The Magna Carta

The Magna carta played a crucial role in the making of the two most important united
states documents, the bill of rights and the United States Constitution, it set forth values that
oppressed the possibility of tyrants it captured American distrust in concentrated political power
and protecting rights to unlawful searches and seizures, the right to a speedy trial, the right to a
jury trial in both civil and criminal cases and Protection from loss of life, liberty, or property
without due process of law.
One of the major principles incorporated from the Magna Carta is the due process of
law. As said in the document “No free man shall be seized or imprisoned, or stripped of his
rights or possessions, or outlawed or exiled, or deprived of his standing in any other way, nor
will we proceed with force against him, or send others to do so, except by the lawful judgement
of his equals or by the law of the land.” Also known as the habeas corpus. This is still in
reflection today because in the US Constitution protects the rights of citizens to be fully
subjected to the process of the legal system then to have no rights to protect or prove their
innocence “nor to deny to any person within its jurisdiction the equal protection of the laws.” As
stated in fourteenth amendment of the United States constitution. Another thing under the
principle of due process is the right to a jury trial in both civil and criminal proceeding to be
judged by a jury of you peers and to the right of a speedy and quick trial.
The first ideal of checks and balances was set by the Magna Carta in the document it says
that the power of monarchy isn’t absolute and the branches of government should be divided to
prevent the takeover of a tyrant by both the people and the government. This was taken and used
in to today’s government as an Executive, Legislative and Judicial branches of the United States.
The Magna Carta has many similarities and principles pulled to make the documents of the
US today. This shows the Magna Carta is a good document that affected us a lot today and the
principles still stand today in protecting the right of the people and the limited power of the
federal government.
