Subject: APPEAL FOR ISSUANCE OF APPOINTMENT ORDER AGAINST 100%
DECEASED/MEDICAL GROUNDS EMPLOYEE CHILDREN QUOTA Respected Sir, With due reverence, in continuation to my earlier appeals/applications, it is submitted that my father namely Mr. Amin ul Haq was working as Junior Clerk in the office of Assistant Registrar, Cooperative Societies, Kohat who was retired from service on medical Grounds vide order No. 2084-52 dated 12-11-1995. Consequently, I applied for the post of Inspector under the subject quota in your department and also took interview for the said post on 04.11.2019. However, due to unknown reasons, my appointment order was not issued and rejected. It is pertinent to mention here that earlier my brother was also rejected by the Departmental Selection Committee on the ground of having 3rd division, and now I was rejected despite having good academic grades. Accordingly, I filed an appeal for reconsidering my appointment order and for intimation of reasons of rejection in writing (Copy attached), but in vain. It is worth-mentioning here that I was told by your department officials that I was rejected on ground that I was married and they have rules that deceased/medical- retirement children employment quota can only be extended to unmarried daughters. In this regard I would like to mention here the High Court Orders as precedent i.e. WP Titled Mst. Nadia Ambareen D/o Muhammad Hussain V/S DEO(F) Kohat, Director E&SE, Secretary E&SE and other Writ Petitions (Copies Enclosed) whereby the Hon’ble Court interpreted and explained the Rule 10(4) Part-III Initial Appointment of THE KHYBER PAKHTUNKHWA CIVIL SERVANTS (APPOINTMENT, PROMOTION &TRANSFER) RULES, wherein it is clearly mentioned that children of the deceased or retired on medical grounds are entitled for appointment subject to having minimum qualification for the given post regardless of gender or marital status. It is further explained that Children of the government servant means Son and Daughter where nowhere mentioned that only unmarried children are entitled for initial recruitment under the subject quota. Foregoing in view, it is once against requested to issue my appointment orders under the subject quota and oblige. I shall be thankful to you for this act of kindness as it is my legitimate and lawful right but due to poor financial conditions I cannot afford Court case for my right and only your good self can give me Justice, please.
