RE: STATUTORY NOTICE TO SUE THE LOCAL AUTHORITY PURSUANT

TO SECTION 97 OF THE ACT NO 8 OF 1982.

We are under instruction of Mr Robert Mwanga and 14 others our client to give you one month
statutory notice to commerce suit against you owing to violation of Local Government laws to wit
to force our client above named to be resident of Kimara ward while they fall within Mbezi
Ward

Your are aware that according to the Government Notice No 259 of 1999 it set out boundaries of
the wards within the Municipalities within the Dar es Salaam City Council. According to that
arrangement our client falls within the Geographical area of the Mbezi Ward. However for the best
reasons known to the ward leaders that is Ward executive Officers and Ward councillors of Mbezi
and Kimara and one of the Kitongoji Chairman of Kimara “B” have been forced our client to
be in Kimara Ward contrary to apparent laws.

Take note there fore unless you take measures to rectify those anomalies after expiry of one month
we shall institute a declaratory suit seeking the following reliefs

1) Declaration that our clients are lawful resident of Mbezi Ward

2) Declaration that that Kimara B Ward is non existence

3) Seeking damages for the disturbances caused by Ward leaders to our clients

TAKE FURHER note that unless our client are assured by yourself that they are resident of
Mbezi and hell to our demand note we shall have no other option but to institutes the suit
subject to costs and other embarrassments
