Statement for the Compliance of Non-Use of Hazardous Substances

We, Nanya Technology Corporation, to best of our knowledge, as of the date indicated at the last line of this
Page, declare that the product, excluding package provided by Nanya Technology Corporation (hereinafter
referred to as “Product”) conforms to:
(i) the requirements of the European Union’s Restriction on the Use of Hazardous Substances in Electrical
and Electronic Equipment Directive, 2011/65/EU
(ii) and 2015/863/EU recast (hereinafter referred to as “RoHS 2.0 Directive”) ;
(iii) the requirement of Bromine(Br) and Chlorine(Cl) with restriction of JPCA-ES-01-1999, IEC
61249-2-21, IPC-4101B;
(iv) the requirement of the European Parliament and the Council of the European Union jointly published
the directive on the Restriction of Sales and Use of Prefluorooctane Sulfonates (PFOS), 2006/122/EC
(hereinafter referred to as “PFOS Directive”).
This Statement is based on our understanding of the RoHS 2.0 Directive and 2015/863/EU recast, Bromine
(Br) and Chlorine (Cl) restriction, PFOS Directive and our knowledge of the materials that are used in the
Product as of the date of this Statement. The Product complies with the maximum concentration value
(“MCV”) for the following nine (13) designated substances.

Our Halogen free product is available from now on and will be mass production from 01/01/2009. However,
we shall not be liable for any violation of Halogen free product except to the extent any warranty about
Halogen free product as provided under other agreement. Halogen free product can be identified by part
number. Please refer to our Part numbering rules.

**MCV does not apply to applications for which exemptions have been granted by the RoHS Directive. MCV is based
on concentration levels by weight at the homogeneous material level as defined in the RoHS Directive.
