COMPLAINT AFFIDAVIT
I, Merlyn Abitona, of legal age, married and resident of Block 1, Sunrise Village,
Matina Crossing, Davao City, under oath declared that:

1. On July 17, 2019, Daryl Pakna Aguilar, murdered his live-in partner Jessa May
Abitona.
2. On July 17, 2019 at 12:45 am. Friday, the witness saw the respondents arrive at the
boarding house seemed to be drunk.
3. They heard loud shouts by the two women with one of them asking for help.
4. Witnesses thought that it was only a family problem. When the commotion receded,
they just ignored the incident.
5. Around 5 a.m., the caretakers of the boarding house, received information from the
suspect through FB messenger. The suspect said that he killed his live-in partner Jessa
May, together with her companions inside the room. He also asked help to Jardin
claiming that he was stabbed by one of the victims.

Joint affidavit of witness

We Sheila May Datuon Ayudtod and Michael Jardin, single, of legal age, Filipinos
and both caretakers of the boarding house, after having been sworn to in accordance with the
law, do hereby and deposed and state:

1. At 12:45 a.m. Friday, they saw the suspect arrive at the boarding house and seemed to
be drunk. He entered the victim’s room.
2. We heard loud shouts by the two women with one of them asking for help.
3. We thought that it was only a family problem. When the commotion receded, they
just ignored the incident.
4. Around 5 a.m., we received information from the suspect through FB messenger.
5. The suspect said that he killed his live-in partner Jessa May, together with her
companions inside the room.
6. He also asked help to Jardin claiming that he was stabbed by one of the victims.
