INSTRUCTIONS TO TENDERERS
a. Contractor to Check
The Contractor is required to check the page numbers of the Bills of Quantities and should any be
found missing or in duplicate or other figures or writing indistinct, the Contractor must notify the
Quantity Surveyors at once and have the matter rectified before the tender is submitted.
The Contractor is required to check that all pages are carried to Collections or Summaries as the case
may be and that they are reflected in the Main Summary.
c. Alterations or Qualifications
No alteration, addition or qualification of any kind whatsoever may be made by the Tenderer to the
text of the Bills of Quantities.
If any alteration, addition or qualification is made by him, it may cause the tender to be disqualified
and will in any case be ignored and the text as prepared by the Quantity surveyor will be rigidly
adhered to.
Tenderers must tender strictly on the basis of the terms and conditions of contract specified in this
document. Tenderers wishing to put forward alternative conditions may only do so by submitting an
alternative tender under the terms and conditions which they wish to substitute for the conditions
given in this document. Tenderers submitting an alternative tender must however also tender on the
conditions given in this document, otherwise their tender will be automatically disqualified.
At any time prior to the deadline for submission of tenders the Employer may, for any reason whether
at his own initiative or in response to a clarification requested by a prospective tenderer amend the
tender documents by issuance of an "Addendum". The "Addendum", the receipt of which must be
acknowledged, shall be sent in writing.
Should the employer be of the opinion that the issuance of an "Addendum" has created a need to
extend the deadline of the submission of tenders, then at his discretion, he shall in writing grant such
an extension.
e. Completion of Tenders
All Documents forming part of the Tender shall be completed in INK and the offer shall be made on the
form of Tender. All items measured and described herein must be priced and any item not so priced
shall be deemed to have been covered by the Tenderers prices on the other items. Lump sum pricing
and wilfully omitting to price an item shall render the tender liable to disqualification and item(s) not
so priced shall not in any case be taken into consideration.
The Tender shall be witnessed as to validity. Tenders not so witnessed shall be declared invalid and
therefore non responsive.
INSTRUCTIONS TO TENDERERS
Prior to the tender opening a Tenderer may alter or withdraw his tender in writing provided that any
alterations so made must be personally signed by the Tenderer or by his authorised representative.
The modifications or notice of the with withdrawal shall be prepared, sealed, marked and delivered
with the inner envelop additionally marked "MODIFICATION" or "WITHDRAWAL "as appropriate. No
tender shall be modified or withdrawn subsequent to the deadline of submission of tenders. In the
event of a Tenderer withdrawing before the tenderers are opened, his tender will be returned
unopened in an outer envelope bearing the name and address of the Tenderer without any other
markings.
g. Responsiveness
Prior to the detailed evaluation of tenders, the Employer will determine whether each tender is
substantially responsive tender is one which conforms to all the terms, conditions and specifications of
the tender documents without material deviation or reservation.
A material deviation or reservation is one which affects in any substantial way the scope, quality or
performance of the works, or which limits in any substantial way, the Employer's rights or the Tender's
obligations under the Contract, or which is substantially inconsistent with the tender documents and
the rectification of which deviation or reservation would affect unfairly the competitive position of
other Tenderers presenting substantially responsive tenders.
If a tender is not substantially responsive to the requirement of the tender documents, it will be
rejected by the Employer and may not subsequently be made responsive by the Tenderer having
corrected or withdrawn the non-conforming deviation or reservation.
h. Inspection of Drawings
Before tendering the Contractor should examine the drawings which may be seen at the offices of the
Architect during normal office hours, and shall satisfy himself regarding their detail as no claim by
reason of ignorance in this connection will be entertained.
i. Preparation of Tender
No claim will be allowed for travelling or other expenses which may be incurred by the Contractor in
visiting the site or preparing the Tender for the works.
j. Correction of Errors
Tenders determined to be substantially responsible will be checked by the Employer for any arithmetic
error in computation and summation. Errors will be corrected by the Employer as follows:-
a. Where there is a discrepancy between amounts in figures and in words, the amount in words will
govern; and

b) Where there is a discrepancy between the unit rate and the total amount derived, from the
multiplication of the unit rate and the quantity, the unit rate as quoted will govern, unless in the
opinion of the Employer there is an obviously gross misplacement of the decimal point in the unit rate
in which event the total amount as quoted will govern and the unit rate be corrected.
Notwithstanding the adjustments as aforesaid, the amounts stated on the Form of Tender shall be
taken as absolute and therefore shall not be changed.
In the event of discrepancy between the tender amounts as stated in the Form of Tender and the
corrected tender figure as stated in the Main Summary of the Bills of Quantities the following
procedure shall be adopted:
i. The tender amount as stated in Form of tender shall override the tender amount in the Main
Summary after correction.
Such discrepancy will be notified to the tenderer who will then have the opportunity of confirming
or withdrawing his tender.
ii) the difference between the tender amount and the corrected tender sum shall be expressed as a
percentage of the corrected tender sum nett of preliminaries, Prime Costs and Provisional Sums as a
"Correction Factor"
iii) the above "Correction Factor" shall be applied as a reduction or an addition as the case may be to
adjust the Contractor's rates in the Bills of Quantities for the evaluation of variations. Valuations for
interim certificates and measurements for final accounts.
iv) Any discount given by the tenderer shall be treated as a discrepancy in accordance with sub-
paragraph (ii) above.
k. Preliminaries Section
Where this section should be keenly and consistently priced, no front loading shall be allowed. Any
amount which is the opinion of the Employer has been frontloaded shall be relocated in the measured
section of these bills of Quantities otherwise at the discretion of the Employer, the tender shall be
liable to disqualification as irresponsive.
l. Bid Security
For the tender to be valid, the tenderer is required to provide a Bid Security equivalent to 2% (Two
Percent) of the tender amount from a reputable Bank or reputable insurance company giving an
unconditional undertaking to be bound to the Employer in the event that the tenderer withdraws his
tender, refuses or neglects to execute a contract between the tenderer and the Employer upon
receiving a letter of acceptance of the tender from the Employer. This Bid Security is to be submitted
together with the tender as part of the tender documents.
