To ensure a fair, effective and expeditious handling of seafarer’s complaints alleging breaches of the
requirements of the MLC 2006 convention.
It is of great importance that individuals have a fair and reasonable hearing in regard to grievances or
complaints that crew members feel justified.
All members of the crew are fairly and courteously treated. Crew members respond diligently and
efficiently to lawful commands and orders of superiors.
A crew member feeling unfairly treated or discriminated follows below flow chart.
Persons on board authorized to provide seafarers with confidential and impartial advice on a
complaint or to assist in following the on-board complaint procedures are as appointed on
board by the ship safety committee and will be published on ship’s notice board.

Every seafarer shall be provided with a copy of this on board complaint procedure.
In exceptional cases only, e.g. if any of the above on board contact person is deemed having
responsibility for the cause of the complaint, the seafarer has the right to differ from the above
complaint procedure, and to complain directly to the Master, to the ship owner (crew managed
ships), the DPA or Fleet Personnel Manager, or to the above listed external authorities.

In any case, all involved aspire after amicable solutions to maintain harmonious work
relationships and to avoid costs, e.g. for dismissals.
Complaints shall be made in writing using the “MLC Crew Complaint Tracking” form
SMC Fleet Personnel will keep a track of open and closed crew complaints using form
CRM23.
Seafarers shall have the right to be accompanied or represented during the complaint
procedure, and shall not be victimized.
Persons involved in the handling of an individual crew complaint must keep the matter
confidential
If a third party representative has a complaint concerning the Master or a crew member,
the Master investigates and reports explanation to the shore based organisation. If the
complaint appears unjustified, the complainant is informed accordingly and requested to
accept the explanation. If the complaint appears justified, a representative of the shore
based organisation or the crew manager investigates, if required also on board.
Appropriate measures, which may include disciplinary actions, are implemented, and the
complainant and the Master informed accordingly.
Clarification of complaint resolution process:
Upon receipt of the complaint from the seafarer, the head of department shall endeavour
to resolve complaints within 5 days. If there is no resolution, the complaint will be
transferred to the master who shall endeavour to resolve it within 5 days.
If the complaint cannot be resolved on board in 10 days then it will be transferred to the
company. In the company the complaint is given to 2 personnel - Designated Person ashore
and his /her designee Fleet Personnel Manager and the shipowner (CM ships). Both Fleet
Personnel and the ship owner (CM ships) must resolve the complaint in 8 1 days. This period
of 8 days runs simultaneously from the day of receipt of complaint in the office. The final
decision must be conveyed to the complainant through the master.
If the seafarer is not satisfied, he may approach the flag state within 20 days after receipt
of the decision from office.
The Designated Person Ashore monitors compliance with the complaints process.
