LEGAL ISSUE-

1.Ban on movie will be violation of basic fundamental right of


freedom of speech and expression.
2.Ban on movie will be work as a restriction Over The Other artists
imagination and can someone's mere imagination damage people's
firm religious beliefs?
3. Is content in the movie blasphemous for the Christians belief and
breach of article 25 of Indian Constitution?
ARGUMENTS-
1. Ban on the movie is not justified and curtail the freedom of
speech on artistic expression of artist. ban on the movie will be
also indirect infringement of article 19 G which upholds
individual liberty to earn his livelihood freely as the ban on the
movie will create a huge monetary setback to the producers
and artist of the movie and this economy penalty on the film
maker will also work as landmark judgement which will compel
other artists to restrict their imagination and creativity which is
really hazardous for countries intellectual treasure.
2. . My second argument is based on two facts,
The petition to ban the movie in itself is not maintainable as
sensor board which gain it power from cinematic graphic act
1952 and the government had cleared the screening of film
with ua 18 +certificate and reasonable disclaimer.
This movie is based on a fictional novel of 10 ground which was
written with imagination and creativity and with intention to
entertain people not to heard they religious sentiments and
this book was launched in 2003 and opposition opposition to it
came after 3 hours when movie got launched if the novel on
which the movie is based was existing in Indian market for last
3 years without operation then why there is a demand the
movie based on same literature and same intention to
entertain people in the light of this facts it could be concluded
that the demand the movie is some very unreasonable and
seems to be a conspiracy

COUNTER ARGUMENTS
1. The movie is considered direct attack on the core foundation
of Christianity by suggesting Christianity was founded as a
cover up and that the Catholic Church has hidden the truth
about christ's marriage for nearly two thousand years.
REPLY- I will like to counter my opponent argument by
explaining her the basics of the fiction. Fiction is something
which is totally based on imagination and creativity.
Imagination is not bounded by trith. And when you talk
about religion it's something which is solely and purely
based on the faith and beliefs and it's a well entrenched
social fact that someone's mere imagination cannot damage
anyone's firm faith and belief.
2. The movie suggests that Jesus was a mortal who married
Mary Magdalene had children together and that their
descendants live in France which attacked the very heart of
the Holy Gospel destroying the divinity of Christianity.
REPLY- Christian countries which have adopted Christianity
as the official religion of the state has also taken this piece of
literature as a artwork and not as a blasphemous content.
They have put forth individual right to freedom of speech
and expression then why should a secular country like India
should ban this movie and curtail right to freedom of speech
and expression of artist.

PRAYER-
Therefore, it is prayed, in the light of issues raised,
arguments advanced and authorities cited, that this Hon’ble
Court may be pleased to:
HOLD, The ban on movie Fire (1996) by Deep Mehta
unlawful under Section 153 of the Indian Penal Code, Article
19(1) of the Indian Constitution and Article 25 of the Indian
Constitution.

DECLARE, the riots and protests against the movie uncalled


for and violation of Fundamental Rights of the people.
