APPLICATION FOR RELESING APPLICANT/ACCUSED ON


PERSONAL BOND

MOST RESPECTFULLY SHOWETH:-

1. That the applicant/accused is in the judicial custody since 27.03.2021.

2. That as the Covid-19 Pandemic is on the rise and the occupancy of the

jails are more than its lodging capacity, resulting social distancing is not

possible to a great extent in the right earnest.

3. That it is pertained to mentioned here that in such a grave situation of the

pandemic COVID-19 in Delhi as well as all over Country.

4. That the applicant/accused has already undergone more than 15 DAYS .

5. That in SANJAY CHANDRA Vs CBI (2012) (1SCC 40), the Hon’ble

Supreme Court of India has held that the object of bail is to secure the
appearance of the accused person at his trial. The object of bail is neither

punitive nor preventive. Deprivation of liberty must be considered a

punishment unless it can be required to ensure that an accused person will

stand trial when called upon. Moreover, it is well settled principle of

criminal jurisprudence that generally rule is bail and not jail.

6. That the inmates inside prison are highly prone to contagious viruses and

the rate of ingress & egress in the prisoners is very high and that too on a

daily basis. Furthermore, prisoners are again becoming fertile breeding

grounds for incubation of COVID-19, furthermore presently the rate of

ingress inside the prison is exceeding the rate of egress which is resulting

in steep increase of cases inside the jail. The Hon’ble Court can be

pleased to grant bail to the applicant/ accused in order to decongest the

prison and prevent the further spread of the infection inside the jail.

7. That this Hon’ble Court has granted bail on dated 15/04/2021. The

applicant/ accused belongs to very poor family. So please allow

applicant/accused released on personal bond.

8. That the applicant/accused undertakes to abide by all the terms and

conditions imposed upon him at the time of release on personal bonds to

the satisfaction of the Hon’ble Court or any instruction by this Hon’ble

Court.
9. That applicant undertakes before this Hon’ble Court that he will never

abuse the process of law and never temper with the evidence and will live

peacefully within the society.

PRAYER

It is therefore most respectfully prayed that this Hon’ble

Court may kindly graciously be pleased to release on personal bond to the

applicant/accused in the interest of justice.
