Equal treatment and non-discrimination

The threat of covid 19 is not limited to a particular group and is not limited to any
boundaries- it identifies no boundary of rich, poor, race, colour, sexual orientation or
situation. This means everyone who is in need should get access to medical assistance, health
facilities and testing and those who are having hard time because of lack of money in their
pocket due to pandemic should be looked after by the state by adopting policy on the state
level.

Non discriminate principle mandates marginal section which includes community displaced
voluntarily or involuntary to avail them with every possible basic facility which includes
necessary health care services or basic amenities like cloth, shelter, food or clean water.
Adequate resources, updated technologies should be provided for better treatment.

Right to health

International law makes sure about the provision of facilitating the bare minimum health care
services to the migrants which includes sanitation, food, clean water and shelter. Affordable
treatment and hospital in the vicinity should also be taken care by the state. These
obligations, crucial in the current COVID-19 pandemic, are owed to all persons, including
migrants, refugees, and other displaced persons, as well as stateless persons whose absence of
effective nationality must not disqualify them from enjoying the right to health. The right to
effective and respectful health services are best achieved by measures that take into account
the views of affected populations.

State obligations to combat stigma, racism and xenophobia

International human rights lay down a strict guideline against discrimination among people
which is intolerant to international community. They are out casted and treated with utter
disgrace. Numerous instances of stigmatization and racist or xenophobic violence have been
directed against people based, in particular, on their Asian descent or the perception that they
were a source of COVID-19 infection. Stigma can operate as a significant barrier to seeking
health care – a result that endangers both the groups that are targeted and the public at large.
In order to eradicate such stigma state should create awareness among the people about the
fact that virus is not synonymous to nationality.

Restrictions on movement between States

Right of person to leave any state and enter its own home state may be restricted in
exceptional circumstances and the corona pandemic may be treated as one because it may
lead to widespread of disease
