Business : The petitioners filed present petition seeking to draw final
decree based on preliminary decree passed in OS No.
27/1990. The respondents No.1, 2 to 5, 11, 13 and 14
appeared through counsel and remaining respondents did
not appear before court. In pursuance of application for
appointment of court commissioner, court commissioners
were appointed. The court commissioners filed report
pertaining to house property as well as agricultural lands.
None of the parties have filed objections to the
commissioner reports. The matter posted for hearing on
court commissioner report. Both counsels did not argue.
Perused materials. On perusal of the materials it is noticed
that court commissioner went to the spot to measure
agricultural land and found that schedule 'F, G, M, N are
gomala lands i.e. government lands. Further it is stated in
the report that schedule H, J, K, P properties are not
having land extent as per record of rights. It is stated that
schedule T property wrongly mentioned. Inspite of filing
such report petitioners or respondents did not file
objections to the report. Further no action has been taken
by the petitioners or respondents to get proper
measurement of properties and records. Therefore, there
is necessity of hearing petitioners on maintainability of
petition. Therefore, matter posted for hearing on
maintainability. Call on 30.06.2021.
