GEORGIA, BEN HILL COUNTY
IN THE SUPERIOR COURT OF BEN HILL COUNTY,
‘The Grand Jurors selected, chosen and sworn for the County of BEN HILL to wit:
in the name of and on behalf of the citizens of Georgia charge and accuse RYAN DUKE with the
offense of CONCEALING DEATH OF ANOTHER (0.C.G.A. 16-10-31) for that the accused,
on or about the 23rd day of October, 2005, the statute of limitation being tolled for said offense
in that the crime was unknown until February 19, 2017 and the statute of limitation being further
tolled by the Supreme Court of Georgia's declaration of Statewide Judicial Emergency filed
March 14, 2020, and subsequently extended monthly thereafter until June 30, 2021, in the State
of Georgia and the County of Ben Hill, did unlawfully conceal the death of Tara Faye Grinstead,
a human being, at a location off of Bowen's Mill Highway, Ben Hill County, Georgia, which
hindered the discovery of whether or not said person was unlawfully killed , contrary to the laws
of said State, the good order, peace and dignity thereof.COUNT2
and the Grand Jurors aforesaid, in the name and on behalf of the citizens of Georgia further
charge and accuse RYAN DUKE with the offense of HINDERING APPREHENSION OR
PUNISHMENT OF A CRIMINAL (0.C.G.A. 16-10-50) for that the said accused, on or about
the 23rd day of October, 2005, the statute of limitation being tolled for said offense in that the
crime was unknown until February 19, 2017 and the statute of limitation being further tolled by
the Supreme Court of Georgia's declaration of Statewide Judicial Emergency filed March 14,
2020, and subsequently extended monthly thereafter until June 30, 2021, in the State of Georgia,
and the County of Ben Hill, did unlawfully destroy the body of Tara Faye Grinstead, a human
being, evidence of the crime of Murder, a felony, a crime the accused knew or had reasonable
grounds to believe had been committed by Bo Dukes, individually or as a party to the crime,
with the intent to hinder the punishment of said person, contrary to the laws of said State, the
good order, peace and dignity thereof.
COUNT3
and the Grand Jurors aforesaid, in the name and on behalf of the citizens of Georgia further
charge and accuse RYAN DUKE with the offense of CONCEALMENT OF FACTS (0.C.G.A.
16-10-20) for that the said accused, on or about the 23rd day of October, 2005, the statute of
limitation being tolled for said offense in that the erime was unknown until February 19, 2017
and the statute of limitation being further tolled by the Supreme Court of Georgia's declaration of
Statewide Judicial Emergency filed March 14, 2020, and subsequently extended monthly
thereafter until June 30, 2021, in the State of Georgia and the County of Ben Hill, did
unlawfully, knowingly, and willfully conceal and cover-up the location of the body of Tara Faye
Grinstead, a material fact in the missing persons investigation of Tara Faye Grinstead, a matter
within the jurisdiction of the Ocilla Police Department, an agency of the City of Ocilla, Georgia,
2 political subdivision, by participating in burning the body of Tera Faye Grinstead, contrary to
the laws of said State, the good order, peace and dignity thereof.COUNT 4
and the Grand Jurors aforesaid, in the name and on behalf of the citizens of Georgia further
charge and accuse RYAN DUKE with the offense of CONCEALMENT OF FACTS (O.C.G.A.
16-10-20) for that the said accused, on or about the 24th day of October, 2005, the statute of
limitation being tolled for said offense in that the crime was unknown until February 19, 2017
and the statute of limitation being further tolled by the Supreme Court of Georgia's declaration of
Statewide Judicial Emergency filed March 14, 2020, and subsequently’ extended monthly
thereafter until June 30, 2021, in the State of Georgia and the County of Ben Hill, did
unlawfully, knowingly, and willfully conceal by scheme his knowledge of the murder of Tara
Faye Grinstead, a material fact in the missing persons investigation of Tara Faye Grinstead, a
matter within the jurisdiction of the Georgia Bureau of Investigation, an agency of the State of
Georgia, a political subdivision, by concealing the location of the remains of Tara Faye
Grinstead after having participated in buming her body, contrary to the laws of said State, the
‘good order, peace and dignity thereof.
COUNT 5
and the Grand Jurors aforesaid, in the name and on behalf of the citizens of Georgia further
charge and accuse RYAN DUKE with the offense of TAMPERING WITH EVIDENCE
(O.C.G.A. 16-10-94) for that the said accused, on or about the 23rd day of October, 2005, the
statute of limitation being tolled for said offense in that the crime was unknown until February
19, 2017 and the statute of limitation being further tolled by the Supreme Court of Georgia's
declaration of Statewide Judicial Emergency filed March 14, 2020, and subsequently extended
monthly thereafler until June 30, 2021, in the State of Georgia and the County of Ben Hill, did
unlawfully and knowingly destroy physical evidence, the body of Tara Faye Grinstead, a human
being, said evidence involving the prosecution of the offense of Murder, a serious violent felony
as defined in subsection (a) of Code Section 17-10-6.1 of the Official Code of Georgia, with
intent to obstruct the apprehension and prosecution of Bo Dukes, another person, when he did
bur the body of Tara Faye Grinstead, contrary to the laws of said State, the good order, peace
and dignity thereof.COUNT 6
and the Grand Jurors aforesaid, in the name and on behalf of the citizens of Georgia further
charge and accuse RYAN DUKE with the offense of TAMPERING WITH EVIDENCE
(O.C.G.A, 16-10-94) for that the said accused, on or about the 23rd day of October, 2005, the
statute of limitation being tolled for said offense in that the crime was unknown until February
19, 2017 and the statute of limitation being further tolled by the Supreme Court of Georgia's
declaration of Statewide Judicial Emergency filed March 14, 2020, and subsequently extended
monthly thereafter until June 30, 2021, in the State of Georgia and the County of Ben Hill, did
‘unlawfully and knowingly conceal physical evidence, the body of Tara Faye Grinstead, a human
being, suid evidence involving the prosecution of the offense of Murder, a sericus violent felony
as defined in subsection (a) of Code Section 17-10-6.1 of the Official Code of Georgia, with
intent to obstruct the apprehension and prosecution of Bo Dukes, another person, when he did
‘move the body of Tara Faye Grinstead from one location to a more remote location, contrary to
the laws of said State, the good order, peace and dignity thereof.
