On September 27, 1971, during the hearing ~f this
case, it was ordered in open court that action on the
case be heid in abeyance pending receipt by this Court
of a copy of the memorandum of the Appellate Division
of the Bureau of Internal Revenue recommending the
refund or tax credit of the sum of ~16,533 . 66 being
claimed by the Testate Estate of the l~te Don Roman
R• .Santos• It was also ordered that respondent submit
within ten dais a cop~ of the order of respondent
granting refund or tax credit in favor of the Estate
of the said sum of ~16,533 . 66 . On the same date,
counsel for respondent submitted one additional folder
of BIR records consisting of lo6 pages, containing a
copy of the order granting the tax credit
