APPLICATION UNDER SECTION 439 OF THE CODE OF CRIMINAL
PROCEDURE 1973 FOR GRANT OF BAIL Most Respectfully Submitted as under: 1) That the present application under section 439 of the Code of Criminal Procedure 1973 is being filed by the Accused for seeking grant of bail in FIR No. 225/2016 registered at Police Station Dwarka, Sector 1. The bail application is being moved as the accused has been arrested on 19.02.2016 in connection with the said FIR. The petitioner is now in judicial/police custody. 2) That the police have falsely implicated the applicant in the above said case because he has nothing to do with the said matter. 3) That the Petitioner is a law-abiding citizen of India. The petitioner is gainfully carrying on the business of Beauty salon at Dwarka, and there is no chance of absconding from the court of justice. 4) That the accused/ Petitioner is having good antecedents, he belongs to a good family and there are no criminal cases pending against him. 5) That the petitioner is innocent is not involved in any such case and is also submitted that even though there is no sufficient evidence to prove the guilt of the petitioner, for the offence alleged, the trial court has convicted the petitioner and imposed the sentence. It is submitted that there was no light at the alleged place of occurrence and he was apprehended after 5 months of the incident. 6) That the petitioner undertakes to present before the court or police station whenever required. 7) That the petitioner undertakes not the interfere with the evidence or witness of the case in any manner. 8) That the petitioner is willing to accept any other condition that the court or police officer willing to impose in relation with the case. Prayer It is therefore prayed that the court may order for the release of the applicant in the order of justice. And the other order which the court may deem fit and proper in the facts and circumstances of the case may be also passed in the favour of the petitioner.
