A.M. No. 12-8-8-SC, which prescribes the use of judicial
affidavits to serve as the Direct testimony of the witnesses, on the basis of which
the adverse party may conduct their cross- examination on such a witness, I
hereby execute this judicial affidavit in a question and answer format;
That conformably with section 3 (b) of the said A.M. No. 12-8-8-SC, I also state that
the person examining me is Pros. Lance Adrian Tumanguil of the Office of the
Provincial Prosecutor with office address at Carig Sur, Tuguegarao City. The
examination is being held at the same address.
That conformably under also with section 3 (c) thereof, I am answering his
questions fully conscious that I do so under oath and may face criminal liability for
false testimony and perjury.

other facts in relation to the examination he conducted.

3. . Why are you here in our office today?
B. I want to give my testimony regarding the examination that I conducted
on an alleged heat-sealed transparent sachet containing
methamphetamine hydrochloride or shabu.
7. Q. You mentioned earlier that you examined the alleged illegal; drugs, who
requested the examination of said illegal drugs?
A. PMaj HEPE HUREY requested the examination of the illegal drugs that they
seized during a buy-bust operation.
9. Q. Do you have any evidence to prove that you received the said illegal drugs?
A. Yes, Sir. Before the seized illegal drugs were turned over to me, I signed a
chain of custody form.
10. Q. I am showing to you a document entitled Chain of Custody Form previously
marked as Exhibit “_H__”. Can you please examine whether this is the same
document that you signed to prove the receipt of the seized illegal drugs?
A. Yes, Sir. This is the document that I signed to prove that I received the illegal
drugs.
11. Q. You also mentioned earlier, that there was a request for you to examine
the alleged illegal drugs. Do you have any evidence to prove that a request for
the examination of the illegal drugs was actually made?
A. Yes, Sir. I received a document from PMaj. HEPE HUREY, requesting me to
examine the alleged illegal drugs.
A. Yes, Sir. This is the document that I have received form PMaj. HEPE HUREY.

A. I immediately conducted my examination on the seized illegal drugs.
