(the “Applicant” etain a rail safety consultant to assess the development proposal sit relates toa single industrial spur rll rack that uns adjacent to the properties at 56-60 Felday Road (the Project” or Sit’) Hatch has been retained by Stowe Holdings Ltd. to complete this assessment. This letter reviews the development proposal ‘against the most recent industry guidelines for development in proximity to rail infrastructure to ensure (a) the development proposal aligns with the guidelines; and (b) adequate mitigation measures are being undertaken. ‘The Sites bound by Fieldway Road tothe southeast, a Hydro One corridor to the northwest, and industrial and residential uses tothenortheast and southwest. The ingle industrial spur track connects to the Canpa Spur, which feeds into the Canadian Pacific (CP) owned Galt Sublvision rll coridor futher tothe north. These details arelustrated in Figure 1 below. ‘Figure 1: Canadian Pacific Rolway ‘reo H Industrial Track ‘The industial area serviced by this rack i refered to as‘AveaH inthe CP timetable, This single trackis referred to asthe ‘Area H Industral Track’ and i only used for running freight cars into the industrial area to serve local industry. The CP timetableisincluded in APPENDIXA Rall traffic datais not published publicly ormade available by CP, the rail operator, Information requests to CP Rallin April 2021 and May 2021 for this data went unanswered and CP has indicated that they will no longer be sharing trafic volume data with external groups. This correspondence is included in APPENDIX. Asindustrial activity in the area declines over ‘time and land use patterns change, the frequency of approximately 2 or less trains per day, is anticipated to decline. The applicable guidelines for development in proximity to ral are the Federation of Canadian Municipalities (FCM) the Railway ‘Association of Canada (RAC) Guidelines for New Development in Proximity to Railway Operotions (2013) and the City of Toronto's Land Use Study: Development in Proximity to Rall Operations Guidelines (2019), include specific recommendations for development adjacent to or in close proximity tospur lines as follows: 1. Sethacks: The recommended building setback for new residential redevelopment adjacent to spur lines is 15 metres. 2. Safety Barrier: There are no requirements for a safety barir for new developments adjacent toa spur ine track 3. _ Noise Mitigation: The recommended minimum noise influence area when undertaking noise studies along a spur line track is t5 ewes ‘The ste plan for 56-60 Fieldway Road and the Area H Industrial Track are shown in Figure 2 below. of "Figure 2: Proposed Development Site (Source: TACT Architecture) [A15-metre building setbacks proposed from the Area H Industral Track (propery line), shown in Figure 3below tomeet the recommended guidelines. The FCM/RAC Guidelines state: “appropriate uses within the setback area include public ond private roads porkiand and other outdoor recreational space including backyards, swimming pools, anal tennis courts, unenclosed gazebos; garages and other parking structures, and storage sheds" (pg 28). The proposed ‘outdoor recreation space within the 15-metre setback ofthe industrial rack is consistent withthe applicable guidelines. ‘At the eastem end ofthe property, the small land parcel severed by the Area H Industrial Trackis proposed as a public park and ‘outdoor recreation space which, as a non-sensitiv, low occupancy land use is also considered an acceptable use within proximity othe industrial spur ine track. Lastly, as part ofthis review the possibilty ofa train derailment along the industrial spur ine track s considered. Using the AECOM Development of Crash Wal Design Loads fram Theoretical Tran impact for AECOM Guidelines) energy balance analysis (Method 2, the resutsindicate that a train traveling t the maximum allowable speed of 7mph onthe industrial spur line track would not reach the subject property line. Further, rail traffic data is merely a snapshot in time, and traffic volumes are subject to fluctuation as a function of market demand. Information that | am able to share would be that current operations along any CP track include regular freight trains travelling through, 24 hours a day, 7 days a week. With these operations, engines are constantly running and the operations are continuous, loud and cause a lot of vibration. Rail traffic volume on any part of our North American network is a function of market demand. Traffic volumes fluctuate regularly as market demand for goods and commodities shifts or as export patterns change and does not have a set schedule. . Any development near railway infrastructure should assume the potential for frequent train activity at any time of the day or night, on any day of the year. There is also the possibility of increasing operations in future being increased, including adding or moving track or any other railway related use.
