Darjipura, Vadodara – External Water Supply Work

(Package-1)
Sir,

Under the instruction and authority of my above

named client I, A. A. Ansari, Solicitor & Advocate, serve

you the following legal notice. Please note that if you

fail to fulfill requirement of this notice, my client shall

be compelled to take appropriate legal actions against

you at your cost and consequences.

1. By letter dated 20.10.2007 issued by the NBCC my

client was awarded the work for EXTERNAL WATER

SUPPLY WORKS (PACKAGE-1) at MAP Air Force

Station, Darjipura, Vadodara. The contract was

duly executed between my client and National

Buildings Construction Corporation Ltd. (hereafter

referred to as ‘NBCC’).

2. My client started the contract work on 10.11.2007

with full dedication and diligence. Due to

consistent efforts of my client, the work could be

completed within the prescribed time frame i.e. on

31.07.2009. Upon completion of work, NBCC and

Air Force have issued completion certificate to my

client.
3. My client used to raise running account bills while

the work was in progress. NBCC used to make

payment towards the bill after deducting certain

amount towards the security deposits.

4. Since NBCC had been deducting certain amount

towards the security deposit from the payments to

my client, after completion of work, my client

requested NBCC to release the said amounts

deducted from Running Account Bills and make full

payment of the final bill. My client made various

oral as well as written requests to NBCC, which

have never been paid heed to.

5. Therefore, my client is constrained to issue this

legal notice calling upon you to make payment of

Rs.12,84,599/- (Rupees twelve lakh eighty four

thousand five hundred ninety nine only) towards

dues payable to my client and Rs.7,18,260/-

(Rupees seven lakh eighteen thousand two

hundred sixty only) towards security deposit made

by my client to the NBCC, totaling to

Rs.20,02,859/- (Rupees twenty lakh two thousand


eight hundred fifty nine only) together with

interest @ 18% per annum thereon from date of

final bill i.e. 31.03.2010 to this date within 15

days from the receipt of this notice, failing which

my client will be constrained to take against you

an appropriate civil action, which please note.

6. This notice is issued due to negligence and fault

on your part, therefore you are hereby charged

with its cost i.e. Rs.11000/-, which please lastly

note.
