WITHOUT PREJUDICE

Protect Yourself
What does it mean?

• By adding “WITHOUT PREJUDICE” above your signature,

you are protecting your inalienable rights and making
“no promises to perform”

Uniform Commercial Code:

§ 1-308. Performance or Acceptance Under Reservation of Rights
(a) A party that with explicit reservation of rights performs or promises performance or assents to
performance in a manner demanded or offered by the other party does not thereby prejudice the
rights reserved. Such words as "without prejudice," "under protest," or the like are sufficient .
What does it do?
An ‘open’ signature = just your autograph A ‘qualified’ signature = autograph + WOP
It means you are agreeing It means you are making
With gov’t documents, it means you agree “no promises to perform”
to be bound by public policy (the red box) With gov’t documents, it means you
are exempt from public policy (NO box)

of the public
(aka in the private)

Our Notice of Liability
• The Notice of Liability mentions Section 32 of the
Charter of Rights and Freedoms which states:

Therefore, government legislation does NOT apply to you IF you’re a private individual
Qualified signatures take you out of the public and into the private
=> thereby making you a private individual <=
What is a Signature?

• A signature is actually 2 things

1) Intent
2) Whose intent it is (autograph)

• We currently sign with an ‘OPEN’ signature

• This means that we are agreeing with everything written above it
• We are agreeing to participate in THAT corporate jurisdiction
• Almost ALL contracts we sign are with corporations (government
included)
• We have NOT protected our unalienable rights using an ‘open’ signature
When & where do I use it?
• Use it when signing anything you did not create or author
• Ex. Applications, agreements, public contracts
• Driver’s license, Health card, passport, service agreements,
bank applications

• DO NOT use it when signing anything you wrote yourself, or

agreements you made privately and directly with someone else
• Ex. Letters you write to your employer/union/college, any private
agreement with another private person
Contracts vs Agreements
Contract:
2 or more people agreeing to the terms of the contract as
evidenced by their wet signatures
You CANNOT amend your signature on a contract without
the permission of the other party/parties!
BUT don’t worry…
THEY are in breach of contract if they are pushing these
measures because they weren’t in the contract to begin with
=========================================
Agreement:
Your sole agreement to something,
only your signature on the document
You can amend your signature any time you want!
And if it’s not in the agreement, you’re not in breach – they are!
