BACKGROUND OF THE CASE Nestor Pol of San Juan, La Union, is the owner of a public utllty Jeepney with plate no, DVW 426. plying the route San Femando to Bacnotan, La Union. Copy of the certificate of registration is attached. The authorized driver Is Hermogenes Yapit of San Juan, La Union ‘Spouses Angelito and Zenaida Alviar, are engaged in trucking business with address at Paranaque, Metro Manila, They are the registered owners of a 10 wheeler truck with plate no. PFD 824. The authorized driver Is Rico Nacario of Paranaque, Metro Manila, On October 13, 2014, Rico Nacario while driving the truck along the National Highway, Baroro (South of the Baroro Bridge), Bacnotan, La Union, Proceeding southwards, collided with the jeepney then proceeding northwards, driven by Hermogenes Yapit. As a result Hermogenes Yapit was Injured and a passenger Erlinda Papa died. The Jeepney was also wrecked with an estimated damage of P 225,000.00. Tha truck also Incurred damages. The Jeepney driver claimed that the truck was over-speeding and encroached on his lane when the truck overtook a motorcycle. The truck diver [claimed that his truck has already returned to its lane after overtaking a motorcycle and the jeepney driver panicked and manoeuvred his jeepney on the opposite lane.
