the plaintiff and the defendant

from the BIG ENTERTAINMENT for and in consideration of the sum of twenty-five
million pesos (Php 25,000,000.00)

“5. Where the VENDOR promises to execute a Deed of Absolute

Sale upon full payment of the consideration by the VENDEE either
through a lump sum payment or through the following payment terms:
40% down payment in cash; 40% PDC dated 2 months after down
payment; and 20% PDC dated 4 months after down payment.

6. Where the VENDOR pays in check or other mercantile

documents, they shall only produce the effect of payment only when they
have been cashed.”
