5. EEE’s opposition is bereft of merit.

As a general rule, in the institution of an heir, the heir must be


designated by his name of surname. However, this admits an
exception, that although the heir is not designated or named so long
as the heir is identifiable or has been designated in a manner that
there can be no doubt as to who has been instituted, the institution
is valid.

In the case at hand, although FFF’s name was not expressly


mentioned in the will, since, she can be identified as the Binibining
Pilipinas to represent the Miss Universe after DDD’s death, then she
is properly instituted.
