STATEMENT OF CLAIM

1. The Plaintiff is a company incorporated in Malaysia under Companies Act 2016 with
bearing registration no ……….. and having a registered business at No. 17-A, Jalan
Utama, Taman Bukit Beruang Utama, 75450 Melaka. The Plaintiff is in the business of
operating bookstore.

2. The Defendant is a company incorporated in Malaysia under Companies Act 2016 with
bearing registration no ……….. and having a registered business at ……….. The
Defendant is in the business of printing books.

3. On 08.01.2013, the Plaintiff had duly executed an agreement with the Defendant to
purchase 500 children’s story books with the total purchase price of RM 15,000.00
which should be paid by 21.01.2013. The Defendant agreed to deliver the 500
children’s story books by 28.01.2013

4. Plaintiff claimed that it had paid full purchase price to the Defendant in accordance to
agreement on 21.03.2013 for the 500 children’s story books.

5. Plaintiff further claimed the Defendant informed through a letter dated 27.03.2013 that
it will not deliver the 500 children’s story books to the Plaintiff.
 6. Plaintiff claims that the Defendant had breached the agreement by failing to deliver the
500 children’s story books.

7. Plaintiff claims that the Defendant failed to return the full purchase price paid for the
500 children’s story books.

8. Plaintiff now suffers monetary loss from the said breach.

9. Plaintiff pray to the Court and claims against the Defendant for:-

a) The sum total purchase of RM 15,000.00 being the price of the

children’s story books paid to the Defendant;
b) Interest;
c) Costs;
d) Such further or other relief that this Honourable Court deems fit and
proper.

DEFENCE

1. The Defendant are referring to paragraph 1 of the Statement of Claim and admit the
statement made in the claim.

2. Referring to paragraph 2 and 3 of the Statement of Claim and the Defendant deny the
claim. The Defendant firmly stated that they had not failed to make delivery of the
consignment of vanilla pods.

3. Referring to paragraph 2 herein, the Defendant aver that they had attempted to deliver
consignment of vanilla pods as per the agreement on both 12.04.2011 and 19.04.2011
but the Plaintiff refused to accept the delivery or make payment thereof.

4. Defendant strictly stated that the Plaintiff wrongfully not accepted the consignment of
vanilla pods.

5. Save as hereinbefore expressly admitted, the Defendant denies each and every
paragraph of the Statement of Claim as if the same were set out herein and traversed
seriatim.

6. The Defendant humbly pray for the Court to dismiss the Plaintiff’s claim with costs.
 COUNTERCLAIM

1. Defendants are raising claims against the Plaintiff based on breach of agreement.

2. Defendant are claiming against the Plaintiff for:-

a) RM 2,750.00 being the purchase price of the vanilla pods
b) Costs;
c) Interest;
d) Such further or other relief that this Honourable Court deems fit and proper.

2. The Defendant is a company incorporated in Malaysia under Companies Act 2016 with

is in the business of supplying hardware, machinery and tools.

3. On 08.08.2016, the Plaintiff had duly executed an agreement with the Defendant to
purchase “the Goods” with the total purchase price of RM 25,000.000. The Defendant
agreed to deliver ‘GREAT Professional Tools’ of various descriptions (‘the Goods’) by
30.08.2016.

4. Plaintiff claimed that it had paid the full purchase price to the Defendant in accordance
to the agreement on 26.08.2016 for the goods.

5. Plaintiff further claimed that Defendant informed through a letter dated 29.08.2016 that
it will not deliver the goods to the Plaintiff.
 6. Plaintiff claims that the Defendant had breached the agreement by failing to deliver the
goods.

7. Plaintiff claims that the Defendant failed to return the full purchase price paid for the
goods.

8. Plaintiff now suffers monetary loss from the said breach.

9. Plaintiff pray to the Court and claims against the Defendant for:-

a) The sum total purchase of RM 25,000.000 being the price of the goods
paid to the Defendant;
b) Interest;
c) Costs;
d) Such further or other relief that this Honourable Court deems fit and
