Sub : Borewelt in Iris court OSR area for emergency water needs of residents
To whomsoever it may concern. We are owners of apartment in Iris court, Mahindra world city.
Since we have not been provided with water supply through out the year from the MITL water
treatment plant to our premises. We are going ahead with borewell in our OSR area to manage our
emergency water needs. This conforms ta the MOU signed between MITL and owners association
where we have been provided option to go for external source of water as MITL cant assure water
supply which infact is against the SEIAA clearance terms.
We have written separately to Tamil Nadu Ground water authority regarding the construction of
‘bareweil in our premises for emergency needs.

Ref: Your letter dated 5.12.2020
We refer to your letter dated 5.12.2020 in regard to digging/construction
of borewell in OSR area.
As you are aware, Mahindra World City Developers Limited (MWCDL)
previously known as Mahindra Industrial Park Limited is the Developer
of Industrial Park comprising of both SEZ and non-SEZ zones. MWCDL,
is approved as a SEZ Developer by the Ministry of Commerce & Industry,
Govt. of India, Dept. of Commerce, SEZ Section, New Delhi vide Letter of
Approval dated 8,9.2004.
As per the said Letter of Approval, MWCDL is supposed to provide all the
utility services to the SEZ inchuding water supply services etc.,
Please note that MWCDL has taken necessary approvals from the
competent authorities for the provision of water supply services.
MWCDL has granted to us on lease a larger land extent of lands upon our
getting a Letter of Approval dated 14.2.2007 from the Ministry of
Commerce & Industry, Govt. of India, Dept. of Commerce, SEZ Section,
New Deshi including 18.01 acres of lands over which IRIS Court project
was developed and completed by us. The lands were leased out to us by
MWCDL vide several registered lease deeds.’ Mahincra oe

Simultancous with the exeestion of lease deeds, we have also entered into.
Services Agreement with MWCDL for the provision of O&M services and
upply services on a chargeable basi
1tis pertinent to note that we are not permitted to source water either by
digging wells or borewells in the said leased plots as MWCDL has
undertaken to provide exchisive water supply services to all the park
occupants including residential townships developed by us and other
developers in the Park.
It is also pertinent to note that MITL in their agreement to lease/lease
deed/documentation with all its customers/Lessees of apartments clearly
stipulated that the customers/Lessees are not permitted to source water
cither by digging wells or borewells within the project site in terms of the
Lease Deed ands Agreement for Services signed with MWCDL as MWCDL
has undertaken to provide exchisive water supply services to all the park
occupants including residential townships developed by us and other
developers in the Park.
It is incorrect to state that we have water treatment plant within the Iris
Court project site.
It is incorrect to state that in the MOU signed between MITL and ICHOA,
ICHOA or any of the customers are permitted to dig/construct borewell in
the OSR area of the project site or anywhere else within the project site.
We note from the letter written by some of the customers/Lessees of
apartments that a letter had been written to the Tami) Nadu Ground
Water Authority seeking permission to dig/construct borewell in the OSR
area.
In this regard, we wish to clarify that this action of seeking permission is
not only inappropriate and also not in good order and against the
contractual terms of the executed documents between MWCDL and MITL
and also MITL and its customers/Lessees.

We would therefore hereby call upon you to withdraw your appli
‘Tamil Nadu Ground Water Authority. Please note that if need be, we will
write to Tamil Nadu Ground Water Authority conveying our strong
objections to such proposal from you.
By a copy of this letter, we keep MWCDL informed of this issue and also
bring to the notice of Tamil Nadu Ground Water Authority.
