1f a child under sixteen teen years of age is employed as domestic, the head
of the family shall give him an opportunity to complete at least elementary
education at required by the Code. The cost of such education shall be a
part of the domestic’s compensation unless there is a stipulation to the
contrary. (Art. 110)
Public and private child welfare agencies providing encouragement, care, and
protection to any category of children and youth are classified and defined as
follows:
Receiving home - a family-type home which provides temporary shelter from ten
to twenty days for children who shall during this period be under observation
and study for eventual placement by the Department of Social Welfare.
Abandoned child - One who has no proper parental care or guardianship or whose
parents or guardians have deserted him for a period of at least six continuous
months. Neglected child - one whose basic needs have been deliberately
unattended or inadequately attended.
a. Physical neglect - when the child is ma1nourished, ill clad and without
proper shelter. A child is unattended when left by himself without provisions
for his needs and/or without proper supervision.
b. mentally subnormal;
d. retarded at maturity;
e. mentally deficient as a result of constitutional origin, through hereditary
or disease, and
f. essentially incurable.
Mentally Ill Child - those with any behavioral disorder, whether functional or
organic, which is of such a degree of Severity as to require professional help
or hospitalization
If after hearing the evidence in the proper proceedings, the court should find
that the youthful offender has committed the acts charged against him the
court shall determine the imposable penalty, including any civil liability
chargeable against him. However, instead of pronouncing judgment of
conviction, the court shall suspend all further proceedings and shall commit
such minor to the custody or care of the Department of Social Welfare, or to
any training institution operated by the government or duly licensed agencies
or any other responsible person, until he shall have reached twenty-one years
of age.
When the youthful offender has reached the age of twenty-one while in
commitment, the court shall whether to dismiss the case or to pronounce the
judgment conviction.

SPECIAL PROTECTION OF CHILDREN AGAINST CHILD ABUSE, EXPLOITATION AND
DISCRIMINATION
Children - refers to persons below eighteen (18) years of age or those over
but are unable to fully take care of themselves or protect themselves from
abuse neglect, cruelty, exploitation or discrimination because of a physical
or mental disability condition.
Child abuse - refers to the maltreatment, with habitual or not, of the child
which includes any of the following:
a. Psychological and physical abuse, neglect, cruelty, sexual abuse, and
emotional maltreatment;
b. Any act by deeds or words which debases, degrades or demeans the intrinsic
worth and dignity of a child as a human being;
c. Unreasonable deprivation of his basic needs for survival, such as food and
shelter; or
d. Failure to immediately give medical treatment to an injured child resulting
in serious impairment of his growth and development or in his permanent
incapacity or death.
Those who commit the act of sexual intercourse of lascivious conduct with a
child exploited in prostitution or subject to other sexual abuse.
CHILD TRAFFICKING
Child trafficking is committed by any person who shall engage in trading and
dealing with children including, but not limited to, the act of buying and
selling of a child for money, or for any other consideration, or barter.
Keeping in a Company a minor, twelve (12) years or under or who is ten (10)
years or more his junior in any public or private place, hotel, motel, beer
joint, discotheque, cabaret, pension house, sauna or massage parlor, beach
and/or other tourist resort or similar places, except when the perpetrator is
related within the fourth degree of consanguinity or affinity or any bond
recognized by law.
Taking the minor to any public or private place of accommodation, whether for
occupancy, food, and drink or otherwise, including residential places by
person, owner, manager, or anyone entrusted with the operation.
Using, coercing, forcing or intimidating a Street child or any other child to:
a. Beg or use begging as a means of living;
b. Act as conduit or middlemen in drug trafficking or pushing; or
e. Conduct any illegal activities
EMPLOYMENT OF CHILDREN
Children below fifteen (15) years of age shall not be employed except:
1. When a child works directly under the sole responsibility of his parents or
legal guardian and where only members of the employers family are employed,
provided:
a. That his employment neither endangers his life, safety and health and
morals, nor impairs his normal development; and
b. That the parent or legal guardian shall provide the said minor child with
the prescribed primary and/or secondary education; or
