MEMORANDUM
1. Reference:

2. The crime had been committed on September 20, 2020, 9:42 a.m. in Purok
10, Habitat Village, Tabalong, Dauis, Bohol.
3. The victim was identified as Aaron Jay B. Villapana, 22 years old, single, and
a resident of Purok 10, Habitat Village, Tabalong, Dauis, Bohol. He was
stabbed four times by the suspect who was identified as Kenneth A.
Labesores, 23 years old, and a resident of the same place. Investigation
conducted disclosed that the suspect and victim argued because of Tong-its,
a card game, when suddenly the suspect ran away, came back holding a
knife and stabbed the victim four times, as a result, the victim sustained
stabbed wounds at the left and right portion of his abdomen, one stabbed
wound in his chest, and one in his neck. The victim was dead when the police
officers arrived. The victim was brought to the Gov. Celistino Gallares
Memorial Hospital and was declared dead-on-arrival by Dr. Martin A. Villegas
(Medico-Legal Officer).
4. On September 20, 2020, past 9:30 in the morning, a witness by the name of
Lhendon V. Acedo, was walking home when he passed by his neighbors,
Aaron Jay B. Villapana and Kenneth A. Labesores who were arguing with
each other while they were playing Tong-its, a card game. This caused the
Kenneth A. Labesores to lose control. The witness saw the suspect, ran away
heading towards his home and came back with a knife. The witness could
attest how frustrated the suspect was based on his facial expressions. The
victim, Aaron Jay B. Villapana, was stabbed four times; as a result, the victim
sustained stabbed wounds at the left and right portion of his abdomen, one
stabbed wound in his chest, and one in his neck. When the suspect came
back to his senses and noticed the victim not moving, he ran away. The
witness tried to check the victim if he was still alive or not. Seeing how his
stab wounds were severely bleeding, the witness immediately called the
police to report the incident that had transpired.
At 9:50 A.M., the police came to the crime scene alongside with the
ambulance to transport the victim to the Gov. Celistino Gallares Memorial
Hospital. The SOCO Team then investigated the crime scene with the help of
the police investigator. The victim was identified through the witness who
reported the incident. Later, investigations revealed the victim sustained
stabbed wounds at the left and right portion of his abdomen, one stabbed
wound in his chest, and one in his neck.
At 10:30 A.M., the police of DMPS received a call from the hospital that the
victim was declared dead-on-arrival by Dr. Martin A. Villegas (Medico-Legal
Officer). The victim did not survive the stab wounds he sustained and the
cause of his death was the stab wounds he sustained when the suspect
stabbed him repeatedly.
This police station conducted further investigation the day after the incident by
interviewing the victim’s neighbors and barangay officials of the said
barangay regarding the background of the victim and the suspect. Interviews
were conducted among family members, neighbors, and barangay officials of
both the victim and the suspect.
This station invited the witness to the Dauis Municipal Police Station for his
statements to be executed, written in an affidavit, and to conduct investigation
towards the incident. The witness narrated how the incident transpired and
how the crime was committed. The same statements were still given by the
witness about the incident.
September 23, 2020, at 8:00 in the morning, the investigators went to the
Tagbilaran City Police Station in order to coordinate with them in finding the
suspect.
On September 25, 2020 at 8:30 p.m., the suspect of the case voluntarily
surrendered to the Dauis Municipal Police Station for his crime. The
investigators then initiated cross-examination of the suspect and he revealed
that indeed he was the person who stabbed the victim. He admitted to the
police investigators that when he noticed the victim was dead, he immediately
ran away. He reasoned out that there was no motive behind and he did not
plan to commit the said act and it was all because of his frustration. He flees
from the crime scene due to the reason that he panicked. He did not realize
what he did until he noticed the victim not breathing. The cause of the victim’s
instantaneous death was due to the stab wounds from the knife that
penetrated into his skin.
The suspect, however, is willing to pay the civil indemnities such as the
victim’s funeral expenses and victim’s compensation in exchange to not file a
complaint against him by the grieving party.
