GR: No one is allowed to wiretap any person. (Sec. 3 par.1 of the Constitution)
• As exception, the court may issue an order authorizing the law enforcement agency to
wiretap a person or group of persons in certain crimes such as: treason, mutiny, rebellion,
sedition, kidnapping, & other offenses against national security.

• Note: If a person wiretap another in violation of Sec. 3 (1) of the Constitution, and later on
introduced the private communication to the courts as evidence, such recorded
communication will be declared as INADMISSIBLE evidence or “fruit of the poisonous
tree”. Why? Because every private communication shall remain private.
• But the rule is always subject to the exceptions stated above.
Obscenity
Obscenity - includes materials, when taken as whole, appeals to the prurient
interest and lacks serious literary, artistic, political, or scientific value.

• How to determine if the material is obscene? (Requisites)

1. The subject as a whole appeals to the prurient interest of an average person,

using contemporary community standards;

2. The work depicts or described a patently offensive way of sexual conduct as

prohibited by law; and

3. The work as a whole lacks serious literary, artistic, political, or scientific value
Contracts voluntarily entered shall be respected
“No law impairing the obligations and contracts shall be passed.”

• The Civil Code of the Phil. Provides that the contract between the parties shall bind them, unless
it violates the law or it is against public policy.

• GR: Courts will not intervene with the contracting parties, unless one party goes to court and ask
a relief because of another party’s breach of contract, or to nullify the contract itself for being void.

• EXPN: Contracts may be invalidated when the State exercised its police power.

• What is police power? It is the power of the State to create a law to promote the general welfare
of the people.

• And in cases when the general welfare of the people will be endangered because of a contract,
the State can intervene and exercise its police power to invalidate the contract
Practice of Profession
If a foreigner, also called as “alien”, would like to be employed in the Philippines,
he/she must secure a working visa and and alien working permit from the Bureau of
Immigration and Dept. of Labor & Employment (DOLE)
