Associations, Shipping Companies, and Others Concemed SUBIECT GUIDELINES ON THE PILOTAGE SERVICES TO BE RENDERED IN ALL PORTS AND THE CORRESPONDING FEES THEREFOR I AUTHORITY Section 6-a (vin) of PD 857 Executive Order No 1088 dated February 3, 1986 PPA Administrative Order No 03-85 ‘Supreme Court decision, dated 22 January 1997, upholding the validity ot EO 1088 5 Supreme Court decision, dated 28 January 2003, granting with finality the petition of UHPAP resolving the 1ssues on overtime and correct interpretation of EO 1088 6 Letter of Instruction No 1005-A dated 11 Aprit 1980 7 PPA Admumstrative Order No 15-95 1 SCOPE ‘This Order shall cover all vessels calling at any public or prvate wharf, pier or anchorage fallmg under any of the prlotage cistnets of the country which are within the unsdiction, of PPA, TM OBJECTIVE To standardize the pilotage services to be rendered and the fees to be charged in the different pilotage districts IV GUIDELINES 1 Definition of Terms - The terms used herein shall, unless the context indicates otherwise, mean or be understood to mean as follows 11 Pilotage- The act of conducting a vessel from/to Pilots' Boarding Station, to/fiom berth or anchorage, at any public or private wharf or pier vistox M155103 opel? 3G 44 By 2010 99 shall fave met the sternal tarards port ‘he comut t0 proade mse abd response trace! our Goclines nd sects ah les tn (10) pores apport of ports sum development of our port commutes ind the ‘atonal delopaent emmmament cad bra model corporate agency ofthe gooemment. 12 13 14 15 16 17 18 Regular Service — This service shall refer to those pilotage services requmred to be performed by the harbor pilots to maneuver vessels to/from the ports, as provided in Section 2 of this Order Additional services requested by the Master of the vessels or the ship's agent shall be considered as special service Docking - The collective service of placing a ship alongside a wharf or pier Dockmng shall include the following 131 Transport of pulot from shore to pilots’ boarding station 132 Ordenng the Heaving of anchor 133 Conducting of vessel to berth/anchorage from the pilot boarding station 134 Ordenng of lines to shore 135 Ordenng the making fast of vessel alongside berth Undocking ~ The collective service of moving the ship out from alongside a wharf or pier, and shall include the followmg 141. Pilot orderto let go of hnes 142 Ordering the heaving of anchor 143 Moving the vessel out from berth/anchorage and piloting ito the pilots’ boarding station 144 Transport of pilot from pilots’ boarding station to shore ‘Mooring - Securing ship by means of moonng lines, wires, or chains to a floating buoy secured to the seabed or by dropping of vessel’s anchor(s) to a designated anchorage area ‘Unmoormg - The casting away of all securing lines, heaving up anchors, ‘and departure from the designated anchorage area, Shufting - The transferring of a vessel within the harbor from one pier berth to another pier berth, or from an anchorage area to another anchorage area, or from berth to an anchorage area or vice-versa ‘Untwisting - The unwinding of two tangled anchor chains cs 19 Anchoring - Secunnga vessel by means of an anchor and may also apply by securing a vessel to an assigned anchorage by means of the vessel's two bower anchors, and to mclude the kedge anchor, 1f necessary 110 Channeling - The act of navigatng through a restricted path or through a narrow sea between two close land masses leading to or from a port or harbor 111 Mediterranean Mooring/Docking ~ A special service performed by securing a ship to a moonng buoyipier or wharf by fastening the stem on. both sides by means of mooring lines 112 Conduction - The service of bringing the vessel at any pomt beyond the pilots’ boarding station 113. Boarding Station - The pilots’ boarding station, as designated by PPA, shall serve as pomt of meeting and boarding vessels entering port requinng pilotage service and the pomnt of unboarding pilot for departing vessels In other ports where a pilots’ boarding station has not yet been designated, pilots shall service vessels at a safe distance of not less than one (1) nautical male from the port/anchorage Applicable Pilotage Rate - The rates prescribed under EO 1088 shall apply for pilotage services rendered for every movement of the vessel 5.1 BO 1088 Rates 5.11 For Foresgn Vessels Rate in US$ or Its Peso Equivalent Less than, 500GRT Ss 3000 SOOGRT to 2,500GRT 4333 2,500GRT to 5,000GRT 7133 5,000GRT to 10,000GRT 133 67 10,000 GRT to 15,000GRT 181 67 52 33 35 ae 15,000GRT to 20,000GRT 24700 20,000 GRT to 30,000GRT 30000 30,000 GRT to 40,000GRT 416 67 40,000 GRT to 60,000GRT 483 33 60,000 GRT to 80,000GRT 550.00 80,000 GRT to 100,000GRT 61667 100,000 GRT to 120,000GRT 666 67 120,000 GRT to 130,000GRT 716 67 130,000 GRT to 140,000 GRT 766 67 Over 140,000 GRT- $005 or its peso equivalent for every excess tonnage 512 ForCoastwise Vessel 100 and under 500 GRT BR 4170 500 andunder 600 GRT 55.60 600 and under 1,000 GRT 69 60 1,000 and under 3,000 GRT 13920 3,000 and under 5,000 GRT 194 80 5,000 GRT and over 300 00 ‘There shall be one fee for either docking or mooning or anchoring and another fee for either undocking or unmooring or leaving anchorage ‘There shall be a uniform fee of 100% of the EO 1088 rates for each of the speotal services listed im Section 3 hereof and as requested by the Master of the vessel or ship’s agent Meeting a vessel at a pomt other than the Pilots’ Boarding Station/Quarantme Anchorage, except m Aparri where this 1s a regular service- Twenty Dollars ($20 00) per nautical mile or its peso equivalent Untwisting ~ One Hundred Dollars ($100 00) or its peso equivalent on a lump sum basis and as requested by the vessel Payment of Pilotage Service Fees - Any vessel whuch employs a Harbor Pilot shall pay the prlotage fees prescribed m this Order and shall comply with the following conditions 61 62 ‘When a pilothas been called by the owner/Master/A gent, and after a lapse of one (1) hour, for justifiable reason, his service has not been availed of, the pilot shall be at liberty to unboard the vessel However, the pilot shall bbe paid for such services equivalent to one (1) regular service fee When the pilotis requested by the shipping agent to remain ma particular port for the duration of the vessel's stay m said port, reasonable actual ‘expenses for transportation, lodging and meals may be reimbursed to the pilot upon presentation of the corresponding official recerpts If he stays ‘on board as guest of the Master, no retmbursement shall be made -15- 63. Pilotage service rendered on Sunday, holiday or between 1800 H to 0600 H, a premium fee of one hundred (100%) percent over the regular prlotage fees for vessels engaged m foreign trade and fifty (50%) percent for coastwise vessels However, no premum fee shall be considered for service rendered after 1800 H if tshall be proven that the service can be completed before such hour, after the one (1) hour grace period has expired ‘The additional premium fee for Sunday, holiday or might service shall be based on only one (1) regular service fee, regardless of how many ‘movements have been rendered to the vessel, whether regular or special Forumformty of implementation, attached as Annexes showing sample computations Annex “I” for a foreign vessel with pilotage services and premium, Annex “2” for a domestic vessel and Annex “3” for pilotage services rendered on Sunday daytime and nighttime 64 — Nootheradditional fees shall be charged for the performance of pilotage services except for those enumerated under Sections 2, 3,5 and 6 hereof In thus regard, only PPA-prescnibed format (Annex “4”), which contain all the regular and special pilotage services as authorized in this Order, shall be honored This shall be signed by the pilot on duty prot submission to the shipping lines for payment 65 The "No Service, No Pay" principle shall be followed 66 All fees and charges due pilots must be paid promptly by the Master or ‘owner of the vessel or Agent upon presentation of the Bill or within fifteen (15) days thereafter 67 Generally, prlotage fees are pad upon departure of the vessel If the shipping company fals to pay the comesponding pilotage fee after two (2) consecutive billings, the vessel shall not be granted berth or shall not ‘be given clearance to depart For tramping vessels, payment should be ‘made upon presentation of the bill by the plots Government Share - In consideration of the nghts and pnvileges granted to ‘ender pilotage services and for the use of port facilii¢s, all Harbor Pilots/Pilots’ ‘Associations shall remit to the Authonty, through the Port Management Office (PMO), not later than the tenth (10") day of the succeeding month, a government share of not less than 10 (10%) percent of the gross income derived from prlotage services, whether billed/unbilled and collected/uncollected Late payments by the harbor piloty/pilots’ associations shall be subject to interest and penalties as, prescribed under PPA Admanistrative Order No 01-2002 ‘The pilotage share on the gross revenue from the pilots’ assoctation 1s exclusive of the ten (10%) percent value-added tax (VAT) and that the VAT due thereon shall be for the account of the pilots’ association v MI vu -16- ‘The foregomg remittance scheme shall be without preyudice to the night of the Authonty to rmplement the direct collection scheme, if warranted, on a per vessel basis m any pilotage district Pilotage Equspment and Facilities - To efficiently and effectively render the service, the pilots’ assoctations shall make available such equipment as required by the Authonty 81 Allptlotage equipment and facilities shall be m serviceable and ready-hne condition, including reserved and standby equipment The equipment and facilites shall clude, but not Inmated to, plot launches, communication equipment, pilot stations, land transport and office equipment 82 The pilots’ association shall bind itself to acquire new equipment and to replace such equipment which, in the course of the periodic inspection and yearly mventory or review, has been found by the Authonity to be inefficient to operate or can no longer be reconditioned stration of Pilots’ Association — The pilots’ association, duly registered with the Secuntty and Exchange Commussion, shall be registered with the appropnate Revenue District Office and every year thereafter on or before the 31* day of January Penalty Clause - Violation of any of the provisions of this Order shall subject the pilotage association/pilot concerned to the penalties under Section 36 of PPA Admanistrative Order No 03-85 and/or suspension/cancellation of the pilots’ appointment Likewise, violations by the shippmg companies and its agents shall be subject to appropriate sanctions provided for im Section 43 (c ) of Presidential Decree No 857 and other pertinent regulations of the Authonty Repealing Clause - All orders, niles and regulations, circulars, memoranda previously issued which are inconsistent herewith are hereby repealed or modified Effectivity Clause - Thus Order shall take effect fifteen (15) days after 1ts publication in any newspaper of general circulation ral “a, iSO G CUST fanager Ablisted in the Rulippire Star -
