1. What are the current issues about the 1987 Philippines Constitution? List at least three.

One of the reasons why the Philippines is in this state today is because of our current 1987
Philippine Constitution that was issued by President Corazon Aquino. Since the Filipino people
always strive for democracy, reconstructing the constitution is significant because it guarantees
individuals who make policies on behalf of the nation do so fairly. It also explains how those in
positions of authority can be held responsible to the public they serve. Even so, a question
remains whether the current Philippine constitution was still effective due to the slow progress
of the nation, poverty, injustices, corruption that still happens today. It became evident that the
Philippine constitution possesses numerous issues.

One of the obvious issues is the current constitution of the Philippines imposed political
dynasties. According to Section 26 of Article II, Declaration of State Principles and Policies, the
government shall promote fair access to public service opportunities and restrict political
dynasties as specified by law. In this manner, the 1987 Constitution may have reduced political
dynasties by simply stating what is prohibited. The inability of the constitution to forecast the
emergence of dynasties was a major error. The 1987 constitution fostered the formation of
political dynasties by failing to restrict or outright prohibit them. This results in the
incompleteness of the congress and the prevention of the formation of genuine political parties.

Nevertheless, the constitution also restricts peripheral regions in congress. This could be seen in
the current organization of the Legislative Department, as stated in Article VI, Section 2, which
stipulates that the Senate should be constituted of twenty-four Senators who shall be voted at
plurality by registered Filipino citizens, as authorized by law.

Furthermore, the constitution kept economic development from expanding. Article XII, which
deals with the Country's Economy and Heritages, limits foreign ownership to 40%. This limits
foreign direct investment and slows economic progress and improvement that may allow the
Country's economy to reach its full potential.

2. Is there a need to change or revise the current 1987 Constitution? Why or why not?

Yes, we perceived that the current 1987 Constitution needed to be amended. Since the current
constitution of the Philippines is not effective anymore to the country’s current concerns and
difficulties. Such problems would still continue due to the existing Philippine constitution that
imposes political dynasties and established an excessively potent president that causes
weakening on democratic institutions. Since the presidency is the leader of either the nation or
the administration, such concern may be ascribed to the country's political system
(Presidential). The president's authority and responsibilities are defined in Article VII, specifically
the Executive Branch. Section 1 expressly asserts that executive power shall be bestowed on the
president, and subsequent Sections such as 16, 17, 18, 19, 20, expand the president's authority
by granting him power, influence, and instruction over various executive departments, agencies,

and organizations. The president is also the nation's top-ranked official, with the authority to
revoke the writ of habeas corpus and grant pardons. In conclusion, the Philippines’ political
system and the economy would not improve if the government, as well as the constitution,
would remain the same. Injustices, poverty, corruption, and the nation's slow progress would be
far from over due to the incompetent people in the government and to the constitution that
restricts the creation of worthy political parties
