1. INSTRUCTIONS TO TENDERERS

1.01 The CONTRACT comprises the Government "Standard Documents for


Building and Civil Engineering works third edition 1981" together with a
standard specification and listed drawings. Tenderers are required to make
the following amendments to the "Standard Documents for Building and
Civil Engineering Works third edition 1981".

A. "Employer" means Mr. Abdul Jaleel bin Ahmed Bin Ali Moosa and the
legal successors in title to the Employer who will employ the Contractor.
B. All references to bills of quantities shall be deleted, ignored or interpreted
as schedules of rates.
C. Delete the following:
1. Clauses 55 and 56.
2. Page 4: "The Government.......................................................Finance"
and substitute as noted on page 17 in this Document.
3. Page 14: Clause 1(1) P: "Ministry................................amended".

D. ADD THE FOLLOWING:


Clause 10 to be re-read as follows as amended by the Royal Decree 56/89:- The
successful tenderer shall provide a Performance Bond in the form prescribed in the
Standard Documents for Building and Civil Engineering works, 3rd Edition, July 1981,
to the value of 5% (five percent only) of the contract value, valid for the whole of the
contract and Maintenance period. The performance bond will be retained by the
Employer during the period of the Contract and Maintenance Period and will be
returned to the Contractor upon the satisfactory completion of the maintenance period.

1.02. DISPATCH OF TENDERS

A. The tender shall be delivered to arrive not later than the time and date stated in the
Tender Invitation.

B. The tender shall be submitted using the Form of Tender in the tender document
from which it shall not be detached.

C. The tender document and all supporting documents shall be enclosed in a sealed
envelope, bearing no indication of the identity of the tenderer. The envelope shall
be marked.

1.03. PREPARATION OF TENDERS


A. Tenderers must visit the site and obtain for themselves, at their own expense,
all information that may be necessary for preparing a tender. They must
carefully examine the Tender Documents and satisfy themselves as to the
risks, obligations and responsibilities to be undertaken in the contract.
B. Tenderers and any of their servants or agents will be granted permission by
the Employer to enter upon his premises and lands for the purpose of such
inspection but only upon the express condition that such persons, firms or
companies will release and indemnify the Employer and his servants and
agents from and against all liability in respect of and will be responsible for
personal injury (whether fatal or otherwise) loss of or damage to property
and any other loss damage costs and expenses however caused (whether by
the act or neglect of the Employer or his servants or agents or not ) which
but for the exercise of such permission would not have arisen.
C. Should there be any doubt or obscurity as to the meaning of the Tender
Documents or anything to be done under the contract or concerning these
instructions or any other matter, tenderers shall set forth in writing such
doubts or obscurities and submit them to the Engineer at least 3 days
before the date of submission of tender. If considered appropriate, a
reply in the form of a Circular letter/Addendum will be issued by the
Engineer to all Tenderers to whom documents have been issued.
D. All documents issued and information given to the tenderer shall be treated
as strictly private and confidential, whether or not the recipient submits the
tender, and shall be returned at the time of tender.
E. The Tender Documents and all supporting documents shall be enclosed in
an envelope or package clearly endorsed with project title, and is addressed
and delivered as specified in the Invitation to Tender. The exterior of the
sealed envelope or package must NOT reveal the identity of the tenderer.
F. The correctness or otherwise of the quantities in the Schedule of Rates shall
in no way affect the validity of the tender.

G. The Tenderer shall confirm to the laws of the Sultanate of Oman and his
attention is particularly drawing to the laws governing the employment of
labour. All arrangements which affect the engagement, transport, paying,
feeding and housing of labour and other matters in connection therewith
shall be subject to the Regulations and Codes of the Sultanate of Oman,
now in force or which may be made from time to time during the
continuance of the Contract.
H. Tenderers shall fill in all blank spaces in the Form of Tender and the
Appendix to the Form of Tender, the Breakdown of Tender Costing,
Schedule of Rates, and appendices, if any, except where specifically
instructed otherwise and shall sign, stamp and date the documents in the
spaces provided. The Tender must be signed by the duly appointed
Principal fully authorized to represent and bind the Contractor. Entries
shall not be made in the blank spaces in the Form of Bond and Form of
Agreement.
J. Tenderers shall insert rates or prices against each item in the Schedule
of Rates. Items against which no rate or price is entered must be marked
NIL in the cash column and will be deemed to be covered by the rates or
prices set against other items in the Schedules of Rates.
The rates and prices set down against the items in the Schedules of Rates
Shall be for the full inclusive value of the finished work described and shall
include for profit and all obligations and liabilities of every kind arising
under the contract.
K. Any results of tests carried out on materials, reports on soil samples or any
other information which may be made available for inspection by the
tenderers do not form part of the Contract and no guarantee is given as to
their accuracy, not is it to be inferred that the conditions indicated by this
by this information are representative or may be encountered in carrying
out the Contract and the tenderer must satisfy himself as to the true
conditions.
L. The tenderer shall be responsible for developing his own sources of
materials (except where any particular source is specified) and no guarantee

can be given as to the availability of materials of suitable quality and


quantity. The Contractor in making his arrangements for obtaining
materials will be expected to comply with any statutory requirements and
will be deemed to have acquainted himself with these requirements.
M. The tenderer shall be required to obtain all necessary Government Permits.
N. This contract is to be a fixed price contract and the tenderer must include
in his rates and prices an allowance for any possible increases in the cost of
labour, materials and constructional plant which may occur after the
submission of the Tender and during the period of the Contract except for
increases which may be reimbursable under Clause 70 of the Conditions of
Contract.
P. The Tenderers should note and allow for the fact that they will not be
permitted to erect their labour camp onsite.
Q. The Tenderer’s attention is particularly drawing to the following
regulations, briefly summarized below in respect of accommodation and
importation of labour, and the Tenderer is advised to examine these
regulations in detail before submitting his tender.

a) Royal Decree 13/77 which states that no foreign contracting


company working in the Sultanate of Oman, with the exception of
those granted a special license by the Ministry of Commerce and
Industry may build or establish any housing scheme for the benefits
of their employees and workmen. Housing and accommodation
should be rented.
b) Royal Decree 86/84 which states that all goods imported to the
Sultanate of Oman shall comply with Omani Standard where such
standards exist.
c) Ministry of Health – Ministerial Decision 1/75 which imposes
precise rules for labour imported into the Sultanate of Oman.

d) The Tenderer shall make every effort to employ Omanis of the


requisite skills for the execution of the contract. In the event of

insufficient skilled labour being available and the tenderer wishes to


employ nationalities other than Omanis, he must ascertain whether
the necessary entry permits may be obtained. No foreign labour
shall be employed without the necessary approvals.

1.04. DETAILS OR DOCUMENTS TO BE SUBMITTED WITH TENDER


The tender must be accompanied by the documents listed below and which will be
deemed to form part of the tender. It is emphasized that any tender not accompanied by
these documents or by documents insufficiently comprehensive may be rejected.

A. A construction programme showing the order in which the various sections of the
works are to be constructed and the time which the Tenderer estimates he will
require completing each section.
B. A statement giving the name(s) of the person(s) authorized to sign Agreements
on behalf of the Company.
C. The curriculum vitae of the project and site engineers that the contractor will be
using on the project.
D. A letter stating that the tenderer has visited the site and that he has no queries on
any matter concerning the contract.
E. A Tender Bond, in the sum of not less than 2% of the tender value, valid for 90
days. (Not applicable to this contract).
F. A copy of each Circular letter/Addendum, if any, issued by the Engineer
appropriately endorsed by the Tenderer.
G. Mode of payments required by the contractor with a schedule of payments.
H. A statement that the tenderer has no unresolved doubts regarding the meaning of
anything contained within the Tender Documents.
I. The proposals for providing accommodation for the contractor’s staff and labour
force and for offices, workshops, etc. together with the layouts and areas of land
for the provision of such facilities.
J. A list of all major works which he has completed within the past three years and of
all works which are presently under construction, giving the name of the Client,
Consultant, location, value, duration and date of completion.

k. A list of the proposed construction plant, together with the number and
types/capacities.
K. A statement of the Tenderer’s financial standing, including the name and address of
his bank together with the authority to approach his banker for relevant information
and comment.
1.05. GENERAL
i. All arrangements which affect the engagement transport paying feeding and
housing of labour and other matters in connection therewith shall be subject to the
regulations and codes of the Sultanate of Oman now in force or which may be
made from time to time during the continuance of the contract.
ii. The currency of the contract will be in Rial Omani.
iii. The employer will not be responsible nor pay for any expenses or loss, which may
be incurred by the tenderer in the preparation of his tender.
iv during the period of tendering, all correspondence with the Engineer shall be in the
English language.
iv. The Employer is not bound to accept the lowest or any tender received.
v. The tenderer shall be bound by his tender except as provided in item 10.
vi. Any tender, which does not conform to the foregoing instructions, may be rejected.
vii. The successful Tenderer will be required to provide a Performance Bond in the
form prescribed in the Standard Documents for Building and Civil Engineering
Works (as defined in Clause 10 of the Conditions of Contract) as amended by the
Royal Decree 56/89, to the value of five percent (5%) of the Contract Value, valid
for the whole of the Contract and the Maintenance Period. The Performance Bond
will be retained by the Employer during the period of the Contract and
Maintenance Period and will be returned to the Contractor upon the satisfactory
completion of the Maintenance Period.
1.06 NO ALTERATION TO THE TEXT OF THE TENDER DOCUMENT
Alterations to the Form of Tender and associated documents shall not be
permitted. Any alteration other than the filling in of blanks intended for that
purpose, or failure to fully comply with these instructions may result in the
rejection of the tender. Any alteration to a rate or cash extension made by the

tenderer during the preparation of the tender documentation must be initialed by


the tenderer prior to submission.
1.07 MISTAKES IN TENDER
Tenders received will be checked for accuracy in extensions and additions.
Should any arithmetical error be found it will be corrected and the Tender Value
will be amended accordingly. The tenderer will be informed of any arithmetical
adjustment made should the Employer wish to further consider his tender.

1.08 LOCATION
The site of the project is at plot no 77, Phase 3 at azaiba Bausher.

1.09 DESCRIPTION :

The building comprises of Basement, Ground and First floor of accumulative built up
area. The works comprise of Design supply and Execution of post-tensioning of
Slabs/Beams as truly described in Tender drawings specification of Bill of Quantities.

1.10 TENDERER'S ENCLOSURES


Tenderers shall insert and bind-in, any documents called for within the
tender, in this DOCUMENT. Tenderers shall insert the required papers at the end
of the document and finally bind the document

Gentlemen,

1. Having examined the Instructions to Tenderers, Drawings, Standard Conditions of


Contract, Specification and Schedule of Rates for the execution of the above
named works, we, the undersigned, offer to execute, complete and maintain the
whole of the said works in conformity with the said Instructions, Drawings,
Standard Conditions of Contract, Specification and Schedule of Rates for the sum
of Rials Omani

2. We undertake if our Tender is accepted to commence the Works within _30 days of
receipt of the Engineer's order to commence and to complete and deliver the whole

3. If our Tender is accepted we will obtain the guarantee of a locally registered


Insurance Company or Bank (as required in the Sultanate of Oman Standard
Conditions of Contract for building and Civil Engineering Works, 3rd Edition) to
be jointly and severally bound with us in the sum of 5 percent of the Contract
Value for the due performance of the Contract under the terms of Performance
Bond to be approved by you.

4. We agree to abide by this Tender for a period of 90 days from the date fixed for
receiving the same and it shall remain binding upon us and may be accepted at any
time before the expiration of that period.

constitute a binding obligation upon us.

3 FORM OF AGREEMENT

3. In consideration of the payments to be made by the Employer to the


contractor as hereinafter mentioned the Contractor hereby covenants with
the Employer to execute, complete and maintain the works in conformity in
all respects with the provisions of the contract.
4. The Employer hereby covenants to pay the contractor in consideration of
the execution, completion and maintenance of the works the Contract Price
at the times and in the manner prescribed by the Contract and as stated in
Cash Flow contained in the Appendix to the Form of Tender.

3.1 APPENDIX "A" TO FORM OF AGREEMENT


CONSTITUTION OF COMPANY

i) International Companies:
The Contractor shall prior to the signature of the Form of Agreement
submit notarially authenticated copies of the original documents defining the
constitution of the company, powers of attorney and other relevant documents. In
the case of a Partnership or Firm, these documents shall also show by what persons
and what manner contracts may be entered into and what persons are directly
responsible for the due execution of such contracts and can give valid receipts
together with specimens of their signatures.
An overseas power of attorney of a foreign signatory to the Tender shall have been
endorsed by an approved Omani authority (such as an Embassy).
A contractor intending to undertake the contract jointly with or in association with
other firm or firms including firms or persons acting in an advisory or consultative
capacity shall submit a statement showing how the contract commitment will be
undertaken and the exact relationship between each of the parties.
The name and address of the contractor's agent resident in Oman (if applicable).

ii) Omani Companies:


The contractor shall prior to the signature of the Form of Agreement submit
details of the nature of the company, i.e. partnership, limited liability, joint venture,
joint stock, together with the commercial registration number. These documents
shall also show by what persons and in what manner contracts may be entered into
and what persons are directly responsible for the due execution of such contracts
and can give valid receipts together with specimens of their signatures.

4. NOTE TO THE CONTRACTOR

1. Whilst the Performance bond is an "On First Written Demand" Bond, the
Employer may, but is not bound to adhere to the following procedure. If the
Employer considers that the Contractor is in default of the due performance of his
duties under the contract, then the Employer will give fourteen days written notice
to the Contractor of this occurrence during which time the Contractor shall rectify
such performance to the satisfaction of the Engineer.

If in the opinion of the Engineer such performance is not rectified the Engineer
shall inform the Employer accordingly in writing.

The aforementioned shall not, in any manner whatsoever, alter the nature of the
"On First Written Demand" Bond.

2. A Certificate of Substantial completion in accordance with clause 48 (1) will be


issued only when the building is occupiable and usable for the purpose intended by
the contract and all operating and maintenance documents have been submitted and
approved by the Engineer.

5.0 STANDARD CONDITIONS OF CONTRACT


The Conditions of Contract shall be those contained within the Sultanate of
Oman Standard Documents for Building and Civil Engineering Works, Third Edition, July
1981, prepared and issued by the Directorate General of Finance, Muscat, Sultanate of
Oman, except as amended herein.
Tenderers are deemed to be in possession of their own copy of this document at Tender
Stage and to be fully aware of and have understood the content therein.
AMENDMENTS OF STANDARD DOCUMENTS CLAUSES
The Conditions of Contract shall be those laid down in the aforementioned
Standard Documents for Building and Civil Engineering Works (Third Edition) July 1981,
except in so far as the following alterations and additions shall be made.

Definitions 1(1) (a) "Employer" means Mr. Abdul Jaleel Bin Ahmed Bin Ali
Moosa and the legal successors in title to the Employer who
will employ the Contractor. The address of the Employer

8 ATTENTION TO TENDERERS

This is a fixed price contract with a schedule of notes.

The tenderer is required to include in his offer all the items shown in the drawings
and described in the specifications and all other items required for the completion
of the project.

The Scope of work comprises of:-

Designing, Supplying & execution of post-tensioning slabs and beams for


Stilt, Ground, Five Typical and Terrace floor only.

9.0 SCOPE OF WORKS (ANNEXURE – 1)

SCOPE OF SERVICES FOR POST-TENSIONED SLABS


GENERAL:
The proposed Residential building on plot no 77 at Azaibah, Bausher has a Service
floor, Ground Floor and Typical First to Fourth Floor and Penthouse floor. The structure is
proposed to be an RCC framed structure. Post-tensioned (PT) slab system would be
adopted for the proposed building with PT Beams / Slabs wherever required (Please refer
the structural consultant drawing).
The floor plate / slab system shall be post-tensioned flat slab all over except
at the areas viz. stairs, shafts, voids, ramps etc, or as marked in drawings. The slabs
shall be supported by columns with and without capitals / drop caps generally with
outer peripheral PT/RCC beams. No sinking of slab needs to be considered unless
stated otherwise.
Part A – Post-Tensioned part – PT Contractor’s Scope of Work:
1. Providing detailed design and methodology of post-tensioned slabs with and
without slab drop based on attached design basis.
2. Providing detailed design and methodology of post-tensioned beams (As marked
in structural drawings) based on attached design basis.
3. The PT design elements such as PT slab & PT beams, the PT tendons should share
65% of factored bending moment and the remaining 35% should be shared by
untensioned steel.
4. Liaison and coordination with Main Contractor.
5. Providing shop drawings to Engineer’s approval and to Main Contractor for
information. Both hard and soft copies are to be furnished.
6. All PT Design Drawings and Documentation are to be submitted to the
Consultant for review prior to Municipality submission/Approval. The
Structural Engineer reserves the right to reject any design that seems
unsatisfactory. Any re-design and re-documentation resulting from such a
review will be undertaken by the post-tensioning contractor at no additional
cost.

7. The PT designer should be present at the time of municipality engineer review


with necessary design calculations, analytical models, documentation etc.,
8. Supply and install tendons (Strands).The strands shall be uncoated, 7-wire Low
Relax 12.7mm dia of tensile strength 1860 MPa as per ASTM A416,if not
otherwise stated.
9. Supply of G.I sheathing (ducts) & supervise main contractor’s installation of
sheathing as per the design profile as in approved drawing. The sheathing(ducts)
shall be made from galvanized steel tape of not less than 0.4mm thickness and
the stitching shall be 4-ply to ensure proper durability. The ducts may be of
various sizes as required by the design & post-tensioning contractor.
10. Supply and supervision of fixing of anchorages. The anchorages shall be made
of Cast Iron grade EN GS 250 (Minimum 250 MPa Tensile strength & Hardness
90~100 HRD) or equivalent. The stressing blocks /anchors shall be EN GS 500
(Minimum 500 MPa Tensile strength & Hardness 90~100 HRD) or equivalent.
The wedges shall be three pieces as per the post-tensioning system and shall be
made from special steel of grade SCM415LM 16NiCR4 or equivalent. Proper
Heat hardening & quenching chart / report shall be provided.
11. Design & drawing for the slab mesh reinforcement and additional reinforcement
for punching shear, creep, shrinkage & negative moment at column junctions to
be clearly shown.
12. Supervise all post-tensioned works including work carried out by Main
Contractor on post-tensioned items.
13. Utilizing monostrand / multistrand jacks & Hydraulic pumps as per post-
tensioning system. All equipment shall be accompanied by Technical Data
Sheets; Calibration certificates (as applicable) & details to be submitted to
Engineer / Client for approval. The responsibility, proper functioning of all the
equipment & required service shall be solely on the post-tensioning contractor.
Under the instruction of the engineer, the PT sub-contractor shall re-calibrate
the equipment in the presence of the engineer’s representative.
14. Stressing of tendons and grouting using approved grouts, jacks, stressing pumps
& grouting pumps.
15. Provide technical support to Main Contractor.

16. PT contractor’s responsibility is to mark the PT tendon profile with paint below
the soffit of the PT slabs & beams.
17. Supply and fixing of supports for sheathing (Zinc coated chairs).The chairs shall
be made of 6 ~ 8mm mild steel round bars bent in the form as required by
design.

Part B – Main Contractor’s Scope of work:


1. Liaison and coordination with the post-tensioning contractor.
2. Supply & fix mesh and required reinforcement to Post-tensioned items as per
the post-tensioning design & drawing. Hence, all reinforcements to be supplied
& fixed by the Main Contractor.
3. Provide cement, admixture, grouting water, and crushed ice, grout testing
apparatus, expertise and labourers during grouting of tendons.
4. Supervise concreting in order to ensure no post-tensioning element viz. strands
or ducts or grout vents or anchorages are disturbed / damaged. Once inspected
and permission for concreting is accorded, the entire responsibility for any
damages thereafter, shall be on the main contractor.
5. Provide all shuttering, scaffolding and supports. Note that shuttering for slabs
and beams is to be perfectly level. Supports for post-tensioned items to be
provided until after grouting of strands has been completed.
6. Remove above shuttering and supports once post-tension works have been
completed.
7. Provide sufficient semi-skilled and skilled labourers to the post-tensioning
contractor for fixing of supporting steel & sheathing, threading of strands,
fixing of anchor blocks & wedges, stressing, cutting off excess strands &
grouting.
8. Provide sufficient secure and covered storage for PT hardware’s &
consumables. The area shall be as per the requirement of the construction
program & PT contractor’s requirement.
9. Provide 15m 2 site office with all facilities as per requirement of the post-
tensioned contractor’s use.

10. Provide loading, unloading, site transport and movement of equipment,


materials and labour during the post-tensioned contractors scope of work at all
levels, including handling, cranes, and trucks. All unloading of materials at the
site shall be Main Contractor’s responsibility.
11. Provide power and water for a PT contractor to enable them to complete his
works.
12. Provide equipment and labour for concrete testing. 3 cubes required per 50m3 of
concrete.
13. Supply and erect necessary and safe working platform for post-tensioning
around the periphery of the building as required. Approximate width of the
platform shall be 1.50m and to include approved handrail. The platform will be
required at all levels.
14. Shift cement bags(maxm.50kg each), all hardware’s for post-tensioning, ducts,
strands, all equipment to all floor levels and back to store after all PT
operations.

Part C – Design Brief:

Class 3 - BS: 8110 wherever required (As per Structural Drawings) for the proposed
building with a design life of 60 years & a fire rating of two (02) hours.

Arch. Layout).
 The floating column loads (service/Un factored load) are furnished in tabulated
format. (Please refer to the proposed Beam/Slab layout drawing as provided by the
Structural Consultant) are to be included in the design of P.T beams.
 There are changes in column orientation & partial floating of the column in certain
areas. Please take such partial floating loads / shear into account for the PT
beam/Slab design.
 PT contractor to submit allowable & actual elongation chart for all tendons to the
main consultant for review & approval.
 PT designer to submit the Natural frequency/ vibration check for all cantilever
slabs

11 PRICING PREAMBLES

A. Introduction
These Pricing Preambles set out the basis on which the Scheme of Rates has been
prepared. Notwithstanding the provisions of this Pricing Preamble, the Contract is
reminded that the Tender Drawing and the Specifications form part of the Tender
Documents and as such mutually refer to the intent of the Tender Documents. In the event
of any discrepancy between the details on the drawings, description in the Specifications
or in Schedule of Rates then the item shall be deemed to have been priced in accordance
with the description in the Schedule of rates.
B.Pricing.
Prices shall be inserted against all items in the Schedule of Rates which have a
monetary value against any items he must indicate this intention by writing ‘NIL’, but
each must be separately priced or indicated by ‘NIL’ but each must be separately priced or
indicated by “NIL’ as the case may be.
Items in Preliminaries, for which the Contractor required payment, shall be separate prices.
Items for which the contractor does not require payment must be priced as ‘NIL’ as
mentioned above. Tenders submitted where Preliminaries have been priced as a single
lump sum, may not be considered.
Principles of Measurement

The Schedule of Rates has been prepared in accordance with the ‘Principles of
Measurement, (International) for Works of Construction”, June 1979 edition,
published by the Royal Institution of Chartered Surveyors, 12 Great George Street,
Parliament Square, London SW1P3AD. Rates and prices included in the Tender
shall be deemed to allow for the provisions of these Principles.

D. Descriptions
The classification of descriptions in POM (1) groups similar items together. Where
descriptions in the Bill of Quantities state a specific classification, the price inserted by the
Contractor shall be deemed to cover other classifications given in POM (I) for the item in
question. For example, under POM(I) Clause C2,1,6 the description ‘Walls’ would
include attached columns even though they may not be specifically described.
It shall be understood that the phrase ‘and the like’ shall apply to all descriptions. This
means that the price inserted by the Contractor for each item shall be deemed to apply also
to items which are so similar in terms of material, labour and plant required that the value
would be the same.
Categories of work described in POM (I) as, ‘shall be understood to be included’, are not
mentioned in descriptions. As the phrase implies, it shall be deemed that the value of such
categories of work is covered within other prices in the Bills of Quantities.

E. Measurement (only for variations)


Measured work in Bill of Quantities is measured net as fixed in position with
measurements taken to the nearest 10mm. This principle does not necessarily apply to
dimensions stated in the description which is given as the nearest mm.
Unless otherwise stated, no deduction has been made from items required to be measured
by area for voids less than 1.00 SQ.M2 unless the void is located at the edge of the
measured area.

F. Items to be Inclusive
Unless otherwise stated, items measured in the Schedule of Rates are deemed to be
inclusive of all that is necessary to fulfill the liabilities and obligations required for
completing the work including:
a) Labour and all associated costs
b) Materials and goods in accordance with the Specifications

c) Fixing materials in their final position including all hoisting.


d) Provision of plant, tools and equipment
e) Temporary works
f) Establishment charges, overheads and profit.
The prices inserted by the Contractor shall be deemed to include for this provision.
The amounts set against any items of profit shall include for all costs in connection with
letters of credit, bank charges, interest charges and insurance after the materials come
under the control of the Contractor.

G. Lump Sum Prices


Where contractors are required to price sections/elements as a lump sum or series
of lump sums, then the pricing shall take account of the following:
a) The works shall be described in the specifications and shall comprise general and
specific requirements of the tender drawings. No claim in respect of errors or
omissions in the pricing of the lump sums will be admitted.
b) The Contractor shall particularly note any list of approved sub-contractors. No
other sub-contractors shall be used for the project without prior approval.
c) The Contractor shall be required to draft, quantify and price a complete breakdown
of his tender lump sum figures. The breakdown shall be comprehensive and
adequate for the administration of the contract and shall be presented in accordance
with the relevant Sections of POM (I) to facilitate the preparation of monthly
valuations and the settlement of the Final Account.
d) Each individual section/ element price shall allow for complying in all respects
with the specifications and cover all obligations under the contract for final design
work, supply of all materials and equipment, installation of all materials and
equipment to produce complete operational installations and maintenance of the
works.
e) All rates and prices shall be gross and shall include for main contractor’s
overheads, profits and general and special attendance
f) The lump sum prices shall be subject to contract provisions for variations and
adjustment of costs.

g) The Contractor’s responsibility for the adequacy of the lump sum shall not be
reduced by any errors or omissions, which are discovered in the breakdown.
h) The Contractor shall include for the supply of spares detailed in the specifications
for all mechanical and electrical engineering installations to be handed to the
Engineer.
H. Approvals
The terms “Approved”, “Directed”, “Selected” and similar expressions shall mean
approved by, directed by or selected by the Engineer.

I. Fix only
The expression “fix only” means that the Contractor shall provide the following facilities:-
a) Loading, transport from store to site and unloading, including additional packing
required.
b) Fixing as defined in Clause GP72 of POM(I)
c) Supplying full - size templates.
d) Giving and marking dimensions and taking responsibility for their accuracy.
e) Getting in, protecting, handling, distribution, and placing in position.
f) Assembling as required.
g) Casing up and protecting and clearing away, protection on completion of the
works.
h) Full cost replacement of any items which are damaged, broken, lost or stolen after
the acceptance of the items from the supplier and until handing over the completed
works.
i) Other necessary and usual facilities and documentation.

J. Attendance on Nominated Sub-Contractors.


The expression ‘Add for Attendance’ in respect of Nominated Sub-Contractors
supplying and fixing goods and materials as used hereinafter shall be deemed to include
on the part of the Contractor the following.

a) Allowing free use of standing scaffolding, mess rooms, sanitary accommodation


and welfare facilities, providing office accommodation and sheds for storage of

plant and materials inclusive of necessary lighting, power and water, providing
light and water for their work and clearing away all rubbish. If the Contractor
should strike any scaffolding before ascertaining whether it is required by any Sub-
Contractor he will have to re-erect it, if so required, at his own expense.

b) i) Provision of all transport for labour, plant and materials at the site.

ii) a) Taking delivery at the site of all materials, plant, equipment and tools.

b) Getting in, stacking or placing adjacent to the works of under, cover where
the nature of the materials is such that they may be damaged by inclement
weather.

iii) Provision of all necessary labour and plant for general assistance in unloading,
hoisting and distribution materials and plant for Nominated Sub-Contractors for the
provision of all necessary information and assistance, for setting out and for the
provision of adequate and proper working space.

14.SCHEDULE OF RATES

The Tenderer shall provide hereunder a detailed


Schedule of Rates on which his fixed price is based.
These rates will be used to calculate the value of any
variations to the Contract.

Any item of work instructed by the Engineer which


constitutes a variation to the Contract which is not
covered by these rates shall be measured and valued on
a pro rata basis wherever possible.

New rates supplied for variations will require to be


based on the same pricing principles as the rates stated
by the Tenderer.

The Tenderer should note that the list is not exhaustive


and he should insert items and rates for work which
forms part of his lump sum price which is not detailed
here.
