5. Because of the Can Spam Act, Karen cannot harvest emails from the college directory. Karen

also cannot use a prerecorded message in a call unless the consumer has agreed to receive such

messages. Prerecorded messages are considered robodialing and is restricted under the

Telephone Consumer Protection Act and enforced by the FCC.

9. Dallas should contact the collection agency and state that he will not pay the demanded

amount of debt. The agency will no longer be able to contact him about paying. Under the Fair

Debt Collection Practices Act of 1998, Dallas’ employer can object to the collectors calling Dallas

in their place of work as well. If Dallas is victim of identity theft, the FTC suggests that he should

(1) contact reporting credit agencies about the dispute, (2) file a report with the FTC, (3) file a

police report, and (4) monitor his credit report and obtain copies. He should also put a freeze

on his credit so no one can use it without permission.
