(2) Subject to the provisions of any law made in this behalf by Parliament, the Supreme Court
shall, as respects the whole of the territory of India, have all and every power to make any order
for the purpose of securing the attendance of any person, the discovery or production of any
documents, or the investigation or punishment of any contempt of itself
Article 142 of the Constitution vests unfettered independent jurisdiction to pass any order in
public interest to do complete justice, if exercise of such jurisdiction is not be contrary to any
express provision of law.
One of the important instances of application by the Supreme Court of Article 142 was in the
Union Carbide case — relating to the victims of the Bhopal gas tragedy — where the Court felt
a need to deviate from existing law to bring relief to the thousands of persons affected by the gas
leak. In this judgment, the Supreme Court, while awarding compensation of $470 million to the
victims, went to the extent of saying that to do complete justice, it could even override the laws
made by Parliament by holding that, “prohibitions or limitations or provisions contained in
ordinary laws cannot, ipso facto, act as prohibitions or limitations on the constitutional powers
under Article 142.” By this statement the Supreme Court of India placed itself above the laws
made by Parliament or the legislatures of the States.

In Kalyan Chandra Sarkar v. Rajesh Ranjan, (2005) 3 SCC 284, the Supreme Court after
reiterating that in exercise of its jurisdiction under Article 142 of the Constitution would not pass
any order which would amount to supplanting substantive law applicable to the case or ignoring
express statutory provisions dealing with the subject, observed that “It may therefore be
understood that the plenary powers of this Court under Article 142 of the Constitution are
inherent in the court and are complementary to those powers which are specifically conferred on
the court by various statutes though are not limited by those statutes. These powers also exist
independent of the statutes with a view to do complete justice between the parties...and are in the
nature of supplementary powers...(and) may be put on a different and perhaps even wider footing
than ordinary inherent powers of a court to prevent injustice. The advantage that is derived from
a constitutional provision couched in such a wide compass is that it prevents 'clogging or
obstruction of the stream of justice’.

The Supreme Court in a number of cases had battled with tracing the contours of the provision
in Articles 136 and 142 of the Constitution of India. Distinctively, although the words employed
under the two aforesaid provisions speak of the powers of this Court, the former vest a plenary
jurisdiction in the Supreme Court in the matter of entertaining and hearing of appeals by granting
special leave against any judgment or order made by a Court or Tribunal in any cause or matter.
The powers are plenary to the extent that they are paramount to the limitations under the specific
provisions for appeal contained in the Constitution or other laws. Article 142 of the Constitution
of India, on the other hand is a step ahead of the powers envisaged Under Article 136 of the
Constitution of India. It is the exercise of jurisdiction to pass such enforceable decree or order as
is necessary for doing 'complete justice' in any cause or matter.
Article 142 of the Constitution of India is supplementary in nature and cannot supplant the
substantive provisions, though they are not limited by the substantive provisions in the statute. It
is a power that gives preference to equity over law. It is a justice-oriented approach as against the
strict rigours of the law. The directions issued by the court can normally be categorized into one,
in the nature of moulding of relief and the other, as the declaration of law. “Declaration of law”
as contemplated in Article 141 of the Constitution: is the speech express or necessarily implied
by the highest court of the land. The Supreme Court in the case of Indian Bank v. ABS Marine
Products (P) Ltd., (2006) 5 SCC 72, Ram Pravesh Singh v. State of Bihar, (2006) 8 SCC 381
and in State of U.P. v. Neeraj Awasthi, (2006) 1 SCC 667, has expounded the principle and
extolled the power of Article 142 of the Constitution of India to new heights by laying down that
the directions issued under Article 142 do not constitute a binding precedent
unlike Article 141 of the Constitution of India. They are direction issued to do proper justice and
exercise of such power, cannot be considered as law laid down by the Supreme Court

It is true that Article 142 has been invoked for the purpose of doing tremendous good to large
sections of the population and indeed to the nation as a whole. The Supreme Court has perceived
its role as one which would require it to ‘wipe away every tear from every eye’, but perhaps it is
time that the use of this vast, unlimited power included checks and balances.
While one ponders over the possible solution to this conundrum, one cannot lose sight of the fact
that today, in Supreme court of 31 judges who sit in thirteen divisions of two or three to
deliberate on the seminal legal issues of the day. One would even be compelled to observe that
India has thirteen Supreme Courts as each division represents, by itself, the Supreme Court of
India, and each bench is independent of the other. Therefore, all cases invoking Article 142
should be referred to a Constitution Bench of at least five judges so that this exercise of
discretion may be the outcome of five independent judicial minds operating on matters having
such far-reaching impact on the lives of people. It also propose that in all cases where the court
invokes Article 142, the government must bring out a white paper to study the beneficial as well
as the negative effects of the judgment after a period of six months or so from its date.
