Since the unpaid Estate Tax of the Marcoses is now being talked about just
recently, I just suddenly remembered the Estate Tax that we paid years ago.
In 2016, we sold my grandparents’ farmland in San Pedro, Laguna.
My grandmother (Loreta) already passed away in 2001 while my grandfather
(Feliciano) passed away in 2012. Given this, their 8 children will automatically
inherit the sales of the land.
My mother (Alicia) died in 1993. So as her only child, I got part of her inheritance
from my grandparents. Even though my father was still alive at that time, my aunts
and uncles did not include my father as one of the heirs because, since 1995, he
was already living in with his common-law wife.
I also have an uncle (Alfonso) who died in 2012 following the death of my
grandfather. In his case, the heirs are his wife and three children.
During the times when the sale of the land was being handled, it was explained to
us that we had taxes to pay because of our inheritances. And this is indeed the
Estate Tax.
Even before the official Estate Tax papers were obtained from the BIR, the estate
agent already informed us of the amount of Estate Tax for each deceased heir.
These are the following:
PHP 10,000.00 PHP 683,929.50 PHP 433,100.50 PHP 25,000.00
With these digits, Ate Nene (our eldest aunt) assumed that each amount was
based on the date of death of the deceased heirs; the earlier you die, the greater
the estate tax amount is. Well, obviously, since my mother died in 1993, the
highest amount (PHP683,929.50) was assumed to be for her.
𝑃𝐻𝑃683,929.50 ÷ 8 = 𝑃𝐻𝑃58,491.19 ≈ 𝑷𝑯𝑷𝟖𝟓, 𝟓𝟎𝟎
On December 7, 2016, I immediately paid my aunts and uncles in the amount of
PHP85,500 each. I have them signed as proof of my payment.

In January 2017, we had received the copy of the Estate Tax Return from the BIR
and the digits are as follows:

It turned out that the smallest amount (PHP10,000) is the Estate Tax for my
deceased mother.

I should have pay them just only PHP1,250 each.

= 𝑷𝑯𝑷𝟓𝟎𝟓, 𝟓𝟎𝟎
I have made a total excess payment of PHP505,500. This is really a huge huge
amount!
I wrote a letter to them asking to return back my excess payment but they refused
to give it back stating that the Estate Tax papers were only made up by Kuya Jhune
(uncle). He is the one who handled the transactions when the farmland is on sale
and they were really angry on him during those times.
In my mind, these people are just so unfair! The paper was really from the BIR so
how can they say that it’s just all made up.
One more thing..the heirs of my deceased uncle (Alfonso) should also pay us the
associated Estate Tax that was already stated for them but my aunts and uncles
did not even charge them. So unfair!

I know it was my mistake that I paid immediately before the Estate Tax Return
from the BIR was released. But it's really frustrating, because they're my relatives
and I expected them to be fair.
I think it is really true that MONEY IS THE ROOT OF ALL EVIL. One could forget
about being a relative just because of money.
Wew!

Why am I writing this now? Even though I know that I can't really get my money
back, I'm writing this because I think I shouldn't just forget it. I think I need to
share it somewhere on the internet. I think that somebody has to know this story.
