CLAIM INSTRUCTIONS
IN CASE OF LOSS / SHORTAGE OR DAMAGE TO CARGO

In the event of loss/shortage or damage, the observance of the following instructions is INDISPENSABLE 1

Ⅰ ACTIONS TO BE TAKEN
1. Inform Marine Insurance Services SIA as soon as possible by sending email to claims@marineinsurance.lv or alternatively
during office hours by phone: +371 67830730 or using emergency 24/7/365 AOH phone number: +371 28 688 777 providing
the following information:
• Cargo description and details of accident;
• Identity and contact details of carrier, warehouse or other person responsible for accident;
• Warehouse address or location of accident and contact details for survey arrangements.
2. Take all reasonable measures to protect the goods and minimize loss or damage.
3. Preserve all recovery rights against all carriers and/or liable Third Parties.
4. Submit claim documents to Underwriters as quickly as possible and in any case before the expiry of the Carriers time bar (nine
months).

LIABILITY OF CARRIERS, BAILEES OR THE OTHER THIRD PARTIES


1. In case of apparent loss or damage
• Before taking delivery, clause the delivery receipt mentioning marks and numbers of lost and/or damaged parcels.
• Contact immediately Marine Insurance Services SIA for survey arrangements.
• Within 24 hours from time of delivery give notice in writing to the Carriers or Bailees.
2. In case of non-apparent loss or damage discovered after the time of delivery
• Cease unpacking immediately and contact Marine Insurance Services Ltd. for survey arrangements.
• Give notice in writing to the Carriers or Bailees within 3 days of delivery.
3. In case of non-delivery
• Request from the Carrier a non-delivery certificate for all missing packages.
4. Goods in containers
When delivery is made by container, ensure that the container & its seals are examined immediately by their responsible official. If
the container is delivered damaged or with seals broken or missing or with seals other than as stated in the shipping documents,
clause with the delivery receipt accordingly and retain all defective or irregular seals for subsequent examination by the surveyor.
The content will have to be checked with the Carrier before destuffing of the container.
5. IN ALL CASES the Carriers, Bailees and/or other liable Third Party should be requested by facsimile, e-mail or registered letter to
attend the survey.
6. Prevent the recovery from becoming time-barred by requesting time extensions from Carriers, Bailees and/ liable Third Parties if
the completed claim file cannot be submitted to the underwriters one month before the time bar expires (nine months from arrival of
the ship and/or other means of transport).
Note: The non-compliance with the above procedure could prejudice the settlement of the claim.

ⅠⅠ DOCUMENTS TO BE SUBMITTED
For all claims, at the latest one month before the expiry of the Carrier’s liability.
A - IN ALL CASES
1. Original insurance policy/certificate. Original Bill of Lading or other Contract of Carriage.
2. Original or copy of commercial invoices of the goods and Packing List. Loss statement.
3. Delivery receipt, closed with remarks to show loss/damage upon arrival. Weight notes.
4. Correspondence exchanged with the Carriers and other Parties regarding their liability for the loss or damage.
B - TO BE ADDED TO THE ABOVE
1. Damage and/or loss: survey report.
2. Non-delivery. Non-delivery certificate issued by the liable third parties.
Note: Underwriters reserve the right to request further documents/information on a case-by-case basis.

ⅠⅠⅠ GENERAL AVERAGE


If General Average is declared, contact the underwriters or nearest agents immediately. If for any reason this is not possible, prior to
signing an Average Bond it must be certain that the persons signing are the owners of the goods at the time General Average was
declared. If there is any doubt about title, then a Letter of Indemnity should be obtained from the other party in the Sales Contract.

ⅠⅠⅠV TOTAL LOSS OF THE CARGO FOLLOWING TOTAL LOSS OF THE SHIP
1. All original Bills of Lading.
2. Letter from the shipping company advising the consignee of the loss of the ship.
3. Extract for the ships manifest showing that the goods were duly loaded, failing that, Sworn Affidavit from the Carriers.
