Synopsis

The Code of Civil Procedure lays down the procedure for the enforcement of a foreign judgement
and decrees which is based upon the basic principle of ensuring that the judgement is passed by a
court of competent jurisdiction and is passed on the basis of merits and is conclusive. A foreign
judgement is a judgement passed by a foreign court and by a foreign court we mean a court not
situated within the territorial boundaries of India or established or continued under the authority
of the Government of India.

This project aims to discuss the nature and scope of foreign judgements, going into the details of
which foreign judgements are conclusive, which cannot be enforced by the courts and which stands
against the international and Indian judgements. Apart from this, the project also peruses the
procedure for enforcement of such judgements through various judgements of courts.
