We have reviewed the accounts of the Municipality for calendar year 2021 and

observed the following deficiency:

The Municipality did not renew its Radio Station License issued by the National
Telecommunications Commission (NTC) for the operation of radio communication
equipment in the LGU contrary to Section 1 of Republic Act No. 3846.

Section 1 of Republic Act (RA) No. 3846 provides that:

No person, firm, company, association or corporation shall construct, install,

establish, or operate a radio station within the Philippine Islands without having first
obtained a franchise therefor from the Philippine Legislature; Provided however,
That no franchise from the Legislature shall be necessary for the construction,
installation, establishment or operation of a broadcasting station, an amateur station,
an experimental station, a training station, a station on board a mobile vessel, train,
or aircraft, or a private station in a place without any means of communication.

RA No. 3846, otherwise known as the Radio Laws of the Philippines, mandates the
National Telecommunications Commission (NTC) to effectively implement Radio Rules and
Regulations in the Philippines which include the need to secure the necessary
licenses/permits for the purchase and operation of radio communication equipment.

Pursuant to its mandate, the NTC Regional Office through its OIC-Regional Director,
requested in a letter dated January 4, 2022 that government agencies be reminded to secure
the necessary permits for radio communication equipment in compliance with the above-
mentioned provision of law.

Our review disclosed that the Radio Station License issued by the NTC for the
operation of government fixed base radio station in the LGU has already expired on
November 22, 2019 (Annex A). Consequently, the use and operation of the municipality’s
base radio station in the succeeding periods is considered unlicensed.

We recommend that Management renew its Radio Station License with the
National Telecommunications Commission (NTC) for the operation of fixed base radio
station in the LGU in compliance with Republic Act No. 3846.
