Problem question
Janine has had a grudge against her neighbour, Christine, for many years because
Christine bullied her when they were in the same class at school. Janine often talks
to her friend Bella about how much she hates Christine. Recently, Janine has been
complaining about Christine even more than usual and saying that she deserves
some payback. Bella is worried that Janine may hurt or even kill Christine.
One day, after Janine has yet again been complaining to Bella about Christine, Bella
sees someone she thinks is Janine approaching Christine’s house. In order to stop
Janine from attacking Christine, Bella runs up and pushes her over. As she falls, she
hits her head on a rock and loses consciousness. Bella realises then that it is not
Janine at all but Janine’s sister, Lynn. Bella calls an ambulance.
The paramedics arrive quickly but as they are lifting Lynn onto the stretcher, they
drop her, causing her to hit her head a second time. Lynn dies on the way to the
hospital. A coroner’s report shows that Lynn died from internal bleeding from both
blows to the head, which was made worse due to blood-thinning medication Lynn
was taking for a heart condition.
Meanwhile, Janine is out walking in some woods near her house when she
encounters Christine. Janine hits Christine over the head with a hockey stick and
Christine falls to the ground. Believing that she has killed Christine, Janine buries her
in a shallow grave in the woods. When Christine’s body is later discovered, a
coroner’s report shows that the head wound was only minor and survivable, and that
Christine died of suffocation from being buried alive.
Advise Bella and Janine as to their liability, if any, for criminal offences,
including the use of any criminal defences that may be relevant.
Within your answer, you should also critically discuss – with reference to legal
authority and academic commentary – at least ONE area of potential liability
where you think English criminal law is unsatisfactory.
