You have approached and requested us to earmark, in your favour, the said ‘Apartment, with the right to use the Parking Space/s as an amenity attached to the said Apartment, We have considered your request and have agreed to earmark in your favour the said Apartment at or for a total consideration of Rs [e]/- (Rupees [¢] Only) (CPurehase Price") alongwith the right to use the Parking Space/s as an amenity thereto. The Agreement for Sale will be fxecuted and registered as and when called upon by us. The Booking Amount will be adjusted by us, towards the Parchase Price, on your executing and registering the ‘Agreement for Sale, () The Agreement For Sale records and contains inter-ali () the details of the (Common Areas and Amenities ofthe Project and the Limited Common Areas and ‘Amenities ofthe Project, (i) the details of the amenities proposed to be provided in ‘the suid Apartment and (ji) the other charges and deposits payable by you. (6) All stamp duty, registration charges and other incidental charges payable in respect of the execution and registration ofthe Agreement for Sala shall be bore 1 and paid solely by you. (a) Ifyou fail to execute and register Agreement for Sale within period cf 30 (thirty) days as and when callad upon by us then you shall be in breach of this LOI and we hall be entitled to terminate this LOI and earmarking ofthe said Apartment without ‘any notice to you. (©) On termination of this LOI, we shall refund to you the Booking Amount after eciucting i) pre-estimated liquidated damages (which you and we consider to be reasonable, and not asa penalty) equivalent to 20% (twenty percent) ofthe Booking ‘Amount, and (i) accrued taxes. (@) Notwithstanding anything to th contrary herein, the aforesaid refund by us shall ‘be made only after expiry of 30 (Thirty) days from the date on which such refund ‘becomes due to you.
