Chairman of Rajya Sabha रा यसभा सभापती

 घटने या कलम ८९ अ वये भारताचे उपरा पती हे रा यसभेचे पदिस सभा पती असतात The
vice president is the ex-officio chairman of the Rajya Sabha and its presiding officer.
 यांना रा यसभेचे सभापती या ना याने दूर करता येत नाही यांना उपरा पती हणन
ू पदाव न
दूर के यासच ते रा यसभे या सभापती पदाव न दूर केले जाऊ शकतात.
 रा यसभा सभापती हे संसदेचे सद य नसतात. तसेच रा यसभा सभापत ना मतदाना या पिह या
पैरीत मतदान करता येत नाही. यांना केवळ मतां या समसमानते या ि थतीत िनणायक मत
दे याचा अिधकार आहे .
 यावेळी उपरा पत ना (सभापत ना) पदाव न दूर कर याचा ठराव रा यसभेत िवचाराधीन असतो
तेहा ते सभागहृ ाचे पीठासीन अिधकारी हणन
ू काय क शकत नाहीत. मा यांना सभागहृ ा या
कामकाजात भाग घे याचा व बोल याचा अिधकार आहे . मा अशा ठरावावर मतदान कर याचा
यांना ह क नाही.

सभापत चे अिधकार व काय
सभापत ना लोकसभा अ य ा माणेच अिधकार व काय असतात. मा लोकसभा अ य ांना असलेले
पुढील दोन अिधकार रा यसभा सभापत नी नसतात.
१.एखादे िवधेयक धनिवधेयक आहे िक नाही हे ठरिव याचा अंितम अिधकार लोकसभा अ य ांचा
असतो. The Speaker decides whether a bill is a money bill or not and his
decision on this question is final.
२. दो ही सभागहृ ां या संयु बैठक चे अ य थान लोकसभा अ य भष ू वतात. The Speaker
presides over a joint sitting of two Houses of Parliament.
जर लोकसभा अ य गैरहजर अस यास अ य थान लोकसभेचे उपा य भष ू वतात, अ य व
उपा य दोघेही गैरहजर असतील िकंवा यांची पदे र असतील तर संयु बैठक चे अ य थान
रा यसभेचे उपसभापती भषू वतात. सभापत ना हा अिधकार नसतो कारण ते संसदेचे सद य नसतात.

कलम ८९ अ वये, रा यसभा श य ितत या लवकर रा यसभे याच एखा ा सद यास आपला उपसभापती हणन

िनवडते.
उपसभापती हे रा यसभेत य पणे जबाबदार असतात, ते सभापत या अिधन थ नसतात.
उपसभापत चे काय व अिधकार

उपसभापती सभापत ची काय पार पाडत असतान ते रा यसभेत पिह या फेरीत मतदान क शकत नाहीत, मा
िनणायक मत दे ऊ शकतात.
सभापती सभागहृ ाचे अ य थान भषू वत असताना उपसभापती इतर सद या माणेच असतात, अशावेळी यांना
सभागहृ ात बोल याचा, कामकाजात भाग घे याचा व मतदानाचा अिधकार असतो.

Panel of Vice-Chairmen in Rajya Sabha
 The chairman of the Rajya Sabha nominates six MPs from amongst the members of the
House for the panel of vice-chairmen.
 In the absence of the chairman and the deputy chairman, one of them presides over the House
 But can not preside when the chairman and the deputy chairman seats are vacant. During such
time, the Chairman’s duties are to be performed by such member of the House as the president
may appoint for the purpose. सभापती व उपसभापती दोघांचेही पदे र असतील तर रा पती
या योजनाथ रा यसभेतील एखा ा सद याची िनयु करतात.
 While nominating members to the panel, the chairman usually gives consideration to the
strength of various parties in the house and may also consult their leaders.

Some statutes also confer duties on the Chairman.
 For instance, rules made under the Salary, Allowances and Pension of Members of Parliament
Act, 1954, do not take effect until they are approved and confirmed by the Chairman and the
Speaker.
 Under the Judges (inquiry) Act, 1968, the Chairman has to constitute a Committee, upon receipt
of a motion for the removal of a Judge of the Supreme Court or of a High Court, for investigation
into the grounds on which the removal of a Judge is prayed for. The rules made under that Act are
also required to be approved and confirmed by the Chairman and the Speaker.

Leader of the House
Under the Rules of Lok Sabha, the ‘Leader of the House’ means the prime minister, if he is a
member of the Lok Sabha, or a minister who is a member of the Lok Sabha and is nominated
by the prime minister to function as the Leader of the House.
There is also a ‘Leader of the House’ in the Rajya Sabha. He is a minister and a member of the
Rajya Sabha and is nominated by the prime minister to function as such.
The leader of the house in either House is an important functionary and exercises direct
influence on the conduct of business.
He can also nominate a deputy leader of the House.
The same functionary in USA is known as the ‘majority leader’.

Leader of Opposition
 The Leader of Opposition is leader of the largest party that has not less than one-tenth of the total
strength of the house.
 It is a statutory post defined in the Salaries and Allowances of Leaders of Opposition in Parliament
Act, 1977.
 The Act says that LoP is the Leader in that House of the party in opposition to the Government
having the greatest numerical strength and recognised as such by the Chairman/Speaker of the
House.
 In Lok Sabha, total strength is 545 members so any party that has 55 members can get the post as
recognised as such by the speaker/chairman.

Leader of Opposition िवरोधी प नेता
Importance of LoP: The shadow PM
 The Westminster model that India follows the opposition is a recognizable entity and the LoP is
referred to as the ‘shadow Prime Minister of Shadow Cabinet’.
 She/he is expected to be ready to take over if the government falls.
 That is why Ivor Jennings described the leader of Opposition as the ‘Alternative Prime Minister’.
He enjoys the status of a minister and is paid by the government.
 The LoP also plays an important role in bringing cohesiveness and effectiveness to the
opposition’s functioning in policy and legislative work.
 LoP plays a crucial role in bringing bipartisanship and neutrality to the appointments in institutions
of accountability and transparency – CVC, CBI, CIC, Lokpal etc.
 The same functionary in USA is known as the ‘minority leader’.

Whip तोद or गटनेते

 Meaning: A whip in parliamentary parlance is a written order that party members be present for
an important vote, or that they vote only in a particular way. The term is derived from the old
British practice of “whipping in” lawmakers to follow the party line.

House nor in a Parliamentary Statute.

Whip तोद or गटनेते

 It is based on the conventions of the parliamentary government.

 Every political party, whether ruling or Opposition has its own whip in the Parliament. He is
appointed by the political party to serve as an assistant floor leader.

 He is charged with the responsibility of ensuring the attendance of his party members in large
numbers and securing their support in favour of or against a particular issue.

 He regulates and monitors their behaviour in the Parliament.

 The members are supposed to follow the directives given by the whip. Otherwise, disciplinary
action can be taken.

Kinds of whips in Britain
The importance of a whip can be inferred from the number of times an order is underlined.
1. A one-line whip, underlined once, is usually issued to inform party members of a vote, and
allows them to abstain in case they decide not to follow the party line.
2. A two-line whip directs them to be present during the vote.
3. A three-line whip is the strongest, employed on important occasions such as the second
reading of a Bill or a no-confidence motion, and places an obligation on members to toe the
party line.
