Terms and Conditions

You are requested to read the following points carefully before handing over the consignment.

1. In these terms and conditions (TandC) we, us or our shall mean and relate to InstaKart Services
Private Limited. Similarly, you, your, shipper or consignor shall mean and relate to any natural or
legal person who has agreed to utilize our services in accordance with these TandC and any other
applicable policy which may be brought into effect by us from time to time.
2. A shipment/ consignment" shall mean all parcels/ packages/ goods (excluding any consignment
related documents) that travel under a waybill and which may be carried by any means or route we
choose including air, road or any mode of carriage.
3. A waybill shall include any label, air waybill, consignment note or any document as a proof of
dispatch, manually or automatically generated by us and shall incorporate these TandC.
4. All consignments shall be booked on a said to contain basis i.e. we shall be under no obligation to
verify the description and contents of the consignment declared by the consignor and as such the
consignor shall undertake and ensure to make correct and factual declaration on the waybill.
5. We however shall have the right to inspect any consignment without prior intimation to the
consignor for checking the contents.
6. Every consignment is transported on a limited liability basis as provided herein. If Consignor
requires greater protection, the consignor needs to insure their respective consignments.
7. Consignments are delivered only to the consignee's address given by the Consignor but not
necessarily to the named consignee personally.
8. Consignments must not contain any letter of communication which will infringe the Indian Postal
Act, 1983 or any other statute for the time being in force. Further, consignments must not contain
any hazardous material, dangerous goods, articles prohibited or restricted by IATA, ICAO, BCAS,
Indian Railways or other government or regulatory agencies or under any other law for the time
being in force will not be accepted.
9. You shall not enclose cash in the consignment and not book passports, credit/ debits cards, share
certificates and travel documents.
10. Our liability in cases of any loss or damage to the consignment shall not exceed Rs.5000/-.
11. You shall declare the value of the consignment on the waybill and shipping label at the time of
booking.
12. You shall ensure that the consignment is properly packed with appropriate packaging material to
withstand the handling during carriage.
13. Consignments addressed to Ministry Offices and Central Government Offices in New Delhi are
put a box, due to security reasons as per the directions of the Central Government without taking
any POD proof/ acknowledgement from the consignee.
14. You have to hand over all the consignments before the specified cut off time for us to ensure on
time delivery.
15. The consignor agrees that we shall not be liable for any loss including but not limited to taxes and
duties levied on the consignments arising due to confiscation of any consignment by any
government Agencies due to lack of proper documents. Further, we shall not be liable for any loss
arising due to events that are beyond its control such as floods, accidents, fire, theft, war etc.
16. Every effort shall be made to adhere to the delivery schedule, but it may be delayed in the
circumstances beyond control of the company.
17. The consignor agrees that Octroi or any other charges levied by any Central/State/local
Authorities wherever applicable will be extra, which the consignor shall be liable to pay in Indian
Rupees.
18. You agree that we shall not be liable for any loss, miss-delivery, delay or damage to any
consignment sent and no officer of ours will be liable for any such loss or delay or damage,
except to the extent of clause mentioned above in Clause No. 10 above.
19. All matters of business should be settled within the jurisdiction of the booking/ picking up hub.
20. Consignments shall be accompanied by the respective state forms as prescribed by the
Government of India to meet the requirements of the sales tax/ VAT authorities.
21. Consignments addressed to a Post Box Number cannot be delivered.
22. The consignor agrees to indemnify and hold us harmless for any loss or damage arising out of the
consignors failure to comply with any applicable laws or regulations, failure to provide any
requisite documents in relation to the consignment and for consignors breach of the following
warranties and representations:

1. All information provided by the consignor/ consignors representatives Is complete and accurate,
2. The consignment was prepared in secure premises by consignor/ consignors representative;
3. The consignor has protected the consignment against unauthorized interference till the same being
handed over to us.
4. The Consignment is properly marked and addressed and packed to ensure safe transportation with
reasonable care and handling.
5. All applicable statutes have been complied with.
1. The invalidity or unenforceability of any of the particular clause/s of these TandC shall not affect
the remaining clauses.
2. Dead weights or volumetric weight whichever is higher will be charged and taken while calculating
the weights and rates and billed to next higher half or one kg. The final weights will be marked by
company only. Any discrepancy in weight shall be sorted out till final delivery happens to the
customer only. No post-delivery weight disputes will be taken up by us.
3. All consignments must accompany all applicable statutory declarations and documents, and
invoices for speedy regulatory clearances.
4. You shall provide at least 2 (two) copies of invoice/ declaration to facilitate delivery.
5. Regular pickup will be effected only on business days. Transit time will not include non-business
days.
6. Not-withstanding anything contained anywhere or earlier agreed between the parties, any
consignment which is returned back to origin (RT0) for any reason whatsoever, will be chargeable
as per the rate specified by us and the consignor shall be liable for the payments of such RTO
service charges without raising any objections or disputes whatsoever.
7. It is expressly understood and confirmed by you that we are merely a service provider to you.
8. We may at our sole discretion provide additional services such as web based online tracking,
accepting payment from consignees by way of cash/ card.
9. We will be liable for any damage to a consignment on actuals only if the consignment has been
identified by us as damaged after dispatch and before delivery to the consignee.
10. In case of reverse pickup, we shall not take any responsibility of any damage to the consignment.
11. We reserve the right to cancel a reverse pickup request without any prior intimation.
12. We reserve the right to refuse, hold, cancel, postpone or return any consignment at any time if
such consignment would in our sole opinion be likely to cause damage or delay to other
consignments, goods or persons, or the transportation of which is prohibited by law or is in
violation of these TandC, or if the account of the consignor is not in good credit standing.
