As I am aggrieved by decision/no decision of Central/State Public

Information Officer and/or First Appellate Authority, I hereby file this
appeal for your kind decision.

5. Particulars of the application –

5.1 Please provide official email id of all the municipal officers of East
Delhi Municipal Corporation for both zones, from commissioner
level to the lowest level.

6. Brief facts leading to the appeal-

6.1 The applicant has filed the RTI vide Application No.
EDLMC/R/2021/60639 in EDMC on 07/10/2021. No reply was
received from the PIO within the time period of 30 days.
6.2 The applicant has filed the first appeal vide Application No.
EDLMC/A/2021/60205 in EDMC on 06/12/2021. The details were
given in the appeal of the concerned First Appellate Authority. The
applicant contacted the Director of IT Department. The applicant
was asked by Director IT, to provide the RTI application on the
Whatsapp and First Appellate Authority promised to reply of appeal
within the time period.
6.3 The First Appellate Authority failed to give a satisfactory reply to
the applicant. The First Appellate Authority disposed of the request
on 07/01/2022 by giving a web link which is non-functional. The
applicant again requested the First Appellate Authority to provide
the details but no reply or acknowledgement is received.
7. Prayer or relief sought –

7.1 In view of the aforesaid facts and circumstances of the case, it is

most respectfully prayed to provide the information asked in the RTI
vide Application No. EDLMC/R/2021/60639.
7.2 As per Section 20 of the RTI Act, 2005, it is prayed that the Central
Information Commission should be imposed a penalty of two
hundred and fifty rupees each day till information is furnished, the
total amount of such penalty shall not exceed twenty-five thousand
rupees.

8. Grounds for the prayer or relief-

8.1 The First Appellate Authority disposed of the request on 07/01/2022

and sent a link in the reply which is non-functional. The applicant
again requested the First Appellate Authority to provide the details
but no reply or acknowledgement is received.
8.2 The First Appellate Authority knowingly has given incorrect
information which may be treated as no reply received, in
contravention of the RTI ACT 2005, reproduced under:
Under Section 20 of the RTI Act, 2005. “ 20. (1) Where the Central
Information Commission or the State Information Commission, as
the case may be, at the time of deciding any complaint or appeal is
of the opinion that the Central Public Information Officer or the
State Public Information Officer, as the case may be, has, without
any reasonable cause, refused to receive an application for
information or has not furnished information within the time
specified under sub-section (1) of section 7 or malafidely denied the
request for information or knowingly given incorrect, incomplete or
misleading information or destroyed information which was the
 subject of the request or obstructed in any manner in furnishing the
information.”

VERIFICATION:

I, Avnish Kumar Tyagi, the applicant do hereby verify at Delhi on

this 13th day of January, 2021 that the contents of the second appeal
are true and correct to the best of my knowledge and nothing
material has been concealed there from.
