THE GENERAL ASSEMBLY

Affirming the Universal Declaration of Human Rights, which proclaims that people
have the right of adequate living standard,

Stressing the urgent need to achieve a comprehensive and permanent peace in


South Asia, since the region is in an arms race and potential issues like Kashmir can
lead to full flare nuclear war and neighboring countries such as Iran are also aiming
at getting Nuclear weapons.

Bearing in mind that it is United Nations’ responsibility to raise awareness among the
people for the citizens of Kashmir in order to emphasize the unity of people,

Deeply concerned whether the new decision will be ignored, as was the
‘‘referendum’’ decision of the United Nations, which was put into effect 72 years ago,

Expressing its appreciation towards the United Nations’ previous exertion for the Non
State Armed Groups issue,

Fully aware of the increment of Non State Armed Groups in Kashmir Valley,

Fully alarmed about the rapid proliferation of Non State Armed Groups in Kashmir
Valley,

Acknowledges the violence by Non State Armed Groups inflicted on the Kashmir
citizens,

Realizing the unsafe and life dangering conditions Kashmiri people face when
forcing to leave their homelands. A need to prevent thousands of citizens from dying,
but also to defend the rights of people by NSAG (159 non state militant groups) and
state during the conflict in 2019,

Bearing in mind that prevent the armament movements in the Kashmir Valley is the
DISEC’s ultimate goal to ensure that the weapons in the region are silenced and
nuclear weapons cause more damage to the region, and totally unacceptable to see
DISEC as a union dealing only with weapons,

Considering the DISEC’s two main goals in ensuring disarmament are to preserve
world peace, and the second is to ensure that more people are not harmed by this
problem, therefore, it is necessary to observe human rights in following clauses, for
this reason, it is the roadmap that will be followed to first solve the problem in the
region diplomatically and then to disarm the region and ensure the security of the
people of the region,

OPERATIVE CLAUSES

1) Suggesting to come to a new agreement on Non State Armed Groups in


Kashmir Valley,

i. All NSAG should be banned by the UN and other countries should follow
course,
ii. The bank accounts of NSAG should be freezed and countries should be
compelled to do so,

iii. Kashmiri youth which has recently taken up arms against the state should
be given an amnesty to return to their usual occupations,

iv. India should improve its border security so that militant groups are not able
to enter Kashmir and partake in militancy,

v. Foreign militants should not be confused with local Kashimiri fighters and
the general grievances of the local people who are partaking in militancy
should be addressed,

2) Invites the highly respected members of UN Disarmament and International


Security Committee to create a pool of fund which will be called “International

Supporting Fund” (ISF) for assisting to Kashmiri people’s needs which occurred as a
result of NSAG and security forces actions and promoting the projects and programs
which will be conducted by DISEC, and this fund will;
a. be aiming to support citizens who have been displaced by the current
authority in Kashmir and migrants who are trying to escape the India- Pakistan
conflict and dying during the travel because of inappropriate living conditions,
i. increasing international pressure on India by its trading partners not to
resort to these measures would be an important step towards having
normalcy,
b. provides the required help by solving the problems which are related to the
Kashmir borders/settlements, protecting basic human rights of all Kashmiri
people regardless of religion,

3) Encourages the India and Pakistan Government to, eventually, hold a


referendum in Kashmir which will be established by the provision of DISEC by
providing a transitional period for the preparation of a referendum in which the
people in Kashmir would choose between independence and integration with
India which was originally obligated in accordance with the settlement plan in
order to:
i. monitor the ceasefire to maintain the peace between regions,
ii. identify and register qualified voters which will consist of only the
citizens that are residing in the Kashmir Valley,
iii. organize and ensure a free and fair referendum and proclaim the
results,
iv. state representation should be improved by holding free and fair
elections, in this way, Kashmiri people would have an incentive to work their
way through the political platforms rather than taking up arms,

4) Further Encourages the Member States of DISEC to organize an Ad-Hoc


Committee in order to discuss about three specialized agenda items which are
“Human right violations in Kashmir”, “the dangers and effects of feasible 3rd
Kashmir War” and “fight against organized crime and terror formations in
Kashmir Valley and occupied NSAG acts”, and this Committee will be organized
with the implementation of the following terms:

i. investigate the cases about the human right violations in Kashmir and
if necessary, promoting the cases and culprits to the International Criminal
Court (ICC),
ii. to prevent a repeat of the Kashmir Wars that have caused killing
hundreds of civilians, countries that cause conflicts would be restricted in their
authority and the necessary path would be taken to resolve this conflict through
"dialogue" ,
iii. further aiming to take into consideration of resolutions which adopted
by UN or other international organizations such as but not limited to UNHCR
(the UN Refugee Agency), OIC (Organization of Islamic Cooperation), IsDB
(Islamic Development Bank Group),

5) Further invites to the relaunch of peace talks between the India Government
and Pakistan Government because during the years 2003 and 2006 when there
were bilateral talks happening between India and Pakistan, Kashmir was at its
most peaceful in the last forty years, and these peace talks aim at finding a
long-term solution for the future of Kashmir which will be:
i. moderated by UN Disarmament and International Security Committee,
ii. gradual decrease in deployment of troops at Indo-Pak border,
iii. the following topics will be included in the discussion, in order to
acquire a more fruitful discussion environment:
a. the ethnic diversity in the region, socioeconomic backgrounds, and
religious tendencies linked with extremism,
b. geographical factors heavily influencing the areas of interest, namely
the topography of the region, climate and overall geography,
c. the distribution of resources crucial to human survival and those that
are heavily contested,
d. representatives from the DISEC and will participate as observers, in
order to recognize the agreement reached between two forces;
6) Seeks the member states of DISEC to implement a way to raise awareness
about the issue in order to discuss upon the current situation and conflicts in
Kashmir in a detailed and extensive way and these steps should be:

i. The discrimination against Kashmiris especially Kashmiri students
studying in different parts of India should end and this can be achieved by
raising awareness in Indian people respecting Kashmiris
ii. India should take Kashmiri youth especially students into
consideration and india should engage with them through different platforms
and the students should be allowed to reveal a report to find a common solution
for the situation of Kashmir by the youths’ point of view,
iii. the UN member states who can afford should help in funding
Kashimiri students to obtain higher education by giving scholarship visas
iv. international media and human rights organizations should be given
access to Kashmir since Indian media is biased against Kashmiri people and
they do not consider that their voice is being heard by Indian media therefore
international communities should put pressure on India to:
a. Give access to International media to Kashmir
b. Human rights organizations should also be allowed to operate in Kashmir
so that excesses committed by security forces or armed groups can be documented,
v. aiming to introduce the report to the DISEC which will be written by
students and consisting of their suggestions and outcomes of the panel;

7) Calls upon NSAG operating in Kashmir such as JKLF, Hizbul Mujahideen,


Jaish-e-Mohammed and Lashkar-e-Tayyaba, such armed groups are,their very
existence depends upon the support of Kashmiri people, but still their funding
must be stopped, to this end present the following points,
i. Countries which give financial and military support to these groups
should be put on FATF blacklist if they don't give up the support that they
provide to these militant groups
ii. In the meantime Indian government needs to take steps so that further
Kashmiri youth is not further alienated,

8) Regarding to solving the armament problem in Kashmir Valley;


i. After the resolution of the conflict in the region by the UN, a group
under the leadership of the UN will be assigned to the region to prevent the
supply of illegal weapons in the region,

ii. Nuclear weapon production should be decreased in the region, which
has further militarised the region, since nuclear weapons are invented to kill
people fast, therefore, in the case of DISEC, it is up to the door to ensure
disarmament and prevent people from dying, the impact area of nuclear
weapons is not limited to the region where nuclear weapons are used, the
radiation created by nuclear weapons is to ensure that nuclear weapons are
collected and taken under UN control in order to protect the present and future
of the people in the region close to Kashmir,
iii. After the Kashmir problem is resolved by referendum, to prevent the
presence of soldiers in the region and to ensure the safety of the people with
certain officials sent by the UN,
iv. Signing a UN-led "non-aggression pact" between Pakistan and India will
prevent another war in the region,

9) Further invites the UN to recall the resolutions including 23 decisions taken


between 1948 and 1965, and "Resolution 307" on December 21, 1971, and
designate a specialized new resolution paper to improve the current condition
of South Asia by provide contacts with the government of India and Pakistan
Authority in order to;
i. Emphasize the fact that any kind of human right violations as NSAG has been
doing in Kashmir so far cannot be tolerated by UN DISEC,
ii. promote reconciliation about the future of Kashmir Valley,
iii.guarantee freedom of navigation through international waterways in the area,
iv. ensure the political independence all people of Kashmir regardless of
religion,
v. withdraw the armed forces, which have a threat for Kashmiri people, from the
occupied territories and conflict zones,
vi. warn NSAG that if actions which are illegal according to the UN international
laws are repeated, DISEC will be taken due precautions including but not limited to;
a. condemn the NSAG officially,
b. usage of unmanned military vehicles which will be controlled by UN
peacekeeping forces against NSAG,

10) Considering the main issues in Kashmir is a distrust of Kashmiri people in the
system of Indian state apparatus,
i) the committee would like to direct India that the Indian justice system in the
valley should be improved so that the security forces are held accountable for
excesses that they commit, in this way the trust of Kashmiri people on the justice
system could be developed and they would be less likely to take up arms against the
state,

11) Declares accordingly one of the main issues which has led to the taking up of
arms by the Kashimiri youth is a distrust in the Indian political system without proper
political platforms to channel their discontent through, the Kashmiri youth is
increasingly taking up arms against the state to make their voices heard;
i. proper political channels should be provided through which Kashmiri people
can have their say,

12) Regarding the recent article removed by India, article 370 and article 35A from
its constitution which were meant to ensure semi autonomous status and demographic
status quo of Kashmir respectively which has further alienated Kashmiri people and
their fears of demographic change has become a reality, therefore, Indian government
should take following steps:
i. Article 370 should be again put on the constitution of India,
ii. Article 35A should be again put into the constitution of India,

13) Decides to remain actively seized of the aforementioned matter.
