Questions related to Ashghal typical contract general conditions 2007 version:

1.What is the allowable period of time for a contractor such that he must obtain the
required Performance Bond according to Ashghal General Conditions 2007? What are the
acceptable entities who can issue performance bonds?

2. Who is responsible for inspecting the physical conditions of the site?


The contractor

3. What is the purpose of clause 13 under the general obligations section?


The purpose of clause 13 is that the contractor must follow the instructions of the engineer or the
engineer’s representative

4. What is the permissible period such that the contractor must submit detailed schedule of
work for the project?

5. How the contractor is protected for injuries during construction? And which section or
clause support your answer?
The contractor must have an insurance against any injury to workers and this insurance must be
with insurer approved by PWA.

6. What section that protects the rights of labor and prove that they are receiving the
appropriate wages in accordance to local Qatari regulations?

7. By default, is night time construction allowed in any project? Which section or clause
supports your answer?
No, it’s not allowed to work at night time, but if it’s necessary there must be a written permission
to work at night from the engineer representatives.
8. What is meant by Method of Measurement? And what are the different allowable
Methods to be used for quantities?
Method of measurement provide detailed information, classification table and rules for
measuring building work, also it is used in preparation of bill of quantities.

1.What is the language of the contract documents and all communication per the particular
conditions of the project? Which clause supports your answer?
The language of contract documents and all communication is English.

2. What is the main subject of clause 45 (2)? And who will pay the supervision in such case?
Engineer’s overtime: this clause describes the action that must be taken when the contractor
wants to work after the normal hours of work in order to complete the work at the date set in the
contract.
The contractor will pay for supervision.

3. What is the situation if the contractor was delayed due to local regulation procedure?
The contractor must be provided with time extension and the engineer determine how long will
be this additional period.

4.In your own understanding summarize clause 51 (3). Do not copy words express it in
meaningful equations.
This clause describe what actions must be done when there is any addition to the contract price,
so according to clause 51(3) any additional work must be valuated at the rates and prices set out
in the contract, but if the contract does not include the rates of any additional work so the prices
must be determined as the following:

3. Basic cost of plant and machinery
Basic cost must not include any site management cost. For work performed by contractor it must
have limit of 15% and for work performed by subcontractor it must not exceed 8% of basic cost
and 7% of subcontractor actual cost for contractor markup.
When BOQ contract is used the contractor must not be entitled for any markup or any additional
payment.

5. Summarize clause 60 (9) in your own simplified short paragraph.


The total of advance payments and the number of equipment and the time needed to install them,
must be declared in the appendix of contract. The engineer must issue a temporary payment
when the contractor delivers the performance bond and the bank guarantee to the owner in an
amount equal to the advance payment. The bank guarantee must be valid until the payment
repaid and it must decrease gradually by the amount paid by the contractor. If a problem
happened and the advance payment has not been repaid, so the whole of the balance become due
and payable by the contractor to owner.
6. What is the minimum fire rating of temporary facilities at the site?
Walls: Thermal conductance – 0.60 w/m20c
Fire resistance: - 0.5 hours
Roof: Thermal conductance – 0.60 w/m20c
Fire resistance: - 0.5 hours

7. How are the daily activities recorded in the project? What provisions related to such
topic in the specifications and QCS 2014?
The contractor must submit the site diary on daily basis to engineer or engineer’s representative
latest on beginning of following day
Provision of guarantees, warranties and bonds and Provision of operation and maintenance
manuals.
