I have also been advised that you have refused to remedy these breaches despite requests by my clients to do so. 1am attaching a letter from the Landlords which is self-explanatory. The Landlords strongly urge you to vacate the premises, failing which I have been instructed to take immediate action against you without further notice, the costs of which will be charged to you. ‘Your immediate attention to this is expected, NWPP:vs - Encls. * NICO W.P. EMAIL: ico@pauillaweca October 5, 2020, Mr. Blijah Barnett and Mr. John Demuynck, Re: Tenancy at 468 Ontario Street Upon the showing of the basement apartment, your personal inspection of the apartment, and the signing of the rental agreement at 468 Ontario Street, the unit was in pristine condition. All of the appliances, including the windows were brand new and working perfectly. In the three years of the building’s existence, only 1 other tenant lived in the apartment before you. Upon their vacancy, the entire apartment was inspected for any damages or issues. None were noted. ‘You recently sent a letter to the landlords regarding the repair and maintenance of window sereens. However, from the first day of your tenancy, on July 1, 2020, you never mentioned any issues with the windows. We believe that you have neglectfully and deliberately caused damages to the screens, thus allowing bugs and other living organisms to come into the apartment, posing a future threat to damaging the apartment and the other apartments above you. In this same negligent way, you have ignored the “no-smoking in your unit” policy, which you signed in your lease agreement. AS a result, you have obnoxiously infiltrated the entire ibuilding with the smell of nicotine and marijuana smoke by smoking in your unit, affecting not only the reasonable enjoyment of the other tenants, but causing one of the tenants to end their tenaney early. Furthermore, our security cameras have recorded you smoking in the common hallways and less than 9 m from the entrance of the building multiple times, breaking the City of Toronto Municipal Code Chapter-709 Smoking By-Law. ‘You deliberately called the Toronto Fire inspector after illegally trespassing into the building’s mechanical room where you took photos of the wiring and insulation and then sent these photos to the landlords, posted them on social media, and distributed them to other people in the neighbourhood. ‘You have signed a lease that agrees to pay for 80% of the total monthly electricity bill. I have provided you with the past 12 months of electricity usage using the proper form available on the Landlord and Tenant Board’s website, Throughout your tenancy, you have used the outlets lights, stove, refrigerator, dishwasher, washer and dryer and a brand new air conditioner, which was lent to you during this past summer’s heat wave, However, you have refused to pay for all of the electrical bills sent to you regarding your electricity usage. To date, you owe $95.75 for the bill dated August 14, 2020 and $90.58 for the bill dated September 15, 2020, Recently, you have decided not to pay your rent in the amount of $1,900 (nineteen hundred dollars) for the month of October 2020. On Thursday, October 1, 2020, Mr. Barnett uttered death threats to the landlord which was followed by a criminal charge laid by the Toronto Police on Friday, October 2, 2020. On Saturday, October 3, 2020, at approximately 11:05 pm, you maliciously left music blasting after you vacated the apartment for the evening, This affected everyone in the building as well as the adjoining one. There are 9 residential tenants in total between both buildings and all 9 were affected by this, including the patrons of The Irv, the commercial space on the ground floor. On Sunday, October 4, 2020, at approximately 4:17 pm, you once again blasted music from your apartment, disturbing the enjoyment of the other tenants in the building, The intentional verbal harassment towards other tenants in the building, personally leaving inappropriate notes on their doors, yelling profanities in the common hallway for all the tenants to hear inside and outside the building, and waiting for tenants in the parking lot to harass them is completely unacceptable and criminal behaviour which has been captured on our security cameras and reported to the police. On October 4, 2020, police officers came to your apartment several times in response to reports made by the tenants in the building about your criminally harassing and inappropriate behaviour. This is unsettling and makes the tenants feel unsafe. Furthermore, the presence of police at our building is leaving a poor impression to the rest of the neighbourhood and is, harmful for the reputation for future tenants of the building In addition, you have installed an illegal camera outside your apartment door, capturing the common hailway that is accessed by the public. This must be removed immediately. Itis obvious that your tenancy at 468 Ontario Street is not enjoyable nor is it enjoyable for the other tenants in the building or the landlords, Please consider ending your tenancy by the ‘end of this month without penalty of paying the remaining months. You can e-transfer the total amount owing for the electricity bills. I believe this will be the best option for everyone involved.
