section 18: Maintenance of a wife

Husband has the responsibility to give maintenance to wife

Conditions for wife to claim maintenance

 Dissertion: leaving the matrimonial hope, husband is forcing wife to leave the house .
dissertion must be there at least for 2 years. but she can claim maintenance immediate after
a month

 Cruelty by the husband. ---------physical & mental

 If the husband is suffering for viral form of leprosy
 Husband has another wife/illegal relation
 Concubine relation
 Conversion of religion by husband
 If the reason is just and proper

Conditions for wife cannot claim maintenance

 Unchaste—sexual relationship of wife

 Illegal relation
 Conversion of religion by wife

Effect of passing decree of maintenance by court ---no need to stay with the husband

Section 19: Maintenance of widowed daughter-in-law

Widowed D.I.L can claim:

 Only when she is not getting income from the properties of husband
 If she is not earning
 If she does not have children/ children are unable to maintain

Cannot claim

 If the father.I.L has no means to maintain

 If she has a remarriage
 Conversion of religion by wife
