DEED OF ABSOLUTE SALE OF A PORTION OF UNDIVIDED

SHARE OF UNREGISTERED LAND

KNOW ALL MEN BY THESE PRESENTS:

This DEED, made and executed in the City of Catbalogan, Province of Samar,
by and between:

ANTERO O. GAMAS, of legal age, widower, Filipino and a resident of Brgy.


Tizon, Tarangnna, Samar, hereinafter called the VENDOR

- and -

MIGUEL CARLSBERG L. CASTILLO, of legal age, married to Phoebe Suarez-


Castillo, Filipino and with residence at Azucena St., Brgy. Muñoz, Catbalogan City,
hereinafter called the VENDEE-

WITNESSETH: THAT-

WHEREAS, the VENDOR is part owner of 1/6 shares or TWENTY THOUSAND


SIX HUNDRED EIGHTY SIX (20,686) SQUARE METERS, being one of the children and
surviving heirs of the late Albina Obseñares, of a parcel of land designated as Lot No.
2366, Cad 706-D, consisting of One Hundred Twenty Thousand One Hundred
Seventeen and 37/100 (124,117.37) Square Meters, or 12.411737 Hectares, located at
Brgy. Tizon, Tarangnan, Samar, bounded on the North by 062 (2422); on the South by
017 (2355 004 (2367); on the East by 003 (2400 045 (2401 and on the West by National
Road, with Assessed Value of P87,770.00 and Market Value of P95,385.60 per Tax
Declaration No. 20-041-00164, PIN 036 20 041 03 003 issued by the Municipal
Assessor’s Office, Tarangnan, Samar on February 16, 2015;

WHEREAS, the VENDOR acquired said portion of land consisting of TWENTY


THOUSAND SIX HUNDRED EIGHTY SIX (20,686) SQUARE METERS, thru intestate
succession by virtue of the Extrajudicial Partition/Settlement executed by the Heirs of
Albina Obseñares on February 3, 2014, and was ratified by a Notary Public, Atty. Pedro
M. Labid, entered as Doc. No. 13; Page No. 1; Book No. II; Series of 2014 of his Notarial
Registry;

WHEREAS, the VENDEE has offered to buy and the VENDOR has agreed to
sell all his shares or portion of the above described land consisting of TWENTY
THOUSAND SIX HUNDRED EIGHTY SIX (20,686) SQUARE METERS, pending its
subdivision in accordance with law, for a price and under the terms and conditions
herein set forth;

NOW, THEREFORE, for and in consideration of the foregoing premises, and


more particularly the sum of ONE HUNDRED FIFTY THOUSAND PESOS
(P150,000.00), Philippine Currency, the receipt whereof is hereby acknowledged from
the VENDEE to the entire satisfaction of the VENDOR, the said VENDOR does hereby
sells, transfers and conveys, in a manner absolute and irrevocable unto the VENDEE,
his heirs and assigns and successors-in-interest that undivided portion or shares of the
VENDOR on the land above-described, consisting of 1/6 parts or an area equivalent to
TWENTY THOUSAND SIX HUNDRED EIGHTY SIX (20,686) SQUARE METERS, as
may be evidenced by a subdivision plan which the parties hereto agree to be effected in
due time;

That the parties hereto hereby agree that within a reasonable period of time from
and after the execution of this instrument, the parties shall engage the services of a
licensed geodetic engineer to undertake the preparation of the necessary survey plan of

subdivision, segregating the definite portion object of this sale, and submit the same to
the proper government authorities for verification and approval in accordance with law;

That the VENDOR do hereby warrant valid ownership to, and peaceful
possession of, the portion of the property herein sold and conveyed, and further declare
that the same is free and clear of all liens and encumbrances of any kind whatsoever.

This DEED, made and executed in the City of Catbalogan, Province of Samar,
by and between:

VEVENCIO L. TABON, of legal age, married to Carlita Argona Villa Rojo, Filipino
and a resident of Bindoy, Negros Oriental, hereinafter called the VENDOR

- and -

MAURICIO L. TABON, of legal age, married to Aileen Decatoria-Tabon, Filipino


and with residence at Brgy. Guindapunan, Catbalogan City, hereinafter called the
VENDEE-

WITNESSETH: THAT-

WHEREAS, the VENDOR is part owner of 1/6 shares being one of the children
and surviving heirs of the late spouses Tomas Tabon and Francisca Tabon, of a parcel
of land consisting of One Hundred Twenty Five (125) Square Meters, located at
Poblacion, Municipality of Catbalogan, Province of Samar, and covered by Transfer
Certificate of Title No. T-9349 issued by the Registry of Deeds for the Province of
Samar, Catbalogan City, and more particularly described as follows:

A parcel of land (Lot 191 of the subdivision plan Psd-


66654, being a portion of Lot 2863-A described on plan (LRC)
Psd-18202, L. R. C. (GLRC) Record No. 1378), situated in the
Poblacion, Municipality of Catbalogan, Province of Samar.
Bounded on the W., along line l-2 by Lot 190; on the NW., along
line 2-3 by Lot 189 both of the subdivision plan; on the Ne.,
along line 3-4 by Lot 192 and along line 4-5 by Lot 193; and on
the SE., along line 5-1 by Lot 203 all of the subdivision plan.
Beginning at a point marked “1” on plan, being N. 87 deg. 21’ E.,
556.89 m. from B. L. L. M. 1, Catbalogan Cadastre, thence N. 2
deg. 14’W., 11.33 m. to point 2; thence N. 61 deg. 11’E., 9.11 m.
to point 3; thence S. 16 deg. 34’ E., 7.29 m. to point 4; thence
S.14 deg. 29’ E., 6.24 m. to point 5; thence S.76 deg.29’ W.,
11.50 m. to the point of beginning; containing an area of ONE
HUNDRED TWENTY FIVE (125) Square Meters.

WHEREAS, the VENDEE has offered to buy and the VENDOR has agreed to
sell all his shares or portion of the above described land pending its subdivision in
accordance with law, for a price and under the terms and conditions herein set forth;

NOW, THEREFORE, for and in consideration of the foregoing premises, and


more particularly the sum of EIGHTY THOUSAND PESOS (P80,000.00), Philippine
Currency, the receipt whereof is hereby acknowledged from the VENDEE to the entire
satisfaction of the VENDOR, the said VENDOR does hereby sells, transfers and
conveys, in a manner absolute and irrevocable unto the VENDEE, his heirs and assigns
and successors-in-interest that undivided portion or shares of the VENDOR on the land
above-described, consisting of 1/6 parts or an area equivalent to TWENTY AND 83/100
(20.83) SQUARE METERS, more or less, as may be evidenced by a subdivision plan
which the parties hereto agree to be effected in due time;

That the parties hereto hereby agree that within a reasonable period of time from
and after the execution of this instrument, the parties shall engage the services of a
licensed geodetic engineer to undertake the preparation of the necessary survey plan of
subdivision, segregating the definite portion object of this sale, and submit the same to
the proper government authorities for verification and approval in accordance with law;

That pending approval of the subdivision plan, the parties hereto have agreed to
register this deed of sale in the Registry of Deeds (Samar) Catbalogan, Samar, by way
of memorandum: annotation on the corresponding certificate of title as permitted under
the provisions of Section 58 of Act 496, as amended with the understanding that upon
the final approval of said subdivision plan and the corresponding technical description of
the resulting lots, certified copy thereof shall forthwith be filed with the Registry of Deeds
to enable him to effect the segregation process by the issuance of a new certificate of
title in the name of the herein VENDEES for the portion of land sold and another
certificate in the name of the herein VENDOR for the portion remaining;

That the VENDOR do hereby warrant valid title to, and peaceful possession of,
the portion of the property herein sold and conveyed, and further declare that the same
is free and clear of all liens and encumbrances of any kind whatsoever.
