titioner did a self-inspection of the allotted flat but the plight of the

allotted flat left her bewildered.

The petitioner orally submitted a written complaint through a letter


dated 28.02.2018 mentioning all irregularities with 27 attached
photographs showing the plight of the allotted building in the office of
Divisional Estate Manager. It, however, remained unanswered.

The petitioner also filed an application under Right to Information Act


to get information regarding drawings and breakup price of the
allotted building. But the Board members provided inconsistent
information even after collecting the receipt of Rs 10 and document fee
of Rs 261 under the Right to Information Act.

The estimated time for completion of project at the time of registration


under the project was about three years. In those three years the
petitioner had deposited around 90.58 percent of Rs. 18,21,500 the
estimated cost of the building i.e. Rs. 16,50, 000 to the board. But the
building was not ready for possession even after six years. Due to this,
petitioner is facing many economic difficulties.

The petitioner requested the Estate Officer for corrections in the


construction of building as per approved drawings and specifications
and getting the possession at the earliest. However, the C.H.C.B failed
to reply the complaint hitherto.

The applicants on 09.05.2018 instituted a case in Chhattisgarh Real


Estate Regulatory Authority (hereinafter referred to as RERA, Raipur
bearing case no. M-PRO-2018-00047 as the allotted building was
constructed arbitrarily in deviation of approved plans and norms, and
requested possession after its construct as per approved drawings,
design and specifications, construction of boundary wall and main
entrance gate of the building, return of Rs, 24,523 with interest
charged as better location charge, interest on total amount paid for
the allotted building for duration of 3 years, and the difference
between estimated cost of the building and cost as per re revised final
allotment order.

The petitioner alleged that the final allotment price fixed by the
Chhattisgarh Housing Board is about 4 to 5 lakh
